Dear Ms. Beasley,
Thank you for the opportunity to comment on DP17-0128, Light Industrial Facility, 1560 E. 17th Street, a development package application for an approximately 0.85 acre site, located southeast of the intersection of South Vine Avenue and East 17th Street, with the project site being immediately northwest of the intersection of South Kino Parkway and East Aviation Parkway (SR-210). The property is zoned Industrial 1 (I-1), with the proposed development being a light industrial building.
This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.
The Tucson Airport Authority conditionally approves the subject request contingent upon the following condition of approval, as noted below. This condition shall be identified in the general notes of the revised development plan.
Condition of approval:
1. "According to the FAA Notice Criteria Tool, this project is located in proximity to a navigation facility and could impact navigation signal reception. The applicant shall file Form 7460 with the FAA at least 45 days before construction activities begin for the project. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes used which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp"

Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the City of Tucson consider requiring the applicant to add the following note into the general notes of the revised development plans. This project is located approximately 5 ½ miles north of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport.

The proposed note would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through requiring the property owner to record the Avigation Easement. The Tucson Airport Authority believes the proposed note helps to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson - Regional and Global Positioning policy 4 (RG-4).
1. "That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided."
The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. Once the Avigation Easement is recorded please send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

Street landscape borders are required along 17th Street and Kino Blvd and at least 5' must be located on-site. Indicate how this comment is addressed or variance must be applied for.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is May 31, 2019.

***This corrected DP was reviewed as a new submittal for compliance with AM 2-06. Address the following zoning comments and resubmit.

1. Follow Up To Previous Comment 2: The previous comment was not address as requested and per the standards as noted below.

2-06.3.7 - A small, project-location map shall be provided in the upper right corner of the cover sheet.
2-06.4.4 - The project-location map to be located on the first sheet of the development package in the upper right corner, shall cover approximately one square mile, be drawn at a minimum scale of three inch equals one mile, and provide the following information.
2-06.4.4.A - Show the subject property approximately centered within the one square mile area;
2-06.4.4.B - Identify major streets and regional watercourses within the square mile area and all streets that abut the subject property; and,
2-06.4.4.C - Section, township, and range; section corners; north arrow; and the scale will be labeled.

Previous Comment 2: Reduce the location map to a scale three inches equals one mile and includes the information listed in the standards 2-06.4.4 through 2-06.4.4.C as noted by the standards above. Remove all lot lines from the location map and use single lines for streets.


2. Follow Up To Previous Comment 4: Include a heavy dark line for the property boundary in the legend. Also delineate in its entirety the additional parcel that was purchased for inclusion into this development. The parcel shall include the distance and bearings and be clearly delineated on the sheets.

2-06.3.10 - A legend that shows and describes all symbols used on the drawing is to be provided, preferably on the first sheet.

Previous Comment 4: The legend on the cover sheet shall include line types and symbols used on the site plan.

3. Follow Up To Previous Comment 12: The newly acquired parcel shall be drawn in its entirety on the site sheets. The site plan sheet shall include the distance and bearings of the new boundary which should include the newly added parcel.

As for the Parcel Combo, include with the next submittal a copy of the signed Parcel Combo Form - approval or acceptance from the Pima County Assessor's Office.

2-06.4.8.A - Provide site boundary/subdivision perimeter information, including bearing in degrees, minutes, and seconds, with basis for bearing noted, together with distances in feet, to hundredths of a foot, or other functional reference system.

Previous Comment 12: Per the applicants email to PDSD, the owner has acquired additional land area for the project parking area. What is not explained in the email is whether or not the owner has completed a Pima County Tax Parcel Combo through the Pima County Assessor's Office. The Pima County Tax Parcel Combo will have to be completed prior to approval of the DP.

The DP must be drawn with both parcels and must be labeled with the distances and bearings as one parcel. The acquired parcel must be fully depicted on the plans.

It is not very clear on the plan where the property boundary of the acquired parcel is located. It is suggested that a reduced copy of the overall property with the acquired parcel be depicted on the last sheet. The parcel depicted by the Pima County GIS map does not match what is currently depicted on the revised DP site plan sheets. Address as required.


4. Follow Up To Previous Comment 15: The information for the newly added parcel must be added to the site plan sheets.

5. COMMENT: Remove all revision clouds and revision deltas form the DP sheets. The revision clouds and deltas are required on DP or site plan sheets once the DP has been approved and the site built. The revision clouds and deltas would be required on the as built drawings.
