COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is March 14, 2019.

Thank you for the opportunity to comment on DP19-0063, The Station, 2nd Submittal, a development package application for an approximately 0.37 acre site, located southeast of the intersection of East 19th Street and South 6th Avenue. The property is zoned Commercial 3 (C-3), with the proposed development being a food service use; a brewery and cafe.
This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions shall be identified in the general notes of the revised development plan unless FAA staff with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA) has provided the applicant with written confirmation that filing FAA Form 7460 is not required. The Tucson Airport Authority utilized the Federal Aviation Administration (FAA) Notice Criteria Tool for this project and it identified that filing FAA Form 7460 is required. The following is the response the FAA Notice Criterial Tool provided for this proposed project; "your proposed structure will be in proximity to a navigation facility and may impact the assurance of navigation signal reception." This particular response is one of several listed which the FAA identifies as requiring FAA Form 7460 to be filed.

Condition of approval:
1. "According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception. The project applicant shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp"

Re: Application Review Comments for The Station, Development Plans: DP19-0063 with
associated activity #T19JA00151 & IID-19-07

The purpose of this document is to show the comments from my review. The Applicant has submitted a
revision to the DP Package dated 10 December 2019.
The Applicant has revised the Development Plan drawings to show the following:
1) Building Use: Microbrewery use and Commercial storage have been added to the Food Service
buildings use.
2) Square footage reductions: The east exterior patio area has been reduced from 2,500 sf to 933 sf.
The three buildings have reduced square footage. The total paved area has been reduced from
3,474sf to 1,070sf.
3) Building Height: The actual building height has been reduced from 18' to 15.2'.
4) Building Setback: North setback has been increased from 14.9' to 38.8'.
5) Parking Requirements: IIP approved on 9/11/19 allowing for only 1 required on-site space. 17 spaces have been provided.
6) Solid Waste: Trash bins have been replaced by multiple residential bins as requested by COT.
7) Driveway apron for access to parking spaces from 6th Ave, widened to 24'.
8) Shade Study: 1,365 sf public hardscape shade required, 1,593 sf shade provided. 50% shade
requirement is met.
Based on the drawings provided, I see this revision as a minor change that does not impact the total
massing. I therefore approve these changes.

If development occupant decides to pursue higher capacity refuse/recycle service in the form of front-load container service they would be required to maintain provisions for storing such equipment within the property NOT within any right-of-way and comply with TSM 8-01.0.0.
