This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

Sheet 2: Show the public sewer easement with width and recordation information. Also the dumpster enclosure cannot be located inside the public sewer easement.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents. Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the development plan. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second(2nd) submittal. A check for the review fee of this submittal in the amount of $100.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

2. Label the existing ADOT right-of-way line. Our records indicate that ADOT's right-of-way at this location is 85 feet from the construction centerline. The construction centerline is 25 feet east of the section line.
3. Clarify the 15 feet future right-of-way notation on the plans. To whom will this future right-of-way be dedicated?
3. The diagonal sawcut line at the south driveway needs to be revised. The sawcut line should go straight across the driveway.

1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is 07/13/10.

2. This project is not a stand alone project and is therefore considered an expansion of the shopping center adjacent to this site. Provide a copy of the last approved development/site plan for the shopping center in order to complete this review.

Provide expansion calculations for the shopping center for lot size expansion, vehicular use area expansion and building area expansion. The expansion calculations are cumulative and must include any previous expansions of the shopping center. If the expansion calculations exceed 25% for any of the three calculations full code compliance will be required for the entire shopping center. Because of the changes being made to the existing shopping center parking, trash enclosure and possible changes made to the Arby's building, outside dining and parking a revised development plan may be required.

Provide in the calculations how this entire site meets the requirements of a shopping center. (greater than 50% of the GFA must be retail use).

Provide a copy of the ingress/egress and parking agreement (general note #13) for review.

3. DS 2-05.2.2.B.2 Case number D09-0027 has been assigned to this development plan (DP). Please place this number in the right corner of all sheets of the development plan, landscape plan, NPPO, and any other associated sheets.
4. DS 2-05.2.2.3 In general note #3 list the proposed use as follows: Food Service "33", subject to: Sec. 3.5.4.6.C.

5. DS 2-05.2.4.D.3 The PAAL and landscape border along the east side of the property is partially located within the future right of way. A future development plan will be required to be provided showing how the site will still meet the code requirements once the widening occurs. See LUC Sec. 2.8.3.5.F. A copy of the required MS&R covenant can be obtained here at DSD. Recording docket and information for the covenant is required to be placed on the future site plan. Another possibility is to design the project to meet future MS&R widening.

6. DS 2-05.2.4.I All applicable building setback lines will be shown. On zoning setbacks, if the building is proposed for location at a greater distance from the property line than the required setback, show only the dimension of the distance between the building and the property line. If the setback's point of measurement is not the property line, include the distance from the property line to the point of measurement (back of future curb).

7. DS 2-05.2.4.K The pedestrian circulation path from the south property line cannot cross through the stacking spaces for the drive through.

Clearly indicate the widths of all sidewalks. Minimum width is four (4) feet. Including at the top of the handicap ramp between the ramp and the building. See DS 2-08.5.1.A.

The type of handicap ramp at the east side of the building does not appear to be correct. See Handicap comments.

8. DS 2-05.2.4.N Provide the dimensions of the proposed structure on the foot print of the building.

9. DS 2-05.2.4.P The parking spaces along the north side of the property will be required to have wheel stops or clearly indicate the required 2'-6" overhang area that will not cross the property line. See DS 3-05.2.3.C.1. If wheel stops are to be used clearly indicate on the development plan all parking spaces using wheel stops.

10. DS 2-05.2.4.R Clearly indicate the location of the future curb and future sight visibility triangles.

11. Provide a elevation detail of the proposed lighting fixtures clearly indicating the required minimum height clearance above the vehicular use areas of 15'.

12. DS 2-05.2.4.V Please indicate the location and type of postal service to assure there are no conflicts with other requirements. If mail is to be delivered to an area within a building please state so on the plan.

13. DS 2-05.2.4.W Indicate the locations and types of proposed signs (wall, freestanding, pedestal) to assure there are no conflicts with other requirements and that minimal locational requirements can be met. Also indicate if there are existing billboards on site. Billboards will be required to meet all LUC requirements as stated in LUC Sec. 3.5.4.26. If none exists please state so.

14) DS Sec.2-05.2.4.X: Clarify general concept how water harvesting is provided in landscaped areas. Revise spot elevations with in parking area to show directed water towards water harvesting areas.
15) DS Sec.2-05.2.4.L: Show dimension for existing sidewalks, or label on keynote 5 sheet 2. Minimum 6-ft wide sidewalk is required for MS&R streets.
16) DS Sec.2-05.2.4.T: Dimensions for proposed refuse collection area appear to be an over sized design for a single unit dumpster. Be advised that the minimum interior dimension for a double dumpster is 20-ft between interior bollards and 10-ft front to rear between gate and rear bollards.
17) DS Sec.3-01.5.3: Show both existing and proposed SVT's. Revise sight visibility triangle locations on Development Plan sheet 2 using the SVT table per this section, using 12-ft setback for sidewalk area.
18) DS Sec.2-05.2.4.R, DS Sec.3-01.5.1.A.1: Other than trees as noted below, plant materials located within existing and future sight visibility triangles shall be limited to ground cover or low-growing vegetation of a species that will not grow higher than thirty inches. Trees may be located within existing and future sight visibility triangles only if clear of leaves and branches to a height of at least six feet above grade upon installation, and at all times thereafter. The trunk caliper of any species selected may not exceed twelve inches in diameter at maturity. Trees with multiple trunks are not allowed. Trees may not be planted in a line that could result in a solid wall effect as viewed from the motorist's perspective. The number and location of trees within existing and future sight visibility triangles may be restricted or modified by the City of Tucson in order to preserve visibility. Show both existing and proposed SVT's on landscape plan, and revise landscape plan sheet to assure that no proposed/existing vegetation obstructs the line of sight.
19) Please acknowledge that a separate grading permit submittal and review for the restaurant will be required for development of the site once the Development Plan is approved. Submittal of the grading plan review package may occur concurrently with the next Development Plan review, for this project.

Resubmittal is required. Submit response letter, copies of the cross access easement documentation, authorization to do offsite improvements, revised landscape sheet, and revised Development Plan. 2. Sheet 3 - Dumpster enclosure, Provide dimensions identifying spacing of bollards. Require 2 ft for front side bollard to front gates/enclosure and 4ft between front side bollard and rear side bollard.
Rear wall bollards should be 4ft on either side of centered bollard. Require a minimum 10 ft x 10 ft clear container service area between the rear and side bollards to the front gates. DS 6-01.4.1.B.
