DEVELOPMENT PLAN COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Unified Development Code (UDC), Administrative Manual (AM) & Technical Standards Manual (TSM) were addressed.

1. Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is May 06, 2014.

2. The revisions to the tentative plat (DP12-0141) and final plat (S13-007) for Hacienda at Wrightstown I will need to be approved prior to approval of this development package. Review of both plans will need to done to ensure consistency between the two plans.

The following comments are based on the requirements of Administrative Manual (AM) 2-06.0. Development package review comments;

3. The CC& Rs were not provided. The Hacienda at Wrightstown I CC&Rs will need to be revised to reflect the two phases, common areas etc. Provide a copy of the proposed CC&Rs with you next submittal.

Based on the applicant's request; a concurrent review is under way for both Development Plan 13-0077, a residential project and Rezoning Case C9-13-02, a request to change the land use zone from RX-1 to R-1, to allow Haciendas at Wrightstown to add 13 lots (phase II) to expand the subdivision.

Prior to the approval of the proposed development plan DP13-0077; rezoning case C9-13-02 must be approved by Mayor and Council. Development plan DP13-0077 shall be required to be in full compliance with all of C9-13-02 rezoning conditions.

Staff offers the following comments:

On November 6, 2013, Mayor and Council approved rezoning C9-13-02 with rezoning conditions. Development plan DP 13-0077 is not in compliance with the following rezoning conditions.

1. Prior to development plan approval, development plan notes shall include all approved rezoning conditions, verbatim, as approved by Mayor and Council. Development plan DP13-0077 omitted rezoning condition No. 13, which reads the following: Along the eastern boundary of lot 25, the perimeter wall shall have a setback of ten feet and be properly landscaped per Code requirements. Please add rezoning condition No. 13 to DP rezoning notes.

2. Please correct, landscape plan to comply with rezoning condition No. 13, which involves landscaping along the east perimeter of lot 25.

3. Please correct, DP13-0077, sheet C1 of 15, General Note 34 to comply with rezoning condition No. 8. Please remove lots numbers from this note.

4. Please correct, DP13-0077, sheet C1 of 15, General Note 38 to comply with rezoning condition No. 11. Please stipulate setback as per rezoning condition 11(verbatim), as it relates to garage setback from street properly along the cul-de-sac frontage.

Tucson Electric Power Company (TEP) has reviewed the Tentative Plat for Haciendas at Wrightstown II, Lots 13-25, submitted for review on October 15, 2013. TEP is unable to approve the plat at this time.

Please call out the 10' Gas and Electric Easement per DKT 675, PG 143 located on Brown Avenue as a separate notation from the language of the 10' of to be dedicated by the plat for roadway. The easement will remain in place within the road right of way.
