The rezoning time extension went before Mayor and Council on November 1, 2005. The existing 26 rezoning conditions remained and rezoning conditions # 27 & 28 were added. Upon staff’s review for compliance on rezoning conditions staff finds the development plan not in compliance with rezoning condition # 15 which reads as following:

Commercial structures, walls, and residential units shall be constructed of building materials that are muted desert colors, or painted muted desert colors which will blend with the local desert environment. Brighter colors shall be limited to accent use.

The proposed building elevations depict external building material to be of sun screen perforated steel sheet – milled finish woven between pipe columns that are painted silver, which then includes aluminum curtain wall. Please revise development plan to be in compliance with rezoning condition # 15.

The Development Plan (DP) cannot be approved as submitted. Please address the following review comments prior to the next submittal.

Development Plan:

1. Please provide North arrow and scale per D.S. 2-02.2.1.
2. Please include a response letter to the comments along with the corrected copies of the DP.
3. This project is subject to overlay zone of the W.A.S.H. Contact Patricia Gehlan at 791-5550 x1179 for details and submittal requirements. Submit the approved W.A.S.H. mitigation plan that was implemented by Harrison Terrace.
4. Label existing and future sight visibility triangles per D.S. 2-02.2.1.10. The SVT at corner of 22nd St. and Harrison shall also be shown. The SVT for the 22nd St. entrance is not shown correctly, the future face of curb location for a 150' ROW is 12' from the property line. Revise as required.
5. Please provide existing topographic contours at intervals not exceeding two (2) feet and/or spot elevations as pertinent and Bench Mark based on City of Tucson Datum, including City Field Book and page number per D.S. 2-02.2.1.23. Correct the Basis of Elevation description and add the elevation and datum.
6. Please show the proposed roof drainage patterns, 100% of the 10-year flow must be conveyed under the sidewalks including any other site drainage as well. Please provide supporting calculations to demonstrate compliance with D.S. 3-01.4.4. If the location(s) of the roof scuppers have not yet been decided, a general note indicating sidewalk scuppers will be used when the roof scuppers locations have been designed and located will suffice. Per the response comment, note 6 does not correspond with roof drainage. Perhaps note 7 is intended to be used, however the number 7 is used at the SE portion of the property. Revise as required.
7. "A grading permit and Stormwater Pollution Prevention Plans (SWPPP's) will be required for this project. Submit 4 sets of grading and SWPPP's with text upon completion and submittal of a grading permit application. A grading permit may not be issued prior to site plan approval. Subsequent comments may be necessary, depending upon the nature and extent of revisions that occur to the plans". The number of grading plans needed to submit is now 4.

COMMENTS: Please attach a response letter with the next submittal, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.


1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is September 7, 2006.

2. The addresses are also required for all the consultants. Please add the addresses to the consultant information under "project directory" on Sheet DP1.0 (DS 2-05.2.2.A.2).

3. Following "Designator '28' " add the phrase "subject to Section 3.5.4.5.A" in "land use" under "project information" on Sheet DP1.0.

4. It appears; from the dimensions provided on the elevation drawings, that the wall heights measured from design grade do not exceed twenty-five feet (25'). Therefore, the required setback for the building is twenty-five feet (25') from the back of the future curb along both Harrison Road and 22nd Street. The twenty-seven feet (27') and the thirty-seven feet four inches (37'-4") appear to be correct for the 22nd Street setback, but thirty-six (36'-0") is not to the edge of the building, nor is it the required setback. The seventy-five feet four inches (75'-4") identified as a maximum setback along 22nd Street makes no sense. Please remove these two dimensions. In addition, please remove the ten foot (10'-0") dimension that is identified as a required setback along Harrison Road. The other setback dimensions along Harrison Road appear to be correct.

5. Please remove the heavy dashed grading limits line from Sheet DP2.0 and place it on the grading plan.

6. Please go through the "descriptive notes." There are several things that do not match up or do not make sense. For example; number 10 points to the bus stop and the trash dumpster, and number 34 point to the southwestern edge of the property and identifies it as a sidewalk. There are more.

7. Please do not use the "net square footage" of the building for any calculation on the site. Please recalculate the FAR and the parking requirements using the square footage from the outside of the building walls.

8. Please revise the parking detail. The wheel stops must two feet six inches (2'-6") from the front of the parking space (DS 3-05.2.3.C.2).

9. The truncated domes are incorrectly located on the handicapped accessible transition ramps for the van accessible parking space. The detectable warning (truncated domes) should be located within six (6") to eight (8") inches of the edge of the nearest curb (ICC/ANSI A117.1-2003 Sec 406.13.2) and be twenty-four inches (24") deep and the full width of the curb or flush surface (ICC/ANSI A117.1-2003 Sec 406.13.1). So, the truncated domes do not go on the sloped portion but rather where the sidewalk begins from the van accessible aisle nest to the parking space.

Item #1 of Tim Rowe’s first development plan review letter dated, November 9, 2005, has not been addressed. Obtain a letter from the PCWMD's Development Services Section, written within the past 90 days, stating that treatment and conveyance system capacity for the project is available in the downstream public sewerage system and provide a copy of that letter to this office. The required form to request such a letter may be found at:

The Keynote #47 (descriptive notes) that appears next to the north cleanout, pointing to what appears to be a wall and having no relationship to the private sewer.

We will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the development plan. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the third (3rd) submittal. A check for the review fee of this submittal in the amount of $78.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.
