Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is May 14, 2019. SECTION 2-06.0.0: DEVELOPMENT PACKAGE (TENTATIVE PLATS AND SITE PLANS) Section 2-06.3.0 FORMAT REQUIREMENTS CONTENT REQUIREMENTS 2-06.4.1 - The name, mailing and email addresses, and phone number of the primary property owner of the site, the developer of the project, registrant(s), and other person(s), firm(s), or organization(s) that prepared the development package documents shall be provided on the right half of the cover sheet. The applicable registration or license number shall be provided if prepared by or with the assistance of a registered professional, such as a surveyor, architect, landscape architect, or engineer. All sealing shall be consistent with Arizona Board of Technical Registration guidelines. 1. COMMENT: List the telephone number and email address for the Owner / Developer. 2-06.4.2.C - The number of proposed lots and common areas are to be noted. If the subdivision is a Flexible Lot Development (FLD), a condominium, or a similar type of residential subdivision utilizing special provisions of the UDC, it shall be so noted; 2. COMMENT: Include in the title block that this is a Flexible Lot Development. Also include in the title of the cover sheet i.e. "Tentative Plat for Count of Monte Vista a Flexible Lot Development Option". 2-06.4.3 - The administrative street address and relevant case numbers (development package document, subdivision, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet. 3. COMMENT: Provide the development package case number, DP18-0116, adjacent to the title block on each sheet. Location Map: 2-06.4.4.B - Identify major streets and regional watercourses within the square mile area and all streets that abut the subject property; and, 4. COMMENT: It is suggested that the line work depicting the lots be removed from the location map and include only the information as noted by the standard above. 2-06.4.4.C - Section, township, and range; section corners; north arrow; and the scale will be labeled. 5. COMMENT: On the location map, revise the section numbers along the south of Grant Road line to the 5, 4, and 3 respectively. 2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses. 6. COMMENT: Under the Zoning & Land Use Notes text block, include in note 3 that the proposed uses is an FLD using Option B, Max. Density. 2-06.4.7.A.7 - If the property is part of a subdivision plat that is being reviewed or has been recorded, provide the case number in the lower right corner of each sheet. As a general note, indicate whether the project is part of a Flexible Lot Development (FLD), condominium, or another similar type project. 7. COMMENT: Once the Final Plat Case number is assigned, list the case number in the lower right corner of all plan sheets. 2-06.4.7.A.8.a - Floor area for each building; 8. COMMENT: Under the FLD notes text block note 3, List the square footage of the building footprint for the two-story building. Also clarify if the vehicular use area listed includes the attached garages, if so list in parenthesis that garages are included and include the square footage of the garage. 2-06.4.7.A.8.b - Percentage and area in square feet of building and accessory building coverage; 9. COMMENT: To be verified on the next submittal when the additional information requested in Comment 11 is addressed. 2-06.4.8.C - The following information regarding existing private or public right-of-way adjacent to or within the site shall be provided: the name, right-of-way width, recordation data, type and dimensioned width of paving, curbs, curb cuts, and sidewalks. 10. COMMENT: Provide the following dimensions on sheet 3: overall right of way width, centerline to property line, and face of curb to property line. 2-06.4.9.B - Identify each block or lot by number within the subdivision boundary and include the approximate square footage of each, or a note may be provided stating that all lots comply with the minimum lot size requirements. 11. COMMENT: Add on sheet 3, a keynote stating to see sheet 5 for site boundary, common areas, and individual lot distance and bearings, and square footages. 2-06.4.9.C - If the project has common areas, label each common area individually with a separate letter designation. Enclose with a solid line each common area, private street, etc., that will have separate restrictions, a separate homeowners' association, or any common area that is separated by a public right-of-way. 12. COMMENT: Label all common areas on sheet 5. The private street and water harvesting areas must be labeled with a Common area designation. Depending on how the CC&R's are written it may be necessary to have different common area designations based on how maintenance, responsibilities and restrictions are to be managed in the CC&R's. 2-06.4.9.F - All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined. If the property is being rezoned, use those boundaries and classifications. The basis for this requirement is that some zoning requirements on a project are based on the zoning classification of adjacent property. Also, in some instances, each zone has to be taken into consideration on property that is split by two or more zoning classifications, as each may have different requirements. 13. COMMENT: Label the zoning classification across the street from this development. 2-06.4.9.H.2 - Show future and existing sight visibility triangles. On a designated MS&R street, the sight visibility triangles are based on the MS&R cross-section. 14. COMMENT: The Sight visibility triangles could not be verified on the plans. Add as required, see additional comments from the PDSD Engineering Plans reviewer. Add a cross section detail drawing that demonstrates compliance. 2-06.4.9.H.3 - Indicate fire circulation, including accessibility and vehicle maneuverability. 15. COMMENT: The structure for the covered parking along parking must be shown to be setback a minimum of 1 foot from the back end of the parking stalls (PAAL side). Detached accessory structures are not allowed within the front perimeter yard of a residential zone without approval through a Board of Adjustment variance. In this development the detached accessory structures are for the required parking which are not on site and will also require approval through the board of adjustment review and approval process. 2-06.4.9.H.4 - Indicate if existing streets are public or private; provide street names, widths, curbs, sidewalks, and utility locations, all fully dimensioned. 16. COMMENT: If Common Area "B" Parking lot is changed to a street label it as a private street. (Zoning suggests that the lot lines for lots 18 through 22 be extended to the north to include the parking areas required for each unit and attach the carports to each unit to eliminate the requirement for a B of A Variance. The PAAL can be considered a private street just as the other internal streets. TSMR review and approval is required for the proposed street cross sections that does not provide parking on both sides of the street and 90 degree parking backing onto a street. 2-06.4.9.H.5 - If utilizing parking area access lanes (PAALs), they shall be designed in accordance with Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC. 17. COMMENT: See related comment 19. 2-06.4.9.H.5.a - Show all motor vehicle off-street parking spaces provided, fully dimensioned. As a note, provide calculations on the number of spaces required (include the ratio used) and the number provided, including the number of spaces required and provided for the physically disabled. The drawing should indicate parking space locations for the physically disabled. A typical parking space detail shall be provided for both standard parking spaces and those for the physically disabled. For information on parking requirements for the physically disabled, refer to adopted building and accessibility codes of the City of Tucson. Design criteria for parking spaces and access are located in Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC. 18. COMMENT: As already noted in comments above all private streets must designed with parking on both sides of street in order to provide sufficient visitor parking spaces. When the streets don't allow for parking on both sides, visitor parking must be provided in a common area at a 1 to 1 ratio. The visitor parking provided on site within common areas does not provide for a 1 to 1 ratio. However, per my conversation with Steve Shields, if an additional visitor parking space can be provided on Monte Vista Drive he will accept those six spaces as meeting the visitor parking requirement. (It is acknowledged that there will be sufficient visitor parking when including the 17 onsite parking spaces in the Common Areas if the TSMR is approved.) 2-06.4.9.O - All applicable building setback lines, such as erosion hazard, floodplain detention/retention basins, and zoning, including sight visibility triangles, will be shown. 19. COMMENT: The onsite building setbacks have not been addressed correctly on the plans or in the notes. The interior street setbacks; are based on the ADT associated with the project. For this development the Developing area setbacks can be used with an ADT of 140 to 1,000 which requires a minimum street setback of the greatest of 21 feet or the HGT from the nearest edge of travel lane. The street building setbacks along the Monte Vista Drive are the same as above. Interior perimeter building setbacks; if the property is adjacent to a common area such the detention basin or other common area other than a street common area, the perimeter yard requirements of Section 6.3.4, Dimensional Standards and Exceptions Tables, may be reduced for setbacks along interior lot lines to the extent permitted by the City 's adopted Building Codes. 2-06.4.9.R - Show on-site pedestrian circulation and refuge utilizing location and the design criteria in Section 7-01.0.0, Pedestrian Access, of the Technical Standards Manual. 20. COMMENT: The pedestrian circulation appears to be in compliance as of this review. If any changes are made to the site design due to review comments, the pedestrian circulation path and sidewalks will be reviewed for compliance on the next submittal of the DP. 2-06.5.0 FLEXIBLE LOT DEVELOPMENT (FLD - ADDITIONAL REQUIREMENTS) 2-06.5.3 Additional Information 2-06.5.3.A. Reduced Perimeter Yards Street perimeter yards along interior street rights-of-way and perimeter yards between interior lots may be modified in accordance with Section 8.7.3.L, Perimeter Yards on Interior Lots, of the UDC. Applicants requesting a perimeter yard reduction must indicate what the required and reduced perimeter yards are and their locations. Applicants requesting a reduced street perimeter yard must provide a written description of how the reduced yard will enhance the architectural design or the vehicular circulation in the FLD and submit a transportation statement, or if required by the Department of Transportation, a traffic impact analysis; 21. COMMENT: As mentioned in comment 19, the interior street setbacks have not been met and must be approved through a B of A review and approval process. However, the street setback may be administratively reduced by the PDSD Director based on a finding that the reduced setback enhances the architectural design or the vehicular circulation in the FLD and a transportation statement is approved by the City's Traffic Engineering division. A street perimeter yard reduction request is considered for approval concurrent with the processing of the plat or site plan , whichever is applicable. 2-06.5.3.B - Maximum Density Option Applicants requesting a Maximum Density Option in accordance with Section 8.7.3.C.3.b must demonstrate compliance with the applicable criteria by written report or on the plat or site plan, whichever is appropriate; 22. COMMENT: How will it be determined which lots will be developed for low income? Are the lots going to be designated on the TP? 2-06.5.3.C - Functional Open Space Delineate the boundaries of the proposed functional open space on the tentative plat or site plan, whichever is applicable. Provide, by note on the plat, the required and proposed functional open space calculations; 23. COMMENT: See the Design Professionals comments related to this requirement. 2-06.5.3.D - Building Elevations Provide dimensioned building elevations of all proposed units. The elevations can be preliminary drawings. The model home construction plans will be used to determine exact setbacks and screening requirements at the time of application for building permits; 24. COMMENT: See the Design Professionals comments related to this requirement. 2-06.5.3.E - Architectural Variation Plan When applicable, an architectural variation plan is required in accordance with Section 8.7.3.M.1 of the UDC as follows: 25. COMMENT: See the Design Professionals comments related to this requirement. 2-06.5.3.E.1 - Identify on the tentative plat or site plan the lots and/or units that must provide architectural variation; and, 26. COMMENT: Provide the information related to the architectural variation as noted by the standard above also See the Design Professionals comments related to this requirement. 2-06.5.3.E.2 - Provide a written statement and drawings (such as elevations and building footprints) demonstrating how the proposed architectural variation techniques comply with Section 8.7.3.M.1 of the UDC. 27. COMMENT: See the Design Professionals comments related to this requirement. 2-06.5.3.F - Privacy Mitigation Plan When applicable, a privacy mitigation plan is required in accordance with Section 8.7.3.M.2.d of the UDC as follows: 28. COMMENT: See the Design Professionals comments related to this requirement. 2-06.5.3.F.1 - Identify on the tentative plat or site plan the lots and/or units that must provide privacy mitigation; 29. COMMENT: Identify the lots on the TP that must provide the privacy mitigation. 2-06.5.3.F.2 - Provide photographs of the site and its interface with the adjacent properties documenting the existing conditions; and, 30. COMMENT: See the Design Professionals comments related to this requirement. 2-06.5.3.F.3 - Provide a written statement and drawings (such as elevations and landscape plans) demonstrating how the proposed mitigation techniques comply with Section 8.7.3.M.2.b of the UDC. The plan should include when practicable additional design elements to increase privacy such as the siting angle of buildings, windows, and lots; 31. COMMENT: See the Design Professionals comments related to this requirement. 2-06.5.3.G.1 - Provide three copies of the Covenants, Conditions, and Restrictions (CC&Rs) regarding the homeowner's association's responsibility for the ownership and maintenance of commonly-owned property. 2-06.5.3.G.2 - Provide two copies of the protective covenants or common use agreements for any shared areas being established by easements over individually-owned property. 32. COMMENT: Provide a copy of the CC&R's with the next submittal of the TP if they are available otherwise they must be submitted at the time the Final Plat is submitted. If providing canopy trees every 40 feet is not achievable, the applicant shall: a. Provide the equivalent number of trees that would be obtained using the 40-foot increment measure; and, b. Distribute the trees within the FLD project site along pedestrian circulation systems and within functional open space areas. If the design cannot provide the required trees within pedestrian circulation, indicate graphically how equivalent requirement is met. 3. Landscape plans shall incorporate water-conserving design as defined in Section 7.6.6, Use of Water, and as described in the Technical Standards Manual. 4.
