COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is October 03, 2018.

2-06.3.0 FORMAT REQUIREMENTS

1. 2-06.3.9 - Sheets 5, 6, 7, 9 & 13 do not meet the orientation requirements of this section. Revise the drawings so that north is either to the top or the left side of the sheet.

2-06.4.7 - General Notes

2-06.4.7.A - Zoning and Land Use Notes

4. 2-06.4.7.A.4 - Under "DEVELOPMENT PLAN GENERAL NOTES" note 3 list the existing use as "GENERAL MERCHANDISE SALES, EXCLUDING LARGE RETAIL ESTABLISHMENT, SUBJECT TO USE SPECIFIC STANDARD 4.9.9.B.1.

5. 2-06.4.7.A.4 - The proposed use listed under "DEVELOPMENT PLAN GENERAL NOTES" note 3 should be listed as "FOOD SERVICE: EXCLUDING SOUP KITCHENS". Remove the reference to Use Specific Standard 4.9.4.M.1 & 5 and 4.9.13.O as it does not apply to the C-3 zone see UDC Table 4.8-4 PERMITTED USES - COMMERCIAL AND MIXED USE ZONES, Commercial Services Land Use Group With Land Use Class/Type: Food Service: Excluding Soup Kitchens.

6. 2-06.4.7.A.6.s - Provide the minor subdivision case number, S17-058, adjacent to the title block on all sheets. Zoning cannot approved the development package as shown until the final plat is approved.

7. 2-06.4.7.A.8.d - As there is no development shown for the propose pads and the calculations do not address the future pads provide a note on the plan stating "A NEW DEVELOPMENT PACKAGE WILL NEED TO BE SUBMITTED AND APPROVED BY THE COT PRIOR TO DEVELOPMENT OF THE PROPOSED BUILDING PADS".

2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

8. 2-06.4.9.F - Provide the existing zoning classifications for the properties located east of Oracle and south of Limberlost, clearly define the zoning boundaries

9. 2-06.4.9.H.2 - It does not appear that the right-of-way (ROW) for Oracle is at full width, contact COT Transportation to verify future ROW for Oracle. If there is future ROW the proposed development needs to be developed to the future ROW or a future ROW plan provide showing how the site will meet code when the ROW is taken.

10. 2-06.4.9.H.2 - Show future and existing sight visibility triangles. On a designated MS&R street, the sight visibility triangles are based on the MS&R cross-section.

11. 2-06.4.9.H.5 - Provide PAAL width dimensions at all new landscape islands and at the northern most PAAL, see yellow highlight.

12. 2-06.4.9.H.5.a - Zoning acknowledges that the vehicle parking calculation, standard and accessible, works for the center as shown on this plan. When the proposed pads are developed accessible vehicle parking spaces will be required for the new development.

13. 2-06.4.9.H.5.c - Zoning acknowledges that no expansions are proposed at this time but to verify what is required for short & long term bicycle parking provide a copy of the last approved site/development plan for this site.

14. 2-06.4.9.Q - Provide the height of the commercial structure within the footprint of the building.

15. 2-06.4.9.S - As you are proposing the required sidewalk along Oracle Road within the property boundary an easement is required. Show the easement on the plan along with the recordation information.

4.1 Identification and Descriptive Data
A. Should amendments be required to the base plan through the review process, the same amendments will be made to the landscape plan which will then be resubmitted along with the base plan.

7.6. LANDSCAPING AND SCREENING

7.6.2. APPLICABILITY
The provisions of this section apply to the following:
A. All new development; and,
B. Expansion of existing development, as provided below:
1. Buildings Greater Than 10,000 Square Feet
On sites where the gross floor area of the existing building(s) is more than 10,000 square feet, expansion in square footage of land area, floor area, lot coverage, or vehicular use area as follows:
a. If the expansion is less than 25%, the standards of this section apply only to the proposed expansion. Existing development on the site is subject to the zoning standards in effect at the time the existing development received zoning approval.
b. If the expansion is 25% or greater or if expansions as of February 15, 1991, cumulatively result in a 25% or greater expansion in land area, floor area, lot coverage, or vehicular use area, the standards of this section apply to the entire site.

Minimum Width
Street landscape borders must be a minimum of ten feet wide as measured from the street property line. On streets designated as Major Streets and Routes (MS&R), the street landscape border must be measured from the future MS&R right-of-way line as determined by Section 5.4.4, Establishment of MS&R Right-of-Way Lines and Gateway Routes.

Oracle Rd. is actually a state route and any plantings within the ROW would need to be approved Arizona Department of Transportation.

The following information must be provided on the plans:
Calculations
a. Square footage of the site;
c. Square footage of the vehicular use area; number of parking spaces, including the required and provided parking space calculations; and the calculation of the required number of canopy trees;
e. Minimum width and square footage measured from the inside edge of tree planters in vehicular use areas;
f. Length and width of landscape borders and landscape transition borders and number of canopy trees per length; and,
g. Square footage of all landscaped borders and calculation of the percentage of vegetative coverage, when applicable.

Vegetative Ground Cover
Fifty percent or more of the area of the street landscape border must be covered with shrubs or vegetative ground cover. The required ground coverage must be achieved within two years from the date of planting.


Screening for individual land uses and zones must be provided as determined in Table 7.6.4-1 and in addition to the required landscape borders. Screening is not required between similar uses in accordance with Table 7.6.4-1.

3. Screening
a. Location of screening elements;
b. Height of screening material and reference point for measurement;
c. Nature of screening material (e.g., permanent or temporary as in phased development); and,
d. Type of screening material (e.g., masonry wall, wood fence, species of plant material).

11/03/2017 TOM MARTINEZ OTHER AGENCIES AZ DEPT TRANSPORTATION Reqs Change The Arizona Department of Transportation (ADOT) has reviewed the referenced 1st Submittal, and the following comments are provided:

ADOT has reviewed and accepted the September 25, 2017 Traffic Impact Analysis (TIA) for the proposed Limber Restaurants to be located on the northwest corner of the State Route 77 (Oracle Road)/Limberlost Drive intersection (Project Address: 4215 N. Oracle Road). Copy of ADOT’s “Letter of Acceptance” is attached. In general, we concur with the findings and recommendations in the report.

At the present time, access to the site is provided by three existing driveways, two driveways on Oracle Road and one driveway on Limberlost Drive. With the project, these three access points will continue to provide access to the site. The south driveway on Oracle Road (identified as South Sports Driveway in the TIA) will be shifted approximately 75 feet to the north as part of the development. In addition, as shown in the TIA, a southbound right-turn lane will be required on Oracle Road at the South Sports Driveway to serve this development. The specific geometry of the southbound right-turn lane on Oracle Road will be addressed during design.

As per Intergovernmental Agreement between the State of Arizona and the City of Tucson, the City will issue the “State Highway Right-of-Way Encroachment Use Permit” for work in State right-of-way at this location. ADOT will assist the City with reviewing and approving the “Off-Site Improvement Plans”.
