COMMENTS

1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is December 26, 2004.

2. This development plan has been reviewed by the zoning review section for compliance with the development designator for the proposed restaurant use DD "28", Development Standards Plan Format and Content and Scenic Corridor requirements. Please address the following comments and revise the plans as required and provide all requested documents necessary for the follow-up review.

3. Remove the distance and bearing notes from the location map on sheet 2. I believe these notes were placed in error. Also draw and label the COT and Pima County jurisdiction limits. DS 2-05.2.1.D

4. In the tile block please list the pad or lot number for the proposed development. Add to the title block a brief legal description. DS 2-05.2.1.G. and .2

5. Please revise general note three to state then number of existing lots rather than proposed or remove the note. (I believe that a tentative plat/development plan was approved for the subdivision.)

6. This project has been assigned the development plan case number D04-0035. Please list the case number on all plan sheets including the landscape and NPPO sheets. DS 2-05.2.2.B.2

7. Add a general note that states that this project has been designed to meet the overlay criteria of the Major Streets and Routes Map. DS 2-05.2.2.B.10

8. Under general note one list the gross lot area of lot 2 by square footage and acreage. DS 2-05.2.2.11

9. Remove all zoning classifications labeled B-1 and replace with C-1. DS 2-05.2.4.B

10. Label the PAAL width for the PAALs along the south side of the building and along the east side of the building between the east edge of the drive-through lane and the parking stalls for the OSCO building. The minimum width for two-way traffic is 24 feet.

Draw and label the drive-through window. Also draw, dimension and label the stacking capacity (vehicle spaces) within the drive-through lane. Six spaces each, eighteen feet in length must be provided within the drive-through lane including the one at the window. The drive-through lane must be separated from the PAAL areas, demonstrate compliance. DS 2-05.2.4.D.3 and DS 3-05.2.1.C.2

11. This project is subject the criteria of the Scenic Corridor. One of the criteria that must be met is the building setback from the existing or future street property line. Based on the proposed building height of 30 feet (maximum height allowed for commercial use in the Scenic Corridor) the building setback must 90 feet. Draw and label the building setback from the street property line. Also please draw and label the building setback from the south property line. DS 2-05.2.4.I

12. Onsite pedestrian circulation is required. This project's sidewalk (circulation) must connect to the adjacent developments to the west and east. Demonstrate on the plan how this will be accomplished. Also the proposed location of the access ramp from the drive-through lane must be relocated from this location. The access ramp leads directly into the drive-through lane, which makes it unsafe for the pedestrian and the delivery personnel. Please revise as required. DS 2-05.2.4.K

13. On the footprint drawing list the building square footage, building heights, and building dimensions. DS 2-05.2.4.N

14. Demonstrate maneuverability into and out of the loading area. DS 2-05.2.4.O

15. The overall parking cannot be verified until the parking ratio for the personal services has been revised to correctly list the number of parking spaces required and provided. The parking ratio for personal service is based on one space per 100 square feet of GFA. Revise the parking calculations as required. DS 2-05.2.4.P

16. Draw the location of the bicycle parking spaces for the new restaurant. The number of bicycle parking spaces required is based on the number of parking spaces required or provided for the new use. Show, label and dimension the bicycle parking facility area. Add a separate detail drawing that depicts the specific facility for the new use. Include the bicycle parking in the calculations as required. DS 2-05.2.4.Q

17. Show the location and list the type of refuse container proposed for the new use. DS 2-05.2.4.T

18. Indicate on the plan the location and type of postal service proposed for the new use. DS 2-05.2.4.V

19. Show locations, types, and sizes of all new signs. DS 2-05.2.4.W

20. See Landscape Review comments related to landscaping, screening, and NPPO requirements. DS 2-05.2.4.Z

21. This development is located on street frontage that is designated as a Scenic Corridor. A scenic corridor review and approval is required prior to final approval of the development plan. The previous development plan approval for the OSCO development was reviewed for scenic corridor compliance. Certain variances were requested and approved prior to final approval of the development plan. The variances only applied to the development proposal at the time. This new development must comply with the scenic corridor requirements except for the 30 foot buffer requirement. The requirements that must be met include the following:

a. Building setback is based on a 3:1 ratio. (The minimum building setback required for a 30-foot building is 90 feet from the future property line. Maximum height is 30 feet.)

b. A color and building materials palette that describes the proposed colors and building materials, the manufacturer of each, part number/name of materials and paint.

c. Color renderings (4 sided building elevations) that depict the proposed building, materials and color (paint) lists.

d. Color renderings of the proposed signage with the materials and color (paint) lists.

If the colors and building materials that were approved for the OSCO are used for the new development a new scenic corridor will not be required. As long as compliance for items a - d as noted above can be met. If the new development will not be constructed with the approved building materials or painted with the approved colors a scenic corridor application will be required. Please let me know prior to submittal of the revised development plan of the decision regarding the scenic requirements.

location.

In order to apply for electric service call the New Construction department
at (520) 770-2062. Also, submit a final set of plans including electrical
load and off site improvement plans, to determine how TEP will serve this
commercial development. If easements are required, they will be secured by
separate instrument. Submit your plans a minimum of six (6) weeks prior to
requiring service.

The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


Please be aware that Pima County Development Services Department has a new development plan checklist. This checklist can be found at http://www.pimaxpress.com/SubDivision/Documents/DevPlanReq.PDF for assistance when preparing a development plan.

This project will be tributary to the Ina Road Water Pollution Control Facility via the North Rillito Interceptor. Provide a letter from PCWWM Planning Services, written within the past 90 days, stating that treatment and conveyance system capacity for this project is available. Contact Robert Decker, PCWWM Planning Services, at (520) 740-6625 regarding this matter.

Based on the evaluation of project S99-037, this project would qualify for Non-Participating sewer connection fee rates.

ALL SHEETS. Add the project number, D04-0035, to the title block of each sheet. This number should be shown larger or bolder than any cross-reference numbers.

SHEET 1. Combine General Notes 19 and 20 into one General Note that reads as follows:

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the development plan. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Department of Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.
