I reviewed the project for compliance with the IID Design Criteria. Here are my comments on the Just a Fence project:

I recommend approval of the project conditioned upon the fence being finished with a sealant to prevent rust from bleeding.

The following is not a condition, but a recommendation to the applicant: Use umbrellas or some other non-permanent shade structure when/if the patio is used during the day.

Resubmittal Required: Traffic Engineering does not recommend approval of the Development Plan; therefore a revised Development Plan is required for re-submittal. The following items must be revised or added to the development plan. Include a response letter with the next submittal that states how all comments have been addressed.

1. Verify that a TRE has been secured for the development within the right of way. Ensure that the proposed development falls entirely within the limits of the TRE.

2. An Excavation Permit or a Private Improvement Agreement will be necessary for any work performed within the Right-of-way. Contact Permits and Codes at (520) 791-5100 for permit information.

3. The permit for right of way work will not be issued until the applicant has contacted Jim Rossi, Dave Koss, or Jose Ortiz in establishing the commencement date for payment to the City of Tucson on the noted TRE.

COMMENTS: Please resubmit revised drawings along with redlines and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.


1. If any of the following comments are to be waived per the Infill Incentive District criteria provide documentation of what has been waived and add this information to the plan.

2. Provide a legal property description for the entire site. This site totals 8 separate tax parcels. A tax parcel combination is advised. Provide a copy of the tax parcel combination.

This project appears to be located with in the City of Tucson right of way, provide a copy of the Temporary Revocable Easement (TRE). Clearly indicate the location of the boundaries of the TRE with distance and bearing of the leased area.

3. This project appears to be in conjunction with the other buildings on the site. Provide a site plan clearly indicating all buildings as well as all property lines.

4. Clearly indicate the proposed use of the "fenced area" per the LUC criteria with development designator and any subject to sections. Alcoholic Beverage Service "36", subject to: Sec. 3.5.4.19.C

Clearly indicate the square footage of all areas used as a bar. A large bar is not allowed in this zone. Bar, Large. A bar which encompasses eighteen thousand (18,000) square feet or more of total area, including gross floor area and any outside areas providing service to the public, such as outdoor seating and recreation areas.

5. Zoning considers this expansion as a Bar use and has reviewed this plan accordingly.

6. The proposed expansion will require providing a total of 41 additional parking spaces to be provided. Provide the number of required and provided vehicle parking spaces on the site plan.

7. Per LUS 3.3.8 this project will require two short term and two long term bicycle parking spaces. Provide a detail of the proposed bicycle parking spaces clearly indicating the required access aisle, surfacing material, lighting, type of rack, etc.

Provide in the calculations the number of required and the number of provided bicycle parking spaces.

8. Provide a pedestrian circulation path (sidewalk) from the north end of the patio connecting to the sidewalk in the right of way. Clearly indicate how pedestrian circulation will be provided to the gates on the south side of the patio.

9. If applicable provide the location of all easements, use, dimensions and recording information.

10. Provide the zoning of all adjacent properties.

11. This project has been assigned case number D11-0010, place the case number near the lower right corner of all sheets.

12. Provide the allowed and provided Floor Area Ratio (FAR) calculations on the site plan per development designator 36.

13. Provide the expansion calculations on the site plan.

14. On sheet O1 in the project information section, remove the historic overlay portion and I believe this project is to be under the Infill Incentive District not the Rio Nuevo Downtown District. Clarify.

The Engineering Division doesn’t recommend approval of this development plan at this time. Please address the following comments.

1. Provide a complete development plan with dimensions of lots, buildings, rights-of-way and other features.
2. Clearly label the area authorized by the temporary revocable easement for the proposed private use. Please provide a copy of the TRE document or some other documentation of the permission granted for use of the alley.
3. The “scope of work” indicates that this plan is only for the construction of a temporary perimeter fence. However, the plan seems to include the construction of additional stairs and ramps. Please clearly indicate the features that are existing and the ones proposed.
4. Clarify the use and traffic controls for the portions of the alley not included in the fenced area. How will vehicles be prevented from inadvertently entering the alley and subsequently having to back out onto Broadway Boulevard?
