COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is January 23, 2009.

2. After discussions with Pete Salonga, P.E. it has been determined that due to changes in the proposed uses that will require a change in the parking calculation a re-submittal of the development plan is required.

3. Depending on how the above comments are addressed additional comments may be forth coming.

The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

The Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the development plan as submitted.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

10/16/2008 JOE LINVILLE LANDSCAPE REVIEW Approv-Cond Revise the application to address preservation of the existing barrel cactus near the northern boundary of the site. The proposed retaining wall may impact the survival of these protected plants. We suggest that these be shown on the landscape plan. Assuming the cati can be preserved through the construction process, the current location of the cacti will even be less consistent with the requirement to locate protected native plants in locations able to support their long term health and viability, due to the additional shading created by the retaining wall.

Per Section 5.3.8.2.A, Expiration Dates, of the Land Use Code, "an applicant has one (1) year from the date of application to obtain approval of a development plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A development plan application that has been in review for a period of one (1) year which has not been approved is considered denied. To continue the review of a development plan for the property, a new development plan which complies with regulations in effect at that time must be submitted. The new submittal initiates a new one (1) year review period."
