Tucson Blvd Development Package (2nd Review) DP17-0304 TRANSMITTAL DATE: March 1, 2018 DUE DATE: January 25, 2018 COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is December 25, 2018. 1. Follow Up to Previous Comment 13: The applicant / Developer have chosen to execute and record the MSR Covenant indicating how the project will comply with UDC requirements when the MS&R Right of Way can no longer be used as part of the site. The DP must be approved prior to recording the MS&R covenant. The approved DP / future site plan must be used as the exhibit to the Covenant. The MS&R Covenant document can be downloaded from the following link; https://www.tucsonaz.gov/files/pdsd/forms/major_streets_covenant.pdf Previous Comment 13: 2-06.4.9.H.5.a - As your vehicle parking layout is a complete redesign of the existing vehicle parking area you need to demonstrate that when the future right-of-way (ROW) is taken that your site will meet code. The future plan does not address accessible vehicle parking or landscape requirements and must be addressed. Based on these requirements it appears that at the time of widening this site will lose four (4) vehicle parking spaces if not five (5) based on the requirement to relocate accessible vehicle parking. As your vehicle parking layout is a complete redesign of the existing vehicle parking you must eight demonstrate that the proposed design meets the requirements based on the future ROW or provide a future site plan that demonstrates that this site will meet code when the ROW is taken. If you elect to use the second option the future site plan must meet code and a Major Streets and Routes Covenant must be recorded.
