The City of Tucson - Environmental Services Department (ES) has completed a review of DP15-0198 for the proposed development at "The Marist on Cathedral Square - Marist College", located at 235 S. Church Street in Tucson. The proposed use of the subject property is eight multi-family residential units.

The 235 S. Church Street property and the property located to the immediate east are both owned by the Tucson Catholic Diocese. These two properties were formerly one parcel. In order to approve the Infill Incentive District plans for these properties, it was necessary to split this parcel into the two present properties. The proposed refuse and recycling containers and enclosure, which will serve both of the above-described properties, will be located on the 235 S. Church Street property.

In an earlier review, Ken Perry had requested that an access agreement be prepared allowing access to the waste enclosure for placement of waste in the enclosure and refuse truck access to the enclosure for both parcels. The document titled "Reciprocal Easement Agreement provides this access agreement. This agreement grants reciprocal use of all common areas and facilities between the two parcels. ES understands that this agreement has been recorded in the Pima County Courthouse.

Based on this review, ES approves the access agreement and does not have any other concerns with the proposed waste management at this property.

Please let me know if you have any questions concerning this review.
