This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. 1. This site is nonconforming. Any modification to the site triggers full compliance review. The site must meet current development standards. The following standards are not being met with the proposed development package. a. The required street perimeter yard setback along 6th St and 4th Av is 21' or the height of the structure, as measured from back of existing or future curb. The existing historical setbacks are 0' from the property line. b. Based on a food service use with a total use area of 7,556 square feet, the required number of parking spaces is 76. The existing parking totals 17 spaces, with one space serving as an accessible stall and one space currently handling trash receptacles. Parking spaces must meet dimensional and circulation requirements. See UDC Article 7.4.6. Accessible parking must meet adopted building code standards. c. Trash receptacles are required to be enclosed with standard trash enclosures. See TSM Section 8.01. d. Bicycle parking is required at a standard of 1 space per 2,000 square feet of gross floor area, minimum 2 spaces, for short-term parking and 1 space per 12,000 square feet of gross floor area, minimum 2 spaces, for long-term parking. This site would require 4 short-term spaces and 2 long-term bike spaces. No bike park spaces have been illustrated on the site plan. e. Landscaping is required for this site per UDC Article 7.6.4. Current landscaping on the site does not meet standards according to the underlying zone of C-3. 2. Modifications to development standards may be obtained through the IID Overlay process. Upon approval of an IID application, the DP may be reviewed and approved. 3. The next submittal for this development package must meet the standards of Administrative Manual 2-06.
