Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is July 12, 2018. Thank you for your response to the zoning comments. Please address the remaining items as listed below in the 4 follow up comments and comments added comments 5 and 6. 1. Follow Up To Previous Comment 1: The use Food and Beverage Sales was not listed under the C-3 Zoning section of the under General Note 4. 2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses. PREVIOUS COMMENT 1: In the C-3 Zone, for Food and Beverage Sales (excluding large retail establishments) No applicable Use Specific Standards. 2. Follow Up To Previous Comment 4: The response to the previous comment is acknowledged. However just as a reminder, once the abandonment or recording of the easements are completed, the appropriate sheets of the DP will have to be revised to include the easement abandonment or new easement recording information along with the copies of the recorded documents for said easements to be included with revision submittal. 2-06.4.8.B - All easements shall be drawn on the plan. The recordation information, location, width, and purpose of all easements on site will be stated. Blanket easements should be listed in the notes, together with recordation data and their proposed status. Should an easement not be in use and be proposed for vacation or have been abandoned, so indicate. However, should the easement be in conflict with any proposed building location, vacation of the easement shall occur prior to approval of plan unless written permission from easement holder(s) is provided. PREVIOUS COMMENT 4: The recordation information for the abandonment of any easement or for new easements must be listed on the DP prior to final approval. (It may be possible to defer the submittal of the easement documentation until building plan review.) 3. Follow Up To Previous Comment 5: A copy of the Email correspondence could not be verified was not included with the submittal of the latest DP. Please include with the next submittal a copy of the email correspondence. 2-06.4.8.C - The following information regarding existing private or public right-of-way adjacent to or within the site shall be provided: the name, right-of-way width, recordation data, type and dimensioned width of paving, curbs, curb cuts, and sidewalks. PREVIOUS COMMENT 5: It is acknowledged that a process to purchase street right of way was underway. The additional right of way is required in order to provide the necessary vehicle use area in order to maneuver into and out of parking spaces adjacent to Miramonte Avenue without backing up directly onto Miramonte or the bicycle lane. Prior to approval of the DP the right of way acquisition must be completed and the recordation information annotated on the DP and the recorded documents included with the DP. 4. Follow Up To Previous Comment 6: It appears that the latest submittal of the DP includes a covered parking area along the southwest parking lot. The PAAL dimensions between the spaces must be a minimum of 24 feet. Per the plan there is only 20 feet but it also appears that the southern spaces are dimensioned as 20 feet. If there is insufficient area to provide a 24-foot PAAL an Approved PDMR will be required prior to approval of the DP. Contact Kelly Lee for information on the required submittal. 2-06.4.9.H.5 - If utilizing parking area access lanes (PAALs), they shall be designed in accordance with Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC. 5. COMMENT: Sheets 20 and 21 did not include the reference case numbers next to the title block. Add the ref. case numbers on sheet 20 and 21. 6. COMMENT: The "Vehicle Parking Requirements and Long Term Bicycle Parking tables on sheet two are not very clear or legible. Both tables should be replaced with legible tables.
