COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is January 01, 2008.

2. Provide documentation from Tucson Electric Company which states that it is OK to build over the electrical easements. The documentation from Tucson Water Company is unclear. Are you abandoning the easement or are they stating that it is OK to build over the easement. Zoning acknowledges that something was recorded at the Assessors Office under Docket 13022 Page 2420. What was recorded? If this recorded document was the abandonment of the existing water easement recorded under Book 43, Pace 88, then show the abandonment information on the plan. D.S. 2-05.2.3.B There are electrical & water easements shown on the plan which run under structures, i.e. buildings, trash enclosures, These easements need to be relocated or abandoned. Provide documentation showing that these easements have been relocated or abandoned.

3. Provide the DSMR number, date of approval and any conditions of the DSMR on the plan. Zoning acknowledges what appears to be a crosswalk from near the northwest corner of building #7, show this as cross hatch for a crosswalk. This pedestrian access/access route, crosswalk running in front of the trash enclosure and loading zone D.S. 2-08.4.1.F, will require a Development Standard Modification Request (DSMR) which is supportable by zoning. D.S. 2-05.2.4.K The pedestrian access/access route shown at the northwest corner of building #7 provides an unsafe condition and also appears to encroach on the 24' PAAL, relocate.

4. Provide the DSMR number, date of approval and any conditions of the DSMR on the plan. Zoning acknowledges the striped area along the south side of building #10. The pedestrian access, crosswalk running in front of the loading zone D.S. 2-08.4.1.F, will require a DSMR which is supportable by zoning. D.S. 2-05.2.4.K Per D.S. 2-08.4.1.B provide a sidewalk along the south side of building #10.

5. Show the billboard access easement on the plan along with the recordation information. Provide recorded documentation that provides for the cross access across the property lines at the southwest corner of this site. The parcels in questions are 137-33-5730, where the existing billboard is located, and 137-34-0020.

SUMMARY: The revised Development Plan Revision package has been reviewed. It does not appear that comment regarding easement issues was correctly addressed. Please have engineer call to discuss and clarify this comment. Development Services Department Engineering does not recommend approval of the Development Plan at this time. The drainage statement was reviewed for development plan purposes only.

DEVELOPMENT PLAN COMMENT:
1) DS Sec.2-05.2.3.B: Specifically respond to the following easement comments:
a) Proposed or existing utility easements shall not conflict with proposed building footprints. As discussed in prior meeting for this project, should an easement be in conflict with any proposed building location, one of the following must be accomplished specifically for proposed north building 6:
i) change layout for north building 6, or
ii) indicate water easement relocation, or
iii) provide documentation from Utility of no interest, or
iv) provide copy of docket and page of abandonment.
b) Label the recordation information, location, width, and purpose of all easements on site.
c) Blanket easements should be listed in the notes, together with recordation data and their proposed status.
d) Should an easement not be in use and be proposed for vacation or have been abandoned, so indicate.

The drawings for the proposed Development Plan for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.



The Pima County Department of Environmental Quality and the Wastewater Management Department hereby approve the above referenced submittal of the development plan received on March 29, 2007.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval to Construct) may need to be obtained from the Pima County Department of Environmental Quality.

Also, air quality active permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating, or engaging in any activity which may cause or contribute to air pollution.

The above referenced development plan has been CONDITIONALLY APPROVED by the Community Design Review Committee. Once the necessary corrections are made per the on-line comments, please submit the following documents for sign-off.

1 Double Matte right-reading Océ or Photo Mylar of the COMPLETE SET of the Development Plan, Landscape Plan, and the Native Plant Preservation Plan (if part of the original submittal).
AND
1 Double Matte right-reading Océ or Photo Mylar of the Development Plan.

The extra Double Matte right-reading Océ or Photo Mylar that you submit will be delivered to Pima County for permanent recording. Additional blackline copies will be made from the complete mylar set and distributed to various review agencies for their files. These copies will be ordered from the City's contracted print company and billed to you unless you already have an account at another printing company. Please let us know which printing company you would prefer to use and list them on your attached transmittal form when submitting your mylars to the CDRC office for sign-off approval. Your printing company will deliver the mylar and two (2) blackline copies to your office. If you are out of town you will need to contact the printing company for pick up or mailing arrangement options.
