12/02/2005 DAN CASTRO ZONING REVIEW Denied COMMENTS

1. General comment: Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is April 26, 2006.

2. Per David Rivera, Principal Planner in the Zoning Review Section, the lot combination covenant does not grant cross access rights. A separate recorded cross access and parking agreement is required for this site. The cross access agreement is required for the subject property and the adjacent property (parcel number 129-08-018A). The response to the previous comment indicates that a copy of the Lot Combination Covenant was submitted to CDRC on September 22, 2005. A copy of this covenant was not found in the CDRC file. Please forward a copy of the Covenant to the CDRC office and a copy with the resubmittal of this plan to the Zoning Review Section.
Previous comment: As a result of the revised parking layout, a vehicular cross parking and access agreement is required for this site. Provide a copy of the agreement for review. The agreement shall then be recorded and a copy of the recorded agreement shall be submitted to the Zoning Review section for our records. A note shall also be added to the drawing listing the cross access and parking agreement along with the docket and page reference. (D.S. 2-05.2.4.A)

3. Response to the previous comment indicates that access from Martin Street will be provided and paving information has been added to the plans. The actual plans submitted do not show the paving information but do show a curb and fence along the property line abutting Martin Street. Please clarify whether or not Martin will be used for access.
Previous comment: Is access proposed from Martin Street? If so, demonstrate maneuverability for a loading zone from Martin Street. In addition, indicate if Martin Street is improved/paved as a note on the drawing.

4. The proposed building area noted under development calculation three (3) on the cover sheet is listed incorrectly as 114,592 S.F. Revise to 14,592 S.F. (D.S. 2-05.2.4.P)

5. Under development calculation three (3) on the cover sheet, revise the number of bicycle parking spaces required to two (2) Class II and list the number and class type provided as two (2) Class II provided. (D.S. 2-05.2.4.Q)

6. Detail one (1) on sheet 2 of 3 shows a curb blocking the access aisle, which is also being used as the accessible pedestrian path to Neff Street. Remove the curb from the detail and the drawing on sheet 3 of 3.
