Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The previous approval date has expired but has been extended to 1/10/2014. The new one-year expiration date for this development plan is 01/10/2014. 2. Per your response to the previous comment there has not been a submittal for review of the WASH overlay. This portion of the previous comment will remain until the overlay has been completed and approved. Please address the previous comment and revise or add the appropriate information related to the WASH overlay as requested. Portion of Previous comment 2: DS 2-01.3.3 This project is required to submit for and obtain approval of a special application for a wash overlay. Once completed, place the case number near the lower right corner of all sheets and provide a note indicating case umber, date of approval, what the special application was for and any conditions of approval. 3. The recording information for the right of way dedication must be labeled on the plan where the keynotes have been provided for the sequence number to be added. In addition and just as a clarification to your response to the previous comment, was the square footage of the parcel listed on the plan with or without the right of way dedicated area? Dedicated area cannot be used to increase the developable area. Portions of the previous Comment 3: DS 2-01.3.9.I Clearly indicate the area of right of way dedication required by the conditions of rezoning. On sheet 2 of 14. Provide recording sequence number for the dedication of right of way. On sheet 2 of 14 4. This information must be added to the plans as requested and if available, submit any documents related to such recordation prior to approval of the development package. Previous Comment: DS 22-01.3.9.L Clearly indicate the recording information of the required easement per rezoning condition #5. 5. A separate letter was provided as requested but several of the conditions have not been completed. All conditions of rezoning must be demonstrated on the plans where possible and reflected via the response letter as to how the conditions were met or demonstrate on the plans how a specific condition that needs to be represented on the plans complies such as but not limited to such conditions, like dedication info along with recordation information, screening requirements, type of lighting, etc. It is acknowledged that compliance with some of the conditions is in process but it is also noted, in review of the plans that compliance with some of the conditions have not been demonstrated on the plan sheets. For instance the screening condition along the south boundary has been depicted with Wrought Iron Fencing in 3 locations on the plans including on sheet 14. Rezoning condition 18 specifically states that 8-foot high Wrought Iron Fencing can be provided along Drexel and Campbell. The site and landscape plan sheets and elevations sheet 14 depict 3 locations with Wrought Iron fencing along the south boundary. Also, on sheet 14 there are two notes related to heights; one is for the building height and the other height is for the screen wall. The height of the screen wall where the screen wall is provided must be 8 feet tall, revise the plan sheets as required to demonstrate compliance with rezoning conditions 18. Rezoning condition 13 is related to lighting, yet the plans do not indicate and lighting anywhere on the plan sheets nor are there any detail that demonstrate compliance with the type of lighting that will be used. Provide details drawings on the type and method of for shielding the light and locations. It is not clear if mechanical equipment is proposed and where. Rezoning condition 15 states that the mechanical equipment must be ground mounted and screened. The plan does not indicate the location of the equipment or method of screening. There are several other conditions that need to be demonstrated on the plans that have not been clearly depicted on any of the plan sheets. Color elevations of the buildings were not provided in the development package. Review all rezoning conditions and ensure that conditions that need to be demonstrated on the plan sheets are depicted with details where necessary and provide any documentation required, such as recordation information. The response to the conditions should clearly state how the condition was addressed whether demonstrated on the plans via drawings or additional documents attached to the DP. Previous Comment 5: DS 2-01.3.9.U Provide a separate letter clearly indicating how each of the conditions of rezoning have been met. Condition of rezoning #17 requires an 8' wall along the south and east borders of the property. The elevations provided on sheet 14 of 14 indicate a 6'-8" wall. Clarify. The elevations provided do not appear to indicate the structures which are being used as part of the walls. Clarify. Clearly indicate the location and height of all walls and fences on the development plan. Revise keynote #20 on sheet 2 of 14 to reflect the required 8' wall.
