COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is April 4, 2019.


1. COMMENT: Zoning has reviewed the proposed the Solar Parking Structure for compliance. Address the following comment(s) and Resubmit for review.

While the solar structure complies with the height requirement, setbacks from the PAALS, the structure does not meet the minimum building setback from the side street. The side street building setback is a minimum of 10 feet from the property line. The plan indicates a 2-foot setback from the property line. Keep in mind that this parcel is within an established area and the building setbacks are based on the greatest of 20 feet or the height of the structure from the front street property line (UDC 6.4.5.C.1.a) Bellevue Avenue and 10 feet from the side street property line (UDC Section 6.4.5.C.1.b) Winstel Boulevard.

The structure can be designed to meet the side street building setback of ten feet by removing one or two panels or approval of a Design Development Option (DDO) will be required prior to Zoning approval of the DP and building plans.
