GRADING PLAN:

DS Sec.11-01.2.1: For future reference a revised grading permit will be required for this project due to the new refuse location, bike parking relocation, revised drainage swale, change in scupper size, etc. A grading permit may not be issued prior to development plan approval.

02/25/2010 JOE LINVILLE LANDSCAPE REVIEW Denied 1) The use of Ulmus parviflora to meet the street landscape border requirement is prohibited per LUC 3.7.2.2.A., but they are allowed, if they were "existing" as of the date of the landscape ordinance per LUC 3.7.2.2.C.

The plans approved with C12-83-48 for the streets associated with the Bay Colony Technology Center included landscape easements along Medina Road and Executive Drive and tree plantings including Ulmus parviflora and Fraxinus velutina. It can be presumed that the trees may have been interchanged (Fraxinus was originally proposed along Executive Dr.) during construction. However, the term "existing" as used above connotes "living" trees as of the date of the 1991 landscape ordinance. Therefore, the pre-ordinance and newer Ulmus parviflora along Executive Dr. are allowed to remain, but non-drought tolerant trees planted after 1991 may not be counted to meet the street landscape border requirement. Revise the plans to include additional trees from the ADWR plant list.

2) The preservation requirements of LUC 3.8.6.2.A.3 apply to the Prosopis velutina that appeared on the Native Plant Inventory. Dead or dying plants are to be replaced with the same size plant at a one-to-one (1:1) ratio of like genus and species. Revise the plans to locate any "same size" replacements for the original TOS trees.

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is March 01, 2011.

2. Per DS 2-08, within all development, a continuous pedestrian circulation path is required. The areas within the development which must be connected include, but are not limited to, all buildings, all bicycle and vehicle parking area, all recreation area, all dumpster areas, and all other common use areas. In this case the dumpster location has been redesigned with two separate dumpster locations. The dumpster to the east of the building has not been provided with a pedestrian path (sidewalk). Demonstrate how the pedestrian circulation path (sidewalk) will be extended or provided to the dumpster location along the east side of the building side of the building (next to the property line).
