Dear Ms. Lee,

Thank you for the opportunity to comment on DP17-0276, TEP Generator & Substation / 1st Submittal; a development package application for an approximately 45.7 acre site, located northeast of the intersection of Interstate 10 and South Alvernon Way. The proposed land use is industrial but is transitioning to a new land use which is called planned area development (PAD); which would permit utility generating uses, with the PAD document ultimately outlining the uses which will be permitted to occur within this particular PAD.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

According to the FAA Notice Criteria Tool, this project is located in proximity to a navigation facility and could impact navigation signal reception. The applicant shall file Form 7460 with the FAA at least 45 days before construction activities begin for the project. Any cranes used which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp

The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions should be identified in the general notes of the approved development plan.

Conditions of approval:

"That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The content of such documents shall be according to the form and instructions provided."

The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. Once the Avigation Easement is recorded please send a copy of the recorded easement to the Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is November 20, 2018.

CONTENT REQUIREMENTS

1. 2-06.4.2.D - Provide the page number and the total number of pages in the package (i.e., sheet xx of xx) on all sheets within the title block.

2. 2-06.4.3 - Provide the development package case number, DP17-0276, adjacent to the title block on all sheets.

3. 2-06.4.3 - Provide these reference case numbers, DP17-0263 & DP17-0267, adjacent to the title block on all sheets.

2-06.4.7 - General Notes
The following general notes are required. Additional notes specific to each plan are required where applicable.

2-06.4.7.A - Zoning and Land Use Notes
4. 2-06.4.7.A.6.a - Provide a general note on the cover sheet stating "THIS PROJECT IS DESIGNED TO MEET THE OVERLAY ZONE(S) CRITERIA, UDC ARTICLE 5.4 MAJOR STREETS AND ROUTES SETBACK ZONE (MS&R) & UDC ARTICLE 5.6 AIRPORT ENVIRONS ZONE (AEZ)."

2-06.4.7.A.8 - For development package documents provide:

5. 2-06.4.7.A.8.b - Sheet 2 General Note 18 remove the reference to Floor Area Ratio as it is not applicable.

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

6. 2-06.4.9.A - As this site is made up of numerous parcels a lot combination is required. Provide a copy of the approved Pima County Combo request from with your next submittal.

7. 2-06.4.9.F - Sheet 1 provide the following information on the Key Map; All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined.

8. 2-06.4.9.H.5.a - 2012 IBC Chapter 11 Table 1106.1 the required number of accessible vehicle parking spaces is 27 but only 15 are provided. A waiver from the Building Official, Clayton Trevillyan, will be required prior to approval of the development package.

Additional comments;

9. General Notes 17, 18, 19, 20 & 21 reference development standards that are not applicable until the proposed PAD is approved. The development package cannot be approved until the PAD is approved.

10. As this project is proposing development standards that are only allowed in the proposed PAD, i.e. vehicle use area, pedestrian circulation etc. the plan cannot be approved until the PAD is approved.
