Previous comment not fully addressed. 2-06.4.7.A.4 - Provide the existing and proposed use based on the Unified Development Code (UDC) and also provide all applicable Use Specific Standards that apply to the use. Correct duplicate notes indicating the use of the property. Existing and proposed uses are Commercial: Automotive Major Service and Repair (4.9.13.E), Retail: General Merchandise Sales (4.9.9.B.1), Residential: Single-Family Residence. Change this to appropriate residential use if this isn't a single-family use.

Previous comment not fully addressed. 2-06.4.7.A.8.c - Provide a building expansion calculation on the plan. If the building(s) or lot area have been previously expanded, those calculations shall be included. It appears there have been previous expansions on the site which may bring the project over the 25% expansion threshold. Provide a last approved site plan showing previous structures, or modify plan to indicate total expansion over time. Additional comments may be forthcoming.

Previous comment not fully addressed. 2-06.4.9.H.5.a - Provide a vehicle parking space calculation on the plan that provides the number of spaces required and provide. This calculation should also include the accessible requirements. Correct parking calculations. The commercial use (auto repair) is calculated at 1:300. If this is a single-family home it is 2.25 spaces per unit.

Previous comment not fully addressed. 2-06.4.9.H.5.a - Clearly show that the required and provided spaces are shown on the plan. Number the total parking spaces on the plan. Keynote 10 indicates 11 new parking spaces. Illustrate which spaces are new on the plan and provide dimensions to ensure they meet current standards.

Previous comment not fully addressed. 2-06.4.9.H.5.d - Provide a bicycle parking space calculation, Short & Long term, on the plan that provides the number of spaces required and provided. The Commercial use (addition of the storage building) requires 2 short-term and 2 long-term parking spaces. If the expansion calculation on this site total more than 25% additional comments may apply. Also note, class 1 and 2 bike parking is no longer valid categories. Bike parking is classed as either short-term or long-term.

Previous comment not fully addressed. 2-06.4.9.H.5.d - As additional bicycle parking is required provide a detail that demonstrates how the requirements of UDC Article 7.4.9.B.1 & .2, 7.4.9.C and if applicable 7.4.9.D. Dear Ms. Beasley,
Thank you for the opportunity to comment on DP19-0060, MJC Auto Repair Storage Bldg, 2nd Submittal, a development package application for an approximately 0.61 acre site, located northwest of the intersection of East Aragon Road and Old Nogales Highway. The property is zoned Commercial 2 (C-2), with the proposed development being a storage building.
This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, FAA Part 77 airspace, and the City of Tucson Airport Environs Zone. Within the City of Tucson Airport Environs Zone this project site contains Compatible Use Zone 1 (CUZ-1), Compatible Use Zone 2 (CUZ-2), Noise Control District 65 (NCD-65), and the Airport Hazard District for Tucson International Airport.
The Tucson Airport Authority recommends the City of Tucson review the submitted plan set for compliance with the City of Tucson Airport Environs Zone. The Tucson Airport Authority reviewed the submitted plan set and did not notice the City of Tucson Airport Environs Zone being mentioned.
The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions shall be identified in the general notes of the revised site plan.
Conditions of approval:
1. "According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception. The project applicant shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp"
2. "That development shall not cause or potentially affect aviation in the vicinity of the site, including but not limited to, physical obstructions to aircraft operations, interference with operations by way of electrical static, visual obstructions through emissions or glare, and/or the open storage of petroleum products, explosive materials, or materials which attract or lead to the concentration of wildlife."
Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following note into the general notes of the revised site plan. This project is located approximately 300 feet west of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport.
The proposed note would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson - Regional and Global Positioning policy 4 (RG-4).
1. "That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided."
The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. Once the Avigation Easement is recorded please send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.
