No permits are to be issued until the plans are in compliance. 1) Revise the development to show the entire existing regulatory floodplain on the development site. DS 2-05.2.3.I Riparian habitat within these floodplain areas may not altered unnecessarily. Per TCC 26-8, the first consideration in approaching alternative drainage design concepts shall be to maintain the natural configuration to reduce exposure to flood and erosion hazards as well as promote groundwater recharge. A mitigation plan for is required with emphasis being placed on earthen or naturally appearing channels for all development in floodplain areas. Provide an inventory and mitigation plan for all disturbed riparian habitat areas in regulatory floodplains. 2) Provide a delineation and area calculation for riparian habitat contained in the floodplains referenced in comment 1. 3) Provide the following information on the riparian mitigation plans: Total Area of Riparian Habitat on site- Total Area Riparian Habitat disturbed- Total Area of Riparian Habitat Mitigation within floodplain Total Area of Riparian Habitat Mitigation in adjacent upland areas- The mitigation area must equal or exceed the disturbance area. 4) The downstream portions of the floodplain should not be disturbed, unless development in those locations is also approved. Where alteration to any portion of the resource area is proposed, the applicant for a development permit is required to demonstrate why the resource area cannot be left in its natural condition. TCC Sec 29.16(a) The explanation of the planning constraints in the Houghton Town Center Resource Report and Mitigation Concept includes the need for anchor tenants in the southern portion of the site. Provide additional information regarding the need to relocate the wash to accomodate these tenants. Labels for Future Improvements 3 & 4 are indicated on the landscape plans, but it is not clear why additional anchor tenants could not be accomodated substantially outside of the floodplain limits. 5) The plans are required to maintain hydrologic function of the constructed natural drainage (including wildlife friendly slopes on both the constructed natural channel and the detention/retention basin). The drainage design will need to be modified such that 10 yr.velocities entering the tobosa habitat areas are no greater than the pre-developed 10-yr velocities in the habitat. 6) The riparian mitigation calculations must be modified for consistency between the Resource Report and the Riparian Mitigation Plans. 7) Clarify on the development plan, landscape plan, native plant preservation and the riparian mitigation plan the phasing proposed for the constructed channel. At minimum mitigation requirements must be met concurrently for each phase of development. 8) Provide a plan for phasing that addresses the occupancy needs of the future tenants. Landscaping is inspected prior to issuance of certificates of occupancy. Landscaping for each phase must be complete prior to occupancy and any safety hazards must be addressed on the site. 9) Revise the Riparian Mitigation plans to include a provision for establishing at least 5000 sq. ft. of tobosa grass by transplanting or or through nursery stock as a demonstration project. Identify the project location on the plans. 10) Resolve the conflict between the proposed trail along Houghton Road and the Qwest easement near the northeast corner of the site. 11) Add any related case numbers, such as the overlay zone and Special Exception to the landscape and native plant preservation plans. DS 2-07.2.1.B 12) The landscape plans include substantial plantings within utility easements along the southern property boundary. Obtain clearances from affect utilities and forward and include copies with the plan resubmittal. Final approval of all plans are impacted by resolution of this issue. Trees and shrubs are to be selected and located so that, at maturity, they do not interfere with existing on-site or off-site utility service lines or utility easements. LUC 3.7.2.6.B 13) Refer to DS 9-06.5.0 for information regarding the requirements for the seeding program. Address irrigation requirements, site preparation, application timing and establishment guarantee. 14) Revise the riparian seed mix to remove Pennisetum cilare (buffel grass). 15) Revise the native plant preservation plan to eliminate removal of native plants from the scenic route buffer area, except areas designated for permitted improvements. LUC 3.7.5.2.D 16) The Office of Conservation and Sustainable Development recommends the following: Protection in the form of a conservation easement, deed restriction, or other permanent mechanism such that it will prevent future development and maintain native vegetation in the natural areas preserved in the western portion of the site. Areas where water harvesting should be conducted should include (but are not limited to) landscape buffers, parking lot tree planting areas, detention/retention areas, road medians and edges, and sidewalk plantings. Landscape plants used in the developed portion of the site should preferentially be native plants, especially those present within the riparian areas of the site.
