Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is May 30, 2018, 2018. SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS) Section 1. COMMENT: Zoning has reviewed the proposed grading plan related to the new bank Protection. Please address the following items: a. Draw in the western edge of the Pool location for reference purposes and to verify the proximity of the pool to the area of construction. b. Clarify if there is a pedestrian path adjacent to or along the top of bank area. If there is an existing pedestrian path along the top of bank area draw and label the path. c. While the proposal does not appear to affect any development criteria related to zoning, zoning will approve the grading plan once the Engineering and Landscape reviewers have approved the ERR, grading plan and related documents. A development plan/site plan, including landscape plans, indicating proposed development; floodplain encroachment locations; location of mitigation areas; techniques used for mitigating impacts to, or preservation of, natural areas; specifications for restoration and revegetation of disturbed areas; and general compliance with the applicable standards; 2. Landscape plans that document compliance with the mitigation plan requirements. A summary of mitigation and preservation requirements shall be included on the plans; and, 3. A description of the maintenance program that provides for revegetated/restored or enhanced areas. The program shall include irrigation to establish native plants, provide for regular inspection, removal of invasive species, and native plant replacement as necessary to successfully establish the mitigation habitat.
