Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is April 16, 2016. 01. Follow up to previous comment 3: The TSMR was not approved by all plans reviewers and therefore the DP cannot be approved. Once the TSMR is approved whether outright or conditional, the TSMR case number, date of approval and conditions of approval must be listed as a general note on the cover sheet. PREVIOUS COMMENT 03: A TSMR review and approval will be required for the proposed sidewalk area utilizing the pavement as the surface material. List the TSMR case number in the lower right corner of all plan sheets and list as a general note the TSMR case number, date and conditions of approval. ********************************************************************* 02. Follow up to Previous Comment 5: There was no response to previous comment 5. Clarify if a request to the zoning administrator was made relevant to previous comment 5. Include in the next submittal some form of communication from the Zoning administrator providing direction with regards to this issue. PREVIOUS COMMENT 05: UDC section 4.9.13.O.2 requires that all activity occur within an enclosed building. The Ice Kiosk is a Vending Machine and technically would have to be within a building. I believe that you should contact the zoning administration staff to get a determination and it is possible that a determination has already been made in the past which may be used for this project. Refer to the CDRC managers instructions provided in the CDRC memo. PREVIOUS COMMENT 16: As noted in comment 3, a TSMR approval for the proposed paved striped pedestrian area that must include some type of physical barrier will be required. ********************************************************************* 04. Engineering Division does not recommend approval of the Development Package at this time. This review falls under the Unified Development Code (UDC), Administration Manual (AM) and Technical Standards Manual (TSM). Provide verification of the PAAL width onsite for existing and future right-of-way for the ice kiosk adjacent to the vehicular use area. Confirmation through TDOT maybe required to ensure that the ice kiosk does not adversely impact the driveway location for safety reason. If the driveway is to be closed off label the curbing and sidewalk dimensions along with a reference to the Standard Detail for Public Improvements to match existing for construction purposes. Existing curb cuts that are no longer used must be closed off per Tucson Code Chapter 25 Sec.25-43. 9) Complied. 10) Restated: AM Sec.2-06.4.9.H.5.a: Revise the development package to correctly dimension the three foot radii for the backup spur. 11) Complied. 12) Complied. 13) Complied. 14) Restated: AM Sec.2-06.4.9.R: Revise the development package to provide a General Note referencing the TSMR Case #, date of approval and any conditions (if applicable). The TSMR (DS15-11) has not been approved at this time for the modification of the sidewalk. Once the TSMR is approved then the note needs to be added with the approval date. 15) Complied. GENERAL COMMENTS: Please provide a revised Development Package that addresses the comments provided above.
