DEVELOPMENT PLAN COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is September 17, 2013

The following comments are based on Development Standard 2-01.0:

1. This comment was not addressed. Per our discussions a building plan must be submitted so that a hold can be put on the Certificate of Occupancy. D.S. 2-01.3.8.B There is a "1' NO-ACCESS EASEMENT" called out along the east property line. As development is proposed with in the easement it must be abandoned prior to approval of the development package.

2. This comment was not addressed. Per our discussions a building plan must be submitted so that a hold can be put on the Certificate of Occupancy. D.S. 2-01.3.8.B There are two (2) "30' OPENING IN NO-ACCESS EASMENT" that do not appear to align with the proposed entrance access lane. If the "1' NO-ACCESS EASEMENT" is to remain it will need to revised so that the opening aligns with the proposed entrance access lane.

3. This comment was not addressed. Per our discussions a building plan must be submitted so that a hold can be put on the Certificate of Occupancy. D.S. 2-01.3.8.B The "10; EASEMENT FOR COMMUNICATION LINES" shown to be released will need to abandoned prior to approval of this development package.

4. This comment was not addressed. As you have not demonstrated that this RX-1 zoned area meets the requirements of LUC Section 1.3.5 and it appears that you are saying the zoning boundary is incorrect a decision by the Zoning Administrator is required, see LUC Section 1.3.6. D.S. 2-01.3.9.F There is proposed development within the RX-1 zoning along the south side of this parcel. Provide documentation that this lot meets the requirements of LUC Section 1.3.5 or remove the proposed development from the RX-1 zoned area.

5. This comment was not addressed for the vehicle parking spaces west of the proposed car wash. D.S. 2-01.3.9.H.5.a Provide a parking space depth dimension for the parking spaces shown south of the southwest side of the proposed building.

6. D.S. 2-01.3.9.H.5.d Per LUC Section 3.3.8.2.B RETAIL TRADE USE GROUP*, Vehicle Rental and Sales, Long-term bicycle parking is based on Gross Floor Area (GFA). That said the Long-term Bicycle parking Calculation is not correct. Show the correct GFA, 29,811, in the calculation.

7. D.S. 2-01.3.9.H.5.d Detail "G" Sheet 9, Long-Term bicycle parking, based on the location shown on sheet 5 only one half of the locker will be accessible.

8. This comment was not addressed. Per D.S. 2-08.3.1 provide the required four (4) foot pedestrian refuge area. D.S. 2-01.3.9.Per D.S. 2-08.4.1.B A sidewalk will be provided adjacent and parallel to any PAAL on the side where buildings are located. That said provide a 4' sidewalk along the southwest side of the proposed building.

9. D.S. 2-01.3.9.R Clarify what the doors are that are shown along the west side of the building. If this area is part of the building provide the required sidewalk.
