Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is 12/07/11. 2. DS 2-01.3.2.B A brief legal description is required to be placed near the title block. This site contains four (4) separate parcels therefore you will need to show how the parcels can work as stand alone parcels if sold separately or provide a Pima County Tax Parcel Combo and a recorded covenant regarding development and use of real property. 3. DS 2-01.3.3 Provide relevant case numbers (DDO, DSMR, overlay etc.)adjacent to the title block on each sheet. 4. DS 2-01.3.7.A..6 If a DSMR is approved for this project, please add the DSMR number, date of approval, what the DSMR is for and any conditions of approval on the development plan (DP) If a DDO is approved for this project, please add the DDO number, date of approval, what the DDO is for and any conditions of approval on the development plan (DP) 5. DS 2-01.3.8.B All easements shall be drawn on the plan. The recordation information, location, width, and purpose of all easements on site will be stated. Should an easement not be in use and be proposed for vacation or have been abandoned, so indicate. However, should the easement be in conflict with any proposed building location, vacation of the easement shall occur prior to approval of plan unless written permission from easement holder(s) is provided. There is a 9' easement located along the east side of the property which must be addressed as per above. The building appears to be built over the easement. 6. DS 2-01.3.8.C This site must be designed as to incorporate the future widening of the intersection of Glenn and 1st Ave. The 1st Ave side as indicated has not taken into account the intersection widening to a width of 75' half right of way with the required taper. Provide documentation from Andy Dinauer approving the plan as indicated. 7. DS 2-01.3.9.H.5.d Bicycle parking provided on the DP does not meet the requirements of revised DS (Development Standard) 2-09. Per DS 2-09.4.1 Class 2 bicycle parking facilities will be located no more than fifty (50) feet from the main building entrance(s) and will be along the front side of the building as well as along other sides of the building that has an entrance. Reviewer is assuming a DSMR will be applied for. 8. DS 2-01.3.9.O The required building setback along the east property line is 1 ½ times the height of the building wall. A setback of 2.17' does not meet this requirement. A Design Development Option (DDO) variance will be required to be completed and approved. Provide wall height of the east elevation of the building in order to complete comments for the variance. 9. DS 2-01.3.9.W The monument sign on 1st Ave is located within the future right of way. Provide a note on the plan stating the upon the widening of 1st Ave the sign will be removed or relocated at no expense to the City of Tucson. The grading plan has been reviewed by Zoning Review Section but cannot approve the plan until it has been approved by the Engineering, and Landscape Review Sections and until all zoning comments or concerns have been addressed. 2. Zoning could not verify that the grading plan was in compliance with the approved development plan. Please submit two copies of the approved and stamped development, landscape, and NPPO plans with the next grading plan submittal. 3. No portion of the MS&R right-of-way area that is publicly owned will be used toward complying with Land Use Code (LUC) requirements, unless specifically stipulated. An approved site plan is required indicating how the project will comply with LUC requirements when the MS&R right-of-way can no longer be used as part of the site. LUC 2.8.3.5.A, & F. Identify the MS&R right of way for 1st Ave. and add the width dimension for the landscape border. 2) Vegetation or structures higher than thirty (30) inches must be located outside of the sight visibility triangle. Address this requirement where SVT's based on the MS&R Plan apply. DS 2-06.3.7.B.1. The Chihuahuan sage will grow too tall. Plants in the SVT should be easily mantainable at 30" or less. 3) Provide an interior landscape border as applicable along the east boundary. See LUC Table 3.7.2-I. The border length for the tree calculation should be entire length of the property boundary. Revise the calculation. Where an easement precludes installation of the required trees within ten feet of the property line, the trees are to be installed elsewhere on the site between the building(s) and the property line.. LUC 3.7.2.4.B.3 A DDO for the landscape border may be appropriate to modify the tree locations. Contact Zoning Administration. 4) The Rainwater Harvesting Plan should include Basin A due to the plant water demand associated with the plantings. |

The Development Package (DP) cannot be approved as submitted. Please address the following review comments prior to the next submittal. Development Package: 1. Please include a response letter to the comments along with the corrected copies of the DP. 2. Due to substantial drainage issues for this project, the site design was changed considerably including but not limited to: lot combinations, re-design of the drainage structures etc. These comments are a reflection of those new changes. 3. The development package cannot be approved prior to recordation of all easements including the "low flow" pipe going back into the acquired alley. Documentation from grantee must also be provided for constructing the drainage structure over the recorded communication easement. 4. Provide documentation for all agreements concerning approval of drainage structures on the public Right-of-way. 5. There is still construction located off the property (NE corner) onto the adjacent property to the East and North. Off-site construction and/or design is cannot be approved with out the registered property owner's permission. 6. Explain why the property (1/2 the alley) at NE cor. of the property was aquired? What will happen if an easement over that portion of the channel cannot be obtained? Drainage Report/Grading Plan: 1. Please include a response letter to the comments along with the corrected copies of the DR. 2. See DP comments for easement dedicatioin. 3. Why is the "low flow" pipe going back in the drainage channel instead of onto 1st Ave? 4. Buildings or other substantial improvements are not allowed in a drainage easement. 5. The stormwater Detention/Retention basin, water-harvesting basins or other drainage improvements for the specific project cannot be located in the existing or future right-of-way. Provide documentation for all acquisitions and or easements for all drainage structures on or off the property. 6. The erosion hazard setback must be delineated. 7. Submit a geotechnical report with the re-submittal. Stormwater Prevention Pollution Plan: 1. Please include a response letter to the comments along with the corrected copies of the SWPPP. 2. It appears the BMP's are satisfactory to contain the stormwater pollution in concept but still must be shown/called-out specifically on the plans. All documents that require signature must be signed by responsible party prior to approval. Usually a text booklet is included with the submittal which includes but is not limited to: the required general permit, an area (pages) in which the SWPPP will updated when changes occur to the plan, etc. 3. Designate a concrete wash-out area on the plans. 4. The SWPPP plan must meet and include all the requirements of the ADEQ SWPPP check list that is available on line.
