Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is August 23, 2013 The following comments are based on Development Standard 2-01.0: 2. D.S. 2-01.3.9.O The garage setback shown does not meet the requirement of LUC Section 3.2.6.5.b.2.a A minimum setback of nineteen (19) feet from the back of sidewalk to allow sufficient space for a motor vehicle to be parked in front of the carport or garage 1. This easement needs to be shown on sheet C2 and shown as "PER FINAL PLAT. D.S. 2-01.3.9.U Rezoing condition 20 allows for access from Lot 8 to Brown Avenue. Show the proposed access on the plan and on the requested plot plan for Lot 8. The screen wall required by rezoning condition 13 should run along the east side of Lot 8 except where the access is proposed. An access easement is required across the common area. 2. This comment was not addressed correctly. Per LUC Section 3.2.9.2.B the vehicle use area needs to be included in the lot coverage calculation. Zoning acknowledges that the lot was listed incorrectly Provide a plot plan for lot 8 showing how the existing house meets the requirements of an R-1 zoned parcel on the plan. The plot plan will show the setbacks, lot coverage etc. 3. Once the above comments have been addressed Zoning is willing to provide an over-the-counter review. Development plan DP12-0141 is required to be in full compliance with rezoning case C9-12-11, rezoning conditions. Staff offers the following comments: 1. Please revise Development Plan 12-0141, sheet C4 of 15, and revise wording in rezoning conditions #18, #19, & #20 to read verbatim, as provided by rezoning Ordinance 11047. 2. Please revise Development Plan 12-0141, sheet C1- of 15 and C-2 of 15 to identify by Key Note and on the lot layout design the location of the required trail, per rezoning condition #21. 3. Please revise Development plan and landscape plan where appropriate (including sheet C-4 detail J/C4 and sheet 8 of 15 ) to comply with rezoning condition #21, show 10-foot wide trail in the utility easement located west of Brown Avenue.
