Comments were based on the preliminary conditions recommended by the Zoning Examiner, and conditionally approved, subject to the applicant adressing those conditions as adopted by Mayor and Council. C9-11-02 was adopted by Mayor and Council on September 7, 2011 – Ordinance No. 10923. Below are comments based on the rezoning conditions adopted by Mayor and Council. Conditionally Approved subject to the following: Comments: 1) Applicant to provide a lighting plan (Rezoning Condition 14) – and is to be identified under Sheet Index on Sheet 1 of 12. Also Lighting Plan should be part of the development package sheets with the correct pagination. 2) Provide a keynote that identifies Rezoning Condition 21 is being met, i.e. reflective, pervious materials in pedestrian areas and adjacent to planting areas. Provide this information on both the site plan (sheet 3 of 12) and landscape plan (sheet 9 of 12). 3) Provide a General Note, sheet 1 of 12, for Rezoning Condition 22. 4) Provide a General Note, sheet 1 of 12, for Rezoning Condition 23. 5) Provide a General Note, sheet 1 of 12, for Rezoning Condition 24. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is 03/03/2012. 2. DS 2-01.3.8.B A cross access agreement with the property to the east will be required to be provided. Provide recording sequence information for the agreement on the plan. 3. DS 2-01.3.9.A A tax parcel lot combination will be required to be completed and approved for the 4 separate lots. The grading plan has been reviewed by Zoning Review Section but cannot approve the plan until it has been approved by the Engineering, and Landscape Review Sections and until all zoning comments or concerns have been addressed. 2. Zoning could not verify that the grading plan was in compliance with the approved development plan. Please submit two copies of the approved and stamped development, landscape, and NPPO plans with the next grading plan submittal. 3. Zoning will re-review the grading plan on the next submittal to insure compliance with the approved site/development plan. Additional comments may be forthcoming. |
