1) This project was submitted as a concurrent rezoning case (C9-11-02, Circle K - Speedway Boulevard, R-1 to C-1) and development plan package (D11-0006).

2) This section reviews the development plan package for compliance with certain rezoning conditions. The comments below are based on the preliminary conditions recommended by the Zoning Examiner.

3) The rezoning case number is C9-11-02, not C10-27-10. Please revise sheet 2/12 accordingly.

4) The plans are conditionally approved, subject to the applicant addressing comment #3 above, and Mayor and Council adopting the preliminary conditions, as indicated on the plans. Any Mayor and Council changes to the preliminary conditions must be addressed by the applicant prior to final approval. If the Mayor and Council adopt the preliminary conditions, and comment #2 above is addressed, a resubmittal to this section isn't required.

The Development Package (DP) cannot be approved as submitted. Please address the following review comments prior to the next submittal.

Development Package:

1. Please include a detailed response letter to the comments along with the corrected copies of the DP.
2. A legend that shows and describes all symbols used on the drawing is to be provided, preferably on the first sheet. D.S. 2-01.2.9. Include the wall symbol in the legend.
3. Edit note no. 19. Thad Harvison is no longer employed by the City of Tucson. He has joined the lucky ranks of the retired. Call permits and Codes @ 791-5100 for the replacement information.
4. Edit note no. 15 to include the information from the recent FEMA FRIM panel 'L' series.
B. All easements shall be drawn on the plan. The recordation information, location, width, and purpose of all easements on site will be stated. Blanket easements should be listed in the notes, together with recordation data and their proposed status. Should an easement not be in use and be proposed for vacation or have been abandoned, so indicate. However, should the easement be in conflict with any proposed building location, vacation of the easement shall occur prior to approval of plan unless written permission from the easement holder(s) are provided. A cross access agreement with the property adjacent to the east will be necessary prior to the approval of the DP. As a rule of thumb, all blanks must be filled in or removed from the DP. A Cond. approval can be applied to the project provided that the recording information will be available when the mylar is submitted to the CDRC office for signatures. Communication with the reviewer explaining the status of the recordation is essential.


5. Information on Proposed Development. The following information on the proposed project shall be shown on the drawing or added as notes. D.S. 2-01.3.9.
H. Proposed traffic circulation:
2. Show future and existing sight visibility triangles. On a designated MS&R street, the sight visibility triangles are based on the MS&R cross-section. The SVT's at the NE corner of Craycroft Rd. and 1st St. are not shown correctly. The SVT's on the right side of a street with medians should be 20'x30' pedestrian triangles. The stem portions of the SVT's are not positioned correctly and the ped. SVT's do not scale to dimensions. Per previous comment.
6. The water harvesting basins cannot be located in the existing nor in the fut. r/w. Obtain documentation from TDOT for allowing the locations of the basins in the r/w. Per previous comment.
7. Elongate the x-sections A, B, C and D on sht. 6 to include the exist. and future r/w's, on-site improvements, landscaped areas and a portion of the P.A.A.L. Show the depressed landscape and basin area correctly on x-sections. The x-section shows that area as flat w/o a depression or a slope from the building.

Drainage Statement:
1. The DS is accepted by engineering.

Grading Plan:
1. FYI - The length of the refuse enclosure wall (11'-8") is not "block module". In other words, if they were to build the enclosure using that dimension, the mason would have to cut the block. The next dim. without having to cut block is 12'-0". Here is the rule for masonry construction:
Dim. for feet that end in an even number, use 0" or 8", ex. 12'-0" or 12'-8"
Dim. for feet that end in an odd number, use 4", ex. 1'-4" or 11'-4"
More importantly, the refuse container is not per COT standard. Refer to D.S. 6-01.5.2 and figure-3A, "Double Container Enclosure" for specific details.
2. List the information of the Geotechnical Investigation Report in the grading plan notes.

1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is 03/03/2012.

2. DS 2-01.3.3 The case number (C10-27-10) is still being referred to in general note number 5 and as title of the rezoning conditions on sheet 2 of 12.

3. DS 2-01.3.8.B A cross access agreement with the property to the east will be required to be provided. Provide recording sequence information for the agreement on the plan.

4. DS 2-01.3.8.C Clearly indicate that the dedication of right of way is to occur at a future date.

5. DS 2-01.3.9.A A tax parcel lot combination will be required to be completed and approved for the 4 separate lots. Provide a copy of the completed combination.

6. DS 2-01.3.9.F The indicated zoning classifications are to be shown as they will be after the rezoning is complete. Remove the line between the C-1 and the C-1 zones.

7. Provide recording sequence numbers for all easements including the easements to be abandoned. Required prior to approval.

1. The grading plan has been reviewed by Zoning Review Section but cannot approve the plan until it has been approved by the Engineering, and Landscape Review Sections and until all zoning comments or concerns have been addressed.

2. Zoning could not verify that the grading plan was in compliance with the approved development plan. Please submit two copies of the approved and stamped development, landscape, and NPPO plans with the next grading plan submittal.

3. Zoning will re-review the grading plan on the next submittal to insure compliance with the approved site/development plan. Additional comments may be forthcoming.
