The one-year expiration date for this development plan is 03/08/13.

2. DS 2-01.2.5 A three (3) inch by five (5) inch space shall be reserved in the lower right quadrant of each sheet for a county approval stamp. Provide on all sheets of the development package.

Move the provided address outside of the 3 X 5 box.

3. DS 2-01.3.3 This project has been assigned case number DP12-0030. Place this number near the lower right corner of all sheets. Provide all relevant case numbers, DRB review, near the lower right corner of all sheets.

4. DS 2-01.3.4 Provide on the location map the section corners.

5. DS 2-01.3.7.A.4 The proposed use "Food and Beverage Sales" in general note #3 appears to be incorrect. Food and Beverage Sales is for the sale of items not to be consumed on the premise. The landscape plan indicates an outdoor eating area. The correct use would be Food Service "36", subject to: Sec. 3.5.4.6.C. Clearly indicate on the site plan (sheet 1 of 9) the outdoor eating area as well as the area to be used for Food Services separate from the retail use area. Revise the parking calculations to reflect the changes in square footage and number of required parking spaces.

6. DS 2-01.3.7.A.6 Provide as a general note (#15) that this project has been designed to meet Sec. 5.1.8, Design Review Board (DRB), provide the case number, date of approval, what was approved and the conditions of approval.

7. DS 2-01.3.8.A Provide the location and recording information for the abandonment of the right of way for Fourth Ave.

8. DS 2-01.3.8.B If applicable, provide the location, width, recordation information, and purpose of all easements.

9. DS 2-01.3.9.F All existing zoning classifications on and adjacent to the project (including across any adjacent right-of-way) shall be indicated on the drawing with zoning boundaries clearly defined.

10. DS 2-01.3.9.H.4 Indicate if existing streets are public or private; provide street names, widths, curbs, sidewalks, and utility locations, all fully dimensioned.

11. DS 2-01.3.9.H.5.a Per LUC Sec. 3.3.4 the ratio for retail use parking is 1:300 revise note on sheet 2 of 9.

Provide parking calculation for the Food Service use at a ratio of 1:100 of GFA per Luc Sec. 3.3.4.

Provide the number of units for the group dwelling use in the parking calculations.

12. DS 2-01.3.9.O Provide dimensions for the building setbacks from either the property lines or the back of future curb whichever is required.

13. DS 2-01.3.9.Q Provide within the footprint of the building the proposed height of the building as well as dimensions of the footprint of the proposed building.

14. DS 2-01.3.9.R Show on-site pedestrian circulation as required by the LUC utilizing location and the design criteria in Development Standard 2-08.0.

The area at the southwest corner of the property indicated as new pavement is also indicated on the grading plan as a pedestrian circulation path. Pavement does meet the requirement of DS 2-08.5.1.C. Revise.

Provide pedestrian circulation path to each adjacent street of this project. Per DS 2-08.4.1.A.

15. DS 2-01.3.9.T Show existing or proposed pedestrian circulation along abutting rights-of-way. Such sidewalks must comply with accessibility requirements for the physically disabled and the design criteria in Development Standard 3-01.0.

Show refuse collection areas, including locations of dumpsters, screening location and
materials, and vehicle maneuverability, fully dimensioned, and access route. If dumpster service is not proposed, indicate type of service. For specific information on refuse collection, refer to Development Standard 6-01.0. Refuse collection on all projects shall be designed based on that Standard, even if collection is to be contracted to a private firm.

16. DS 2-01.3.9.V Please indicate the location and type of postal service to assure there are no conflicts with other requirements. If mail is to be delivered to an area within a building please state so on the plan.

17. DS 2-01.3.9.W If applicable, indicate the locations and types of proposed signs (wall, freestanding, pedestal) to assure there are no conflicts with other requirements and that minimal locational requirements can be met.

18. Because of the type of development proposed (student housing) zoning strongly suggests that bicycle parking be provided.

Engineering Division does not recommend approval of the Development Plan Package at this time. This review falls under Development Standard 2-01. All comments reflect Site Plan, Grading Plan and SWPPP review. The following items need to be addressed:


SITE PLAN: It is recommended that Development Standard 2-01 "Development Package" be reviewed prior to resubmittal. DS Sec.2-02 no longer exists and all reviews fall under DS Sec.2-01 for Development Package. The standard has changes that must be incorporated into the plan sheets for review and approval.

1) DS Sec.2-01.3.2.D: Clarify on the development plan document the administrative address, per the plan set the address is listed as 2 N 4th Ave, however per Permits Plus the address is 350 E Congress St.

2) DS Sec.2-01.3.3: The relevant Development Plan Package number (DP12-0030) may be added to the lower right hand corner of the plan on all sheets.

3) DS Sec.2-01.3.5: Revise the plan set to include the SWPPP Exhibit within the sheet index on the first sheet of the development plan document and within the development plan package.

4) DS Sec.2-01.3.7.A.6.b: Revise General Note #9 on the Development Plan Package to reference all special overlay zones that are applicable to this site; specifically state that "the project is designed to meet the overlay zone criteria for Sec.2.8.4 Gateway Corridor Zone."

5) DS Sec.2-01.3.8.C: Provide a label (public or private, label Broadway as a Gateway Route) and dimensions for the existing right-of-way of all streets, specifically the dimensioned width of existing paving, curbs, curb cuts and sidewalks.

6) DS Sec.2-01.3.8.C: Provide on the development plan document all existing conditions within 50-feet of the site, specifically the existing patio (D11-0010) for the Rialto Theater that has been constructed within the right-of-way of Herbert Ave thru a T.R.E. Clearly label these improvements within the Herbert right-of-way and verify if they may or may not affect the proposed onsite conditions and access for this project.

7) DS Sec.2-01.3.8.F: Revise the development plan document to provide the Improvement Plan reference Number in plan view for all existing storm drainage facilities on and adjacent to the site.

8) DS Sec.2-01.3.9.H.2: Revise the development plan documents, specifically the site plan to show the existing and/or future sight visibility triangles for Herbert Avenue at both Congress and Broadway Blvd. Since both roads act as one-way roads it maybe necessary to reverse the near and far side dimensions for line of sight and traffic visibility.

9) DS Sec.2-01.3.9.J: Revise the development plan package to verify conformance with the future Modern Streetcar Project and public roadway improvement plans that will affect the public right-of-way of Congress St and Broadway Blvd. Refer to R. Bruce Woodruff A.I.A., LEED AP, COTGSD AE Project Manager at 520-837-6310 or bruce.woodruff@tucsonaz.gov for any questions regarding the Modern Streetcar Project.

10) DS Sec.2-01.3.9.R: Refer to comments from Ron Brown, RA Structural Plans Examiner for all handicap accessibility comments that may be associated with this project.

11) DS Sec.2-01.3.9.R: Provide on the development plan document clearly labeled and dimensioned on-site pedestrian circulation as required per DS Sec.2-08. Provide a pedestrian access route to all adjacent streets meeting the requirements of DS Sec.2-08.4.1.A.

12) DS Sec.2-05.2.4.T: Verify or provide approval through Environmental Services for refuse pickup. Per DS Sec.6-01 onsite refuse collection is required and the development plan package should reflect the location and access to the required refuse container. If Environmental Service is not requiring onsite collection then PDSD Engineering will approve this comment based on their approval of the development plan package.


SWPPP: The SWPPP does not meet the minimum requirements of the AzPDES Construction General Permit (CGP). Revise the SWPPP according to these comments:

13) Part III.C.2.d: Indicate the percentage of the site that is impervious before and after construction.

14) Part III.C.3.e: Clarify the location of protected storage area (PSA) as shown within the right-of-way of Herbert Ave.


GENERAL COMMENTS:

Please provide a revised Development Plan Package and SWPPP that addresses the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Ensure that the development discourages this behavior with wayfinding signs to direct pedestrians to existing crosswalks, limit pedestrian facilities at the Y of the Broadway/Congress intersection, or provide an overhead pedestrian corridor between this development and the existing parking garage.

6. Additional coordination with Mo El-Ali of TDOT is required prior to final acceptance of the development.

Development Standard 9-10.4.3.B.1 Shade shall be provided for at least fifty (50) percent of all sidewalks and pedestrian pathways as measured at 2:00 p.m. on June 21 when the sun is 82° above the horizon (based on 32°N Latitude). Shade may be provided by arcades, canopies, or shade structures, provided they respect the historic and design context of the street and the architectural integrity of the building. Deciduous trees, as proposed in the Downtown Comprehensive Street Tree Plan, are encouraged to supplement existing evergreen trees.
The use of plantings and shade structures in the City right-of-way is permitted to meet this standard. The shade provided by a building may
serve to meet this guideline.

2. Along pedestrian pathways that lead to the areas planned for retail and entertainment uses and high pedestrian traffic, shade devices should be provided at pedestrian waiting areas and street intersections.

Include with re-submittal DRB approval documentation. Indicate on the lower right hand corner of the development plan package, the case number, date of approval, and any conditions imposed.

The Pima County Regional Wastewater Reclamation Department (PCRWRD) has reviewed the proposed sewer collection lines for the above-referenced project. The following comments are offered for your use:

1. Obtain a letter from the PCRWRD’s Development Liaison Unit, written within the past year, stating that treatment and conveyance system capacity for the project is available in the downstream public sewerage system and provide a copy of that letter to this office. The required form to request such a letter may be found at:

2. Sheet 3: Call out New MH #1 as public.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the development plan. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second(2nd) submittal. A check for the review fee of this submittal in the amount of $50.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.
