Thank you for the opportunity to comment on DP16-0202, City Park; 1st Submittal, a Development Package application for an approximately 0.47 acre site located immediate south of East Congress Street and between South Stone Avenue and South Scott Avenue. The proposed land use is commercial.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

The applicant shall file Form 7460 with the FAA at least 45 days before any construction activity is to begin. Any cranes used for the project must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp.

The Tucson Airport Authority is not requesting the Avigation Easement be recorded for this submittal since the owner previously recorded the Avigation Easement from an earlier submittal received from the City of Tucson, S16-074.

01/06/2017 KLEE1 COT NON-DSD ENVIRONMENTAL SERVICES Reqs Change The City of Tucson - Environmental Services Department has completed our review of DP16-0202, City Park.

The refuse, recycling and compactor locations on the subject site are provided on Sheet 3 of 11 in the Development Plan. Our review comments include:

•The waste generation rate of approximately 248 gallons per week is correct. This calculation is based on 26,920 square feet of floor area for office use and 37,777 square feet of floor space for food service / alcohol use. The waste generation calculations indicate that 16 cubic yards of refuse and recycling materials will be generated each week.

•The dumpster area in the southwest portion of the site indicates that 8 refuse and recycling containers (total) and one compactor will be provided.

•A line is shown around the dumpster area on Sheet 3 of 11 of the Development Plan. In the next submittal, a description of how the dumpsters will be screened from public view and from adjacent properties shall be provided. State if the proposed five story building is to provide a portion of the screening for the dumpsters. State the height and building materials for the perimeter wall on the south side of the dumpster area. State how the dumpsters will be screened to the west.
•Environmental Services would approve the plan for rolling the containers to the designated service area along S. Scott Avenue with the condition that the containers be returned to the container (dumpster) storage area shortly after servicing.

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is November 14, 2017.

This project is within the IID Downtown Core Sub-District. If the overlay is to be utilized for MDR(s), approval of the IID must be completed prior to approval of the DP. Any conditions related to the IID approval must be incorporated into the DP plans. The IID case number date of approval and conditions of approval must be listed on the cover sheet.

3. Follow Up To Previous Comment 12: Zoning acknowledges that the research for the recordation was underway. List the recordation data on sheet 5 once it is verified. Also, on sheet 5 the notes for no build easement and recordation were transposed over another note and neither note is legible. Clean up the notes as required for legibility. (see redlines)

2-06.4.8.B - All easements shall be drawn on the plan. The recordation information, location, width, and purpose of all easements on site will be stated. Blanket easements should be listed in the notes, together with recordation data and their proposed status. Should an easement not be in use and be proposed for vacation or have been abandoned, so indicate. However, should the easement be in conflict with any proposed building location, vacation of the easement shall occur prior to approval of plan unless written permission from easement holder(s) is provided.
PREVIOUS COMMENT 12: Clarify if a no build easement was recorded along the west site boundary line. If so draw, dimension, label and list the recordation information on the site and utilities and easements sheets.


2-06.4.9 - Information on Proposed Development
The following information on the proposed project shall be shown on the drawing or added as notes.

4. Follow Up To Previous Comment 14: The final Plat drawing was labeled with Block 1 and Block 2. Label Block 1 on the cover sheet of the DP and revise the block label for Block 1 on sheet 3, (Block 1 is labeled as Block 2 see redlines).

2-06.4.9.H.1 - Proposed traffic circulation will be designed in accordance with Section 10-01.0.0, Street Technical Standards, of the Technical Standards Manual, to include streets, intersections, street names, right-of-way widths, curve radii of centerlines and curb returns, and proposed improvements, such as pavement, curbs, access points (driveways), accessible ramps, and sidewalks. Street improvements, such as sidewalks, curbs, pavement, and accessible ramps, do not need to be drawn on the plan if such information is provided on typical street cross sections.
Please be aware that, if a new street is created (for other than for subdivisions) which divides the property into two or more lots, a subdivision plat is required (refer to the definition of subdivision in Section 11.4.20 of the UDC).
PREVIOUS COMMENT 16: It appears that the existing vertical curb along the frontage of the building is to be removed and replaced with a wedge curb. Approval through a TSMR is going to be required and specifically approval by TDOT. In addition the area is next to the Sunlink rail system which requires that contractors take a class prior to working in the ROW next to the Sunlink rail system. Contact TDOT for additional information on the training.

2-06.4.9.H.5.a - Show all motor vehicle off-street parking spaces provided, fully dimensioned. As a note, provide calculations on the number of spaces required (include the ratio used) and the number provided, including the number of spaces required and provided for the physically disabled. The drawing should indicate parking space locations for the physically disabled. A typical parking space detail shall be provided for both standard parking spaces and those for the physically disabled. For information on parking requirements for the physically disabled, refer to adopted building and accessibility codes of the City of Tucson. Design criteria for parking spaces and access are located in Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC.
PREVIOUS COMMENT 17: Per the DP plan, parking will not be provided. It is assumed that an MDR is proposed for elimination of the number of parking spaces or to provide the spaces offsite. The plan is not clear as to what is proposed. Clarify what is proposed through the IID MDR process.

Clarify if the square footage of the Alcoholic Beverage Service was included in the square footage for calculating the parking spaces? If so revise the parking note to include Food Service/Alcoholic Beverage Service. If the square footage was not included add a separate parking note with the square footage of the Alcoholic Beverage Service and list the number of parking spaces required.


7. Follow Up To Previous Comment 18: Comment will remain until final review and approval of the IID application. If applicable incorporate any design conditions related to the IID.


2-06.4.9.H.5.b - If any of the required parking is located off-site as permitted by the UDC, a drawing of that parking area is to be provided, together with the city's required parking agreement (include a copy of the lease agreement if applicable) must be provided. Please remember that in these situations, if the off-site parking location is a new parking area, it must comply with all parking area requirements and must be allowed as a principal use by the zoning classification of that property. If the off-site parking area location is an existing parking lot, the parking spaces utilized for the proposed land use must be non-required parking for the existing use for which the parking area was established.

The short term bicycle parking facility must be located on site and no more than 50 feet from a public entrance. The PDSD Director may allow a modification to this requirement based on a finding from the City of Tucson Bicycle Coordinator. Also approval by TDOT must be obtained to ensure that the placement of the facility does not affect public access. The long term facility appears to be located in an open area with the refuse containers. The long term facility must meet the requirements for security, weather protection, signage and lighting. The detail provided on sheet 3 does not demonstrate compliance. Draw the location of the long term racks on the site plan sheet and if necessary include a blow-up dimensioned detail drawing for the location that demonstrates compliance with UDC section 7.4.9.D

2-06.4.9.H.5.d - Show bicycle parking facilities fully dimensioned. For specifics, refer to Section 7.4.9, Bicycle Parking Design Criteria, of the UDC. Provide, as a note, calculations for short and long term bicycle spaces required and provided.
PREVIOUS COMMENT 20: The fully dimensioned detail drawings for the short and long term facilities could not be verified on the plan set. Add the detail drawings as noted by the standard above. Also the location of the long term facilities could not be verified on the site plan. The detail drawings shall indicate the number of bicycle spaces provided.

For specific information on refuse collection, refer to Section 8-01.0.0, Solid Waste and Recycle Disposal, Collection, and Storage, of the Technical Standards Manual. Refuse collection on all projects shall be designed based on that section, even if collection is to be contracted to a private firm.
