Dear Ms. Lee,

Thank you for the opportunity to comment on DP18-0255, Just Smile Orthodontics; 1st Submittal, a development package application for an approximately 0.65 acre site, located northeast of the intersection of West Irvington Road and South Midvale Park Road. The property is zoned Commercial 1 (C-1) and Office 3 (O-3), with the proposed development being a commercial building.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

The Tucson Airport Authority conditionally approves the subject request contingent upon the following condition of approval, as noted below. This condition shall be identified in the general notes of the revised development plan.

Condition of approval:

1. "According to the FAA Notice Criteria Tool, this project is located in proximity to a navigation facility and could impact navigation signal reception. The applicant shall file Form 7460 with the FAA at least 45 days before construction activities begin for the project. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes used which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp"

Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the City of Tucson consider requiring the applicant to add the following note into the general notes of the revised development plans. This project is located approximately 4 miles northwest of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport.

The proposed note would provide a means of assuring that future owners and tenants of the property are aware they are near an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through requiring the property owner to record the Avigation Easement. The Tucson Airport Authority believes this proposed note help to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson - Regional and Global Positioning policy 4 (RG-4).

1. "That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided."

The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. Once the Avigation Easement is recorded please send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

4. 2-06.4.9.H.5.a - Show all motor vehicle off-street parking spaces provided, fully dimensioned. As a note, provide calculations on the number of spaces required (include the ratio used) and the number provided, including the number of spaces required and provided for the physically disabled. The drawing should indicate parking space locations for the physically disabled. A typical parking space detail shall be provided for both standard parking spaces and those for the physically disabled. For information on parking requirements for the physically disabled, refer to adopted building and accessibility codes of the City of Tucson. Design criteria for parking spaces and access are located in Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.

For every six or fraction of six accessible parking spaces, at least one shall be a van-accessible parking space.

1) Sheet 5 Accessible Parking sign detail. Show that the minimum unobstructed vertical clearance of 84" is provided, dimension from grade to the lowest sign. Per City of Tucson (COT) Technical Standards Manual (TSM) section 7-01.4.3
2) Update curb access ramps along W Irvington Rd and the Private Access Drive so that they meet the requirements of PAG standard detail 207
3) Per TSM section 7-01.4.1.A, provide a pedestrian circulation path connection to W Irvington Rd
4) Show on plans the width of existing sidewalks
5) Drainage statement indicates that existing drainage pattern is to the north-west. Proposed site grading largely drains to the south west and south east. Clarify if existing drainage patterns will be maintained. For example the water harvesting area along the north-east property line, the northernmost basin 5 has a bottom elevation which is 1.9' higher than the southernmost basin
6) Provide top/bottom spot grades for all proposed water harvesting areas to show the effective ponding depth is maintained. Note that the grades should take into account the proposed 2" thick layer of screened rock. Provide spot grades at the bottom of each inlet in addition to the spot grades shown at the top of the inlet as currently shown
7) Ensure that roof drains scupper underneath sidewalks. Reference City of Tucson Technical Standards Manual (TSM) section 7-01.4.1.E. It looks like the roof drains do scupper but no detail or keynote is provided
8) Revise the water harvesting area volumes based on constructed volumes. Current volumes assume a 6" depth over the entire area and do not take into account side slopes
9) Confirm that the proposed impervious tributary area to water harvesting areas meets the 1/12 ratio indicated in the drainage statement. Revise grading details as needed to direct more water into the harvesting areas. Show how the proposed plan is in compliance with COT Unified Development Code (UDC) section 7.6.6.C. Particularly the grading of the vehicular use areas should be in such a manner that runoff is directed into landscaped areas
