The proposed land use is commercial, establishing a commercial storage and hazardous material storage use. This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions should be identified in the general notes of the approved development plan. Conditions of approval: "According to the FAA Notice Criteria Tool, this project is located in proximity to a navigation facility and could impact navigation signal reception. The applicant shall file Form 7460 with the FAA at least 45 days before construction activities begin for the project. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp" "That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The content of such documents shall be according to the form and instructions provided." The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. All improvements and site information, such as adjacent rights-of-way and property lines, shown on the landscape plan will be identical in size and location to those shown on the base plan (site plan or tentative plat). Should amendments be required to the base plan through the review process, the same amendments will be made to the landscape plan which will then be resubmitted along with the base plan. This entire project will need to meet current code requirements. a) DDO will be necessary for any replacements of landscape requirements. b) BOA Variance is required for removal of any landscape elements Street Landscape Borders To enhance the visual appearance of the streetscape, a street landscape border is required in accordance with Table 7.6.4-1 along the street frontage of a site as follows, except as provided in Section 7.6.4.C.4, Exceptions to the Landscape Border Standards: 7.6.4. LANDSCAPE STANDARDS: Street Landscape Borders a. Minimum Width Street landscape borders must be a minimum of ten feet wide as measured from the street property line. On streets designated as Major Streets and Routes (MS&R), the street landscape border must be measured from the future MS&R right-of-way line as determined by Section 5.4.4, Establishment of MS&R Right-of-Way Lines and Gateway Routes. a) Portion of Landscape border along Cherry Ave is not 10' measured from street property line. Located on Site Street landscape borders must be located entirely on site, except that, if approved by the City Engineer or designee, up to five feet of the required ten foot width may be placed within the adjacent right-of-way area or within the Major Streets and Routes (MS&R) right-of-way area on MS&R streets. The required landscape buffer along 21st St. is located entirely within the Public ROW. Use of the Public Right-of-Way 1. The landscaping is approved by the City Engineer or designee and complies with the City Engineer's standards on construction, irrigation, location, and plant type; 2. 2. All vegetation complies with the standards of Section 7.6.4, Landscaping Standards; and, 3. The landscaping does not interfere with the use of the sidewalk. Provide written approval for use of ROW for required landscaping to be placed within public right-of-way. 7.6.5. SCREENING STANDARDS The purpose of screening is to provide visual barriers, noise reduction, and to provide privacy. Location Whether or not required by this section, screens along a street frontage must be located on the development side of the street landscape border so that they do not obstruct the view of the street landscape border from the street. Portion of the chain link fence (with slats) on Cherry Ave is located within required landscape buffer Ensure that all Zoning and Engineering comments and concerns are addressed prior to landscape approval. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is August 16, 2018. Follow Up Comment to Previous Comment 2: The contour interval used was not listed on sheet 1 or 3. Label the contour interval on the appropriate sheet. Previous Comment 2: 2-06.3.8 - The north arrow, contour interval, and scale as applicable to each sheet should be placed together in the upper right corner of each sheet. Sheet 1 & 3 move the north arrow, contour interval, and scale to the upper right corner of the sheet. Follow Up Comment to Previous 8: Comment Revise the zoning and land use notes as follows; The Use note shall state "Storage Land Use Group" - "Commercial Storage Subject to UDC Sections 4.9.10.A and 4.9.13.Q" "Accessory Use - Hazardous Materials Subject to UDC Sections 4.9.10.B.1 & .2d" Previous Comment 8: 2-06.4.7.A.4 - As a general note identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses. Follow Up Comment to Previous Comment 30: The accessible route must be continuous from one of the streets that the site is fronting. Demonstrate how the accessible route from either street is provided. Previous Comment 30: 2-06.4.9.R - Per 2012 IBC Section 1104 clearly demonstrate that an accessible route is provided to all buildings on site. The route must meet the requirements of ICC A117.1, Section 403.3; 5% maximum running slopes and 2% maximum cross slopes. Follow Up Comment to Previous Comment 34: Assure that the Landscape plans match the based site plan. The landscape still depicts the striped walkway from the existing warehouse to the Accessible parking space. The striped area shall be removed or if it is to be provided it must be in a location where is not directly behind parking spaces. The petition requested to Building Official to not require the accessible route to the existing building was approved. Previous Comment 34: 2-06.4.9.X - Per UDC Article 7.6.2.B compliance with all standards within UDC Article 7.6 are required for this project. Update plans to show a sidewalk along 21st Street. Connect sidewalk to pedestrian circulation path. 2) AM section 7-01.4.3.B requires 84" of unobstructed vertical clearance for sidewalks or pedestrian areas. Update detail on sheet 2 so that the 7' vertical clearance on the accessible parking sign is to the lowest sign. 3) Pima Associations of Governments "PAG" standard details have been adopted to replace City of Tucson Standard Details.
