Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is September 23, 2015. ********************************************************************* 01. Follow-up to pervious comment 04: 2-06.4.3 - The administrative street address and relevant case numbers (development package document, subdivision, rezoning, board of adjustment, DDO, MDR, DSMR, overlay, etc.) shall be provided adjacent to the title block on each sheet. 04. COMMENT: This project has been assigned the PDSD development package case number DP14-0174. List the case number in the lower right corner of all plan sheets. This development site is within the Greater Infill incentive District (GIID). If using the overlay regulations demonstrate compliance on the plans. If an MDR is processed, list the case number in the lower right corner and as a general along with the date and conditions of approval. Compliance with UDC section 5.12.6 and 5.12.7 must be demonstrated if using the IID overlay. ********************************************************************* 02. Follow-up to pervious comment 06: Label on the location map the following street names; Granada/Main, Speedway, Euclid, and Congress. 2-06.4.2.B - Identify major streets and regional watercourses within the square mile area and all streets that abut the subject property; and, 06. COMMENT: All arterial streets, railroad, washes within the location map mile must be drawn and labeled. ********************************************************************* 03. Follow-up to pervious comment 09: Your response to the previous comment 17 states that storage use has been removed from the development. General note Three (3) continues to include the Commercial Storage as a proposed use in this development. Remove the commercial storage use from general note three (3) on sheet one (1) if the use is not proposed. The use specific standards were not listed as requested by comment 9. List the specific use criteria applicable to each proposed use. The criteria shall be listed in comment three (3) adjacent to the applicable. 2-06.4.7.A.4 - Identify the existing and proposed use of the property as classified per the UDC. List all UDC sections applicable to the proposed uses. 09. COMMENT: On sheet two (2) the uses listed include Storage, Food Service, Office and Retail. List the Use Specific Standards applicable to each use that is proposed for this development. See the Use tables for the reference numbers. The proposed use list is not specific as to the type of Storage proposed whether Commercial Storage or Personal Storage. Personal and commercial storage uses have different Use Specific Standards. List the proposed Storage type along with the correct Use Specific Standard. The type of storage use affects the vehicle and bicycle parking requirements Also list the use of parking lot. The parking lot is not contiguous with the parcels with the building so the parking lot must stand on its own. The review of the plan will include the review of the parking lot/. The parking lot use and any applicable use specific standards must be listed. ********************************************************************* 04. Follow-up to pervious comment 10: Now that it is clear that the plan is to be designed to comply with the GIIS, the plan must demonstrate compliance with the requirement s of Article 5 section 5.12.4 and section 5.12.6. Explain by separate comments how the requirements of 5.12.4.and the design standards in section 5.12.6and Section 5.12.7 have been addressed. If an MDR is processed for any of the non-compliant requirements list the case number in the lower right corner of the plans sheets. Add the case number as a general note along with the date of approval and list any conditions of the MDR approval. 2-06.4.7.A.6 - If a plan or plat is prepared in conjunction with other applications or overlays or the parcel being developed is subject to conditions of an application processed previously, additional information must be added to the plan. Such applications and overlays include, but are not limited to: annexations; rezonings; special exceptions; Board of Adjustment variances; Design Development Options; Technical Standard Modification Request; overlays (Airport Environs Zone, Environmental Resource Zone, Gateway Corridor Zone, Hillside Development Zone, Historic Preservation Zone, Major Streets and Routes, Rio Nuevo District, Scenic Corridor Zone, WASH); Modification of Development Regulations through the Downtown Area Infill Incentive District or Rio Nuevo District; Downtown Heritage Incentive Zone; or, Design Review Board. Provide the following information on the plan. 2-06.4.7.A.6.a - List additional applications and overlays, by case number (if applicable), in lower right corner of each sheet. As a general note provide the type of application processed or overlays applicable, a statement that the project meets the criteria/conditions of the additional application or overlay, the case number, date of approval, what was approved, and the conditions of approval, if any. 10. COMMENT: Unless this plan complies with the requirements of the underlying zone and GIIS is used to design and develop this project, list the overlay case number in the lower right corner of all plan sheets and as a general note list the case number date of approval and conditions of approval if any. A separate IID plan will be required to be submitted for DRB review and approval if the GIIS overlay is utilized. ********************************************************************* 05. Follow-up to pervious comments 17and 18: This project has been reviewed for compliance with the requirements of the GIIS/IID. One of the requirements is for parking to be provided on site or can be offsite if certain requirements can be met. The maximum distance from the off-site parking area must be within 600 feet of the project site as measured along the pedestrian access system. It is clear that Ferrro Ave. is a named (alley) street which does not include a designated pedestrian sidewalk or pedestrian system. 7th Avenue and 5th Street are the logical streets that provide a designated pedestrian system but the distance is greater than allowed by Art 7 Section 7.4.6.1.a. In addition the pedestrian area along the 7th Avenue does not include a concrete sidewalk that provides for an accessible route. Application and approval of an MDR to allow the pedestrian system along the 7th Ave. and 5th street to be used to comply with Section 7.4.6.6.1.a or to allow Ferro Avenue to be used as the pedestrian connection from the off-site parking area to the project site. Both routes have compliance issues such as not accessible route along 7th Avenue and the distance that is greater than 600 feet and no sidewalk system along Ferro Avenue that provides for a safe pedestrian area. The off-site, off-street vehicle parking agreement is required due to the number of parking spaces required for the project cannot be provided on site. This document must be completed and recorded prior to zoning approval of the development package. 2-06.4.9.H.5.a - Show all motor vehicle off-street parking spaces provided, fully dimensioned. As a note, provide calculations on the number of spaces required (include the ratio used) and the number provided, including the number of spaces required and provided for the physically disabled. The drawing should indicate parking space locations for the physically disabled. A typical parking space detail shall be provided for both standard parking spaces and those for the physically disabled. For information on parking requirements for the physically disabled, refer to adopted building and accessibility codes of the City of Tucson. Design criteria for parking spaces and access are located in Section 7.4.6, Motor Vehicle Use Area Design Criteria, of the UDC. 17. COMMENT: UDC Section 7.4.6.1B.1.a - Off-Site Parking: Off-site parking is permitted under the following conditions. For projects outside the Downtown Parking District, off-site parking must be located within 600 feet of the project site. The distance of the accessible pedestrian path to get to the property is greater than 600 feet. A Board of Adjustment variance is required to approve a distance of 626'-7". 2-06.4.9.H.5.b - If any of the required parking is located off-site as permitted by the UDC, a drawing of that parking area is to be provided, together with the city's required parking agreement (include a copy of the lease agreement if applicable) must be provided. Please remember that in these situations, if the off-site parking location is a new parking area, it must comply with all parking area requirements and must be allowed as a principal use by the zoning classification of that property. If the off-site parking area location is an existing parking lot, the parking spaces utilized for the proposed land use must be non-required parking for the existing use for which the parking area was established. 18. COMMENT: A Lease and Parking agreement executed by the owner and approved and signed by the PDSD Director or Designee will be required prior to final approval of the DP package. See the attached OFF-STREET VEHICLE PARKING INFORAMTION PACKET. ********************************************************************* 06. Follow-up to pervious comments 19: A street may be used for access into and out of a loading area provided: the street is not shown the Major Streets and Routes plan. In this case 6th Avenue is a major street on the MS&R Plan. An MDR may be applied for to reduce the standards or waive the requirement for a loading zone but a Board of Adjustment variance would be required to allow the MS&R Street to be used to maneuver a vehicle in an out of the loading area. Depending on the decision to apply for a MDR or B of A Variance, if the loading zone is provided he maneuvering into and out of the loading zone must be demonstrated on the plan. 2-06.4.9.H.5.c - Show all loading zones, vehicle maneuverability fully dimensioned, and access route. Provide as a note the number of loading spaces required, the number provided, whether the loading space is a Type A or B as provided in UDC Section 7.5.4. 19. COMMENT: One (1) type "A" loading space is required for the restaurant use with a square footage greater than 5,000 SF. The Food Service use (Restaurant) is listed as 7,056 SF, one 12'x35' loading zone is required. Demonstrate maneuverability into and out of the loading zone and list the number of required and provided loading zones as in the zoning calculations. ********************************************************************* 07. Follow-up to pervious comments 26: If a sidewalk is required from the standalone parking lot to the project site through conditions of an MDR or B of A variance draw and label the width of the sidewalk The sidewalk will also have to be physically separated from the vehicular use area (Travel lanes) if placed within the Ferro Avenue. The plan sheet where the building is located does not demonstrate an accessible route from the proposed accessible parking spaces to the building. (The route cannot be provided along the back of the parking spaces.) See the comments from the ADA plans reviewers related to this item. 2-06.4.9.R - Show on-site pedestrian circulation and refuge utilizing location and the design criteria in Section 7-01.0.0, Pedestrian Access, of the Technical Standards Manual. 26. COMMENT: draw, label and dimension the street sidewalk that provides the accessible route from the proposed standalone parking lot to the front the building. The onsite pedestrian circulation shall be clearly annotated and dimensioned. The two gates on the asset and west sides of the exterior dining area must be a minimum of four feet wide. Dimension the opening of the gated areas. Draw, label and dimension the sidewalk along the 6th Avenue pedestrian area. ********************************************************************* 08. Should amendments be required to the base plan through the review process, the same amendments will be made to the landscape plan which will then be resubmitted along with the base plan. The landscape plan will contain the following identification in the lower right corner of each sheet: Rezoning case; Subdivision case; Board of Adjustment case; Design Development Option case; Development Review Board (DRB) case; and/or, Any other relevant case number for reviews or modifications that affect the site. UNIFIED DEVELOPMENT CODE ARTICLE 7: DEVELOPMENT STANDARDS LANDSCAPING AND SCREENING To enhance the visual appearance of the streetscape, a street landscape border is required in accordance with Table 7.6.4-1 along the street frontage of a site as follows: Minimum Width Street landscape borders must be a minimum of ten feet wide as measured from the street property line. Located on Site Street landscape borders must be located entirely on site, except that, if approved by the City Engineer or designee, up to five feet of the required ten foot width may be placed within the adjacent right-of-way area or within the Major Streets and Routes (MS&R) right-of-way area on MS&R streets. Fifty percent or more of the area of the street landscape border must be covered with shrubs or vegetative ground cover. The required ground coverage must be achieved within two years from the date of planting. Continuous screens along street frontages for vehicle use area must be as determined by Table 7.6.4-I. Provide appropriate screening. Vegetation used to meet the screening standards is not included in the ground cover calculation as provided in Section 5-01.5.3, Calculation of Plant Growth Coverage. Within a vehicular use area, one canopy tree is required for each four motor vehicle parking spaces or fraction thereof. The canopy trees must be evenly distributed throughout the vehicular use area. Every parking space must be located within 40 feet of the trunk of a canopy tree (as measured from the center of the tree trunk). Parking site does not provide appropriates canopy trees. It appears a significant number of comments were not addressed; please assure all comments are addressed before resubmittal. PDSD Engineering Division does not recommend approval until the remaining comments are addressed for next submittal.
