Dear Ms. Lee,

Thank you for the opportunity to comment on DP18-0143, New Storage; 2nd Submittal, a development package application for an approximately 1.24 acre site located southeast of the intersection of East Wieding Road and South Randall Boulevard. The land use is industrial, with the proposed development being a commercial storage yard.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, City of Tucson Airport Hazard Districts, FAA traffic pattern airspace, and FAA Part 77 airspace.

The Tucson Airport Authority has discovered that notes which were included in a comment letter submitted on the 1st submittal of this project, comment letter dated 8/7/2018, has not been incorporated into the 2nd submittal of this project. The following conditions shall be identified in the general notes of the revised development plan.

Conditions of approval:

“According to the FAA Notice Criteria Tool, this project is located in proximity to a navigation facility and could impact navigation signal reception. If cranes are utilized on the project the applicant shall file Form 7460 with the FAA at least 45 days before construction activities begin for the project. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. The property owner or applicant shall file FAA Form 7460 for all future buildings which are constructed on this property. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp”

“That development shall not cause or potentially affect aviation in the vicinity of the site, including but not limited to, physical obstructions to aircraft operations, interference with operations by way of electrical static, visual obstructions through emissions or glare, and/or the open storage of petroleum products, explosive materials, or materials which attract or lead to the concentration of wildlife.”

"That prior to the City's approval of the development package, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided."

The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder’s Office. Once the Avigation Easement is recorded please send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

4.1 Identification and Descriptive Data
A. All improvements and site information, such as adjacent rights-of-way and property lines, shown on the landscape plan will be identical in size and location to those shown on the base plan (site plan or tentative plat). Should amendments be required to the base plan through the review process, the same amendments will be made to the landscape plan which will then be resubmitted along with the base plan.
7.6.4. LANDSCAPE STANDARDS
The following was not addressed from previous review.
One canopy tree is required for every 33 linear feet of landscape border or fraction thereof, excluding vehicular ingress or egress points.
The length of the street frontage is 156' the required number of trees is 5. Include the required amount of trees within street landscape buffer.
Vehicular Use Areas
General Standards
Within a vehicular use area, one canopy tree is required for each four motor vehicle parking spaces or fraction thereof.
(1) The canopy trees must be evenly distributed throughout the vehicular use area. Every parking space must be located within 40 feet of the trunk of a canopy tree (as measured from the center of the tree trunk).
(2) Fifty percent of the trees required for landscape borders located within ten feet of the paved portion(s) of a vehicular use area may be counted towards both the minimum parking lot canopy tree standard and the landscape border canopy tree standard.
Provide the 5 trees within landscape buffer to meet parking canopy tree requirement.
SCREENING STANDARDS
The purpose of screening is to provide visual barriers, noise reduction, and to provide privacy.
When Required
Screening for individual land uses and zones must be provided as determined in Table 7.6.4-1 and in addition to the required landscape borders. Screening is not required between similar uses in accordance with Table 7.6.4-1.
A 30" screen is required to screen industrial zone from Wieding Rd. Provide screen the entire length of frontage excluding ingress and egress

Provide a complete and detailed response letter describing how each comment from each reviewer has been addressed.
1. Revise the description for the fences. Some fence areas are labeled as existing but are proposed. Other sections appear to be on adjacent properties. Clarify the location of perimeter fences as to whether it is on the subject property or on adjacent property.
2. Provide the required backup spur for the parking spaces closest to the proposed fence.
3. The storage area is labeled as "existing asphalt millings." Revise the description to clarify that the millings are proposed.
4. Clearly dimension the distance between the existing curb and the property line.
5. Provide a 5-foot sidewalk two feet behind the existing wedge curb in the right-of-way.
6. The parking spaces within the fenced area and the access to them are vehicle use areas. Vehicle use areas must be paved. Delineate the parking area access lanes for these spaces and designate pavement for the PAAL and parking spaces.
7. This site is within a balanced basin. The rainwater discharge from the site cannot be increased by this development. Show how water harvesting will be maximized to demonstrate that runoff is not increased.
8. Show existing and proposed contours for the site. Provide an estimate of cut and fill quantities including an estimate of the volume of asphalt millings. This Development Package was not reviewed for grading. If a grading permit is required, a separate package will be needed.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is July 18, 2019.

SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS)
Section



1. COMMENT: It does not appear that the zoning comments were addressed as requested per the first review. In addition, the required response memo was not included in the DP package. The response memo shall clearly "detail" how all reviewers' comments have been addressed whether revision to the drawing, location, keynotes, general notes, calculations etc.

The next submittal shall include a response memo or the DP will not be accepted for resubmittal without it.


2-06.3.4 - A title block shall be provided in the lower right quadrant of each sheet.

2. COMMENT: Provide a title block in the lower right corner as noted by the standard above.


CONTENT REQUIREMENTS

2-06.4.1 - The name, mailing and email addresses, and phone number of the primary property owner of the site, the developer of the project, registrant(s), and other person(s), firm(s), or organization(s) that prepared the development package documents shall be provided on the right half of the cover sheet. The applicable registration or license number shall be provided if prepared by or with the assistance of a registered professional, such as a surveyor, architect, landscape architect, or engineer. All sealing shall be consistent with Arizona Board of Technical Registration guidelines.

3. COMMENT: List the information for the owner / developer, registrants or other persons that assisted in the preparation of this DP. Add the information as noted by the standard above

2-06.4.2 - The title block shall include the following information and be provided on each sheet:
2-06.4.2.A - The proposed name of the project or subdivision, or if there is no name, the proposed tenant's name;

4. COMMENT: Add the name of the project in the title block if different than "New Storage Yard".

2-06.4.2.B - A brief legal description and a statement as to whether the project is a re-subdivision are to be provided. On re-subdivisions, provide the recording information of the existing subdivision plat;

5. COMMENT: Add in the title block a brief legal description of the lot or parcel .i.e. "LOS RANCHITOS NUMBER 5 E2 LOT 205 EXC E120' as Recorded in Map and Plat Book 7 Page 96" SW qtr of the SE qtr of Section 7, T15S, R14E.


2-06.4.3 - The administrative street address and relevant case numbers (development package document, subdivision, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet.

6. COMMENT: Provide the development package case number, DP18-0143, adjacent to the title block on each sheet.

List the administrative Street address in the lower right corner next to the title block as noted by the standard above.


2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses.

7. COMMENT: List the Use Specific Standards 4.9.10.A and 4.9.13.Q under the "Use" note. Also clarify what will be stored at this location; construction materials, hazardous materials etc. the use specific standards may not be the same as noted above dependent on the actual use. If the storage use is for storage of storage containers that are for rent or sale, indicate as such under the use note.

Keep in mind that if the use is for storage of the metal containers the height of the containers or whatever is stored cannot be taller than the slatted 6-foot chainlink fence (along the street frontage) used as the screen for the outside storage. Label the height of the storage containers to be stored.

Clearly delineate on the site plan sheet the area that is to be used for outdoor storage. Keep in mind that outside storage when permitted may not be stored in the front perimeter yard area; in this case it must be behind the slatted (opaque) chainlink fence along the street frontage as determined by the PDSD Zoning Administrator.

Additional comments may be forthcoming based on the responses and changes to the plans.


2-06.4.7.A.6 - If a plan or plat is prepared in conjunction with other applications or overlays or the parcel being developed is subject to conditions of an application processed previously, additional information must be added to the plan. Such applications and overlays include, but are not limited to: annexations; rezonings; special exceptions; Board of Adjustment variances; Design Development Options; Technical Standard Modification Request; overlays (Airport Environs Zone, Environmental Resource Zone, Gateway Corridor Zone, Hillside Development Zone, Historic Preservation Zone, Major Streets and Routes, Rio Nuevo District, Scenic Corridor Zone, WASH); Modification of Development Regulations through the Downtown Area Infill Incentive District or Rio Nuevo District; Downtown Heritage Incentive Zone; or, Design Review Board. Provide the following information on the plan.

8. COMMENT: This parcel is within the TIA AEZ height zones 80 - 88. Draw the height zones on the site plan; see redlines and verify for accuracy. List the ground elevation of the parcel. (Label the heights of the storage containers)

Add a general note that states this development has been designed to comply with the Design Criteria of the Airport Environs Zones Overlay, UDC Section 5.6.


2-06.4.7.A.8.a - Floor area for each building;

9. COMMENT: If used for storage, list the square footage of each container if different size containers are stored or if all the containers are to be the same size list as such and list the total square footage of all containers combined.


2-06.4.8 - Existing Site Conditions
The following information shall be provided on the plan/plat drawing to indicate the existing conditions on site and within 50 feet of the site. On sites bounded by a street with a width of 50 feet or greater, the existing conditions across the street will be provided.

10. COMMENT: Provide the information on the site and landscape sheets as noted by the standard above.


2-06.4.8.A - Provide site boundary/subdivision perimeter information, including bearing in degrees, minutes, and seconds, with basis for bearing noted, together with distances in feet, to hundredths of a foot, or other functional reference system.

11. COMMENT: Label the bearings for all parcel lot lines.


2-06.4.8.B - All easements shall be drawn on the plan. The recordation information, location, width, and purpose of all easements on site will be stated. Blanket easements should be listed in the notes, together with recordation data and their proposed status. Should an easement not be in use and be proposed for vacation or have been abandoned, so indicate. However, should the easement be in conflict with any proposed building location, vacation of the easement shall occur prior to approval of plan unless written permission from easement holder(s) is provided.

12. COMMENT: If applicable draw and label any existing easements as noted by the standard above.


2-06.4.8.C - The following information regarding existing private or public right-of-way adjacent to or within the site shall be provided: the name, right-of-way width, recordation data, type and dimensioned width of paving, curbs, curb cuts, and sidewalks.

13. COMMENT: Street sidewalks will be required for this development. Draw, label and dimension the street sidewalks.


2-06.4.9.H.4 - Indicate if existing streets are public or private; provide street names, widths, curbs, sidewalks, and utility locations, all fully dimensioned.

14. COMMENT: Add the missing information for Wieding Road as noted by the standard above.


2-06.4.9.H.5 - If utilizing parking area access lanes (PAALs), they shall be designed in accordance with Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.

15. COMMENT: Clearly delineate the PAAL behind the parking spaces that are proposed within the proposed fenced area.


2-06.4.9.H.5.a - Show all motor vehicle off-street parking spaces provided, fully dimensioned. As a note, provide calculations on the number of spaces required (include the ratio used) and the number provided, including the number of spaces required and provided for the physically disabled. The drawing should indicate parking space locations for the physically disabled. A typical parking space detail shall be provided for both standard parking spaces and those for the physically disabled. For information on parking requirements for the physically disabled, refer to adopted building and accessibility codes of the City of Tucson. Design criteria for parking spaces and access are located in Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.

16. COMMENT: The parking calculation has not been correctly listed. List the total GFA of the proposed storage containers if the containers are being used for storage. If the containers are the items being stored then they are counted towards the outdoor storage. Review that parking calculations and revise as necessary if the storage containers are used to for storage, otherwise all is considered outdoor storage.

A minimum of one accessible parking space is required and must be an 8-foot wide Van Accessible parking space. Revise the drawing to show one van accessible parking spaces with an 8-foot wide accessible aisle. Also revise the vehicle parking calculation to reflect the number of parking spaces required and provided to include the number of required and provided accessible spaces.


2-06.4.9.H.5.c - Show all loading zones, vehicle maneuverability fully dimensioned, and access route. Provide as a note the number of loading spaces required, the number provided, whether the loading space is a Type A or B as provided in UDC Section 7.5.4.

17. COMMENT: Draw and label the loading zone location and demonstrate the maneuverability in and out of the loading zone area.


2-06.4.9.V - For gang mailboxes indicate location to assure there are no conflicts with other requirements, such as pedestrian accessibility, utilities, and landscaping.

18. COMMENT: Clarify by response if mail will be delivered to this location.


2-06.4.9.W - Indicate the locations and types of proposed signs (wall, free-standing, pedestal) to assure there are no conflicts with other requirements and that minimal locational requirements can be met. Indicate if there are any existing billboards on site. Compliance to the Sign Code, Chapter 3 of the Tucson Code, is required.

19. COMMENT: If applicable indicate the location of any proposed freestanding monument signage. Add a general note that states that all signage will be permitted under separate plans and permit.
