COMMENTS: Please resubmit revised drawings and any redlined plans along with a detailed response letter, which states how all Zoning Review Section comments were addressed.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is March 20, 2016.

1. Zoning acknowledges that a Technical Standards Modification Request (TSMR) has been applied for. If approved provide the TSMR case number adjacent to the title block on all sheets and provide a general note stating the case number, date of approval, what was modified and if applicable any conditions of approval. 2-06.4.9.H.5 - Per UDC Article 7.4.6.H.1 Barriers, such as post barricades or wheel stop curbing, are required in a vehicular use area to prevent vehicles from extending beyond the property lines, to prevent cars from damaging adjacent landscaping, walls, or buildings, overhanging adjacent sidewalk areas, and/or driving onto unimproved portions of the site.
a. This comment was not addressed, see TSM 7-01.4.2. There are two (2) areas where the pavement and sidewalk are flush, along the north and west side of the proposed building that require some type of barrier to prevent vehicles from accessing the sidewalk in this area.
b. Addressed. The access lane north of the building that will provide access to the second phase will require some type of barrier to prevent vehicle from accessing the unimproved portion of the site.

2. Based on the provided vehicle parking space calculation Rezoning C9-15-07/Special Exception S-15-83 condition 29 will need to revised or removed prior to approval of the development package. 2-06.4.9.H.5.a - The provided vehicle parking space calculation is not correct. Per UDC Table 7.4.4-1 Commercial Use Group, Medical Service - Extended Health Care, the requirement is 1 space per 2 beds for a total required of 32. Revise the calculation to show the correct ratio of 1 space per 2 beds and 32 spaces required.

3. This comment will need to be addressed prior to approval of this development package.2-06.4.9.U - Demonstrate on the how you are proposing to meet re-zoning condition 29. Following discussions with staff a request to eliminate condition 29 would be appropriate. 1. Development Plan DP16-0049 is subject to Rezoning C9-15-07 and Special Exception SE-15-83 conditions.

" Development package is not in compliance with Rezoning C9-15-7, condition #29. The applicant is in the process of requesting Mayor and Council to remove Condition # 29.

The "Approved-Conditionally" is subject to Mayor and Council removing Rezoning C9-15-07 condition #29, which is currently a requirement of rezoning C9-15-07.

This request to remove condition #29 is pending and scheduled before Mayor and Council, on May 17, 2016. Pending outcome of Mayor and Council meeting, the current "Approved-Conditionally" status will change to either an approval or a denial.

04/28/2016 AHINES2 COT NON-DSD ENVIRONMENTAL SERVICES Approved The City of Tucson - Environmental Services Department (ES) has reviewed and approves the waste stream calculations you submitted for the Mainstreet Tucson proposed development on E. Pima Street in Tucson. The selection of one 8 cubic yard metal container with servicing two times per week is also approved. The location and design of the container enclosure was previously reviewed by ES and approved.
