A. The responsibility of operating and maintaining a local detention basin rests with the owner of the facility.

That the owner(s) shall have an Arizona registered professional engineer prepare a certified inspection report for the drainage and detention/retention facilities at least once a year, and that these regular inspection reports will be on file with the owner for review by city staff, upon written request; (c.) Tucson Electric Power Company has reviewed and approved the development plan submitted for review June 24, 2004.

Enclosed is a copy of a TEP facility map showing the approximate location of the existing facilities. There are existing underground facilities outside of the project area to the south that my be in conflict with off-site improvements. All cost associated with the relocation of the facilities in conflict will be billable to the developer.

Application for electrical service should be made by contacting the New Construction Department at (520) 770-2062. If easements are required, they will be secured by separate instrument. Two sets of site plans, electrical load plans and off-site improvement plans are required for a preliminary electrical design. These plans should be sent in a minimum of ten (10) weeks prior to requiring service.

1. LUC Section 5.3.8.2 permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for full CDRC review. The one year expiration date for this development plan is June 28, 2005.

2. Place the development plan number (D04-027) on each sheet of the d.p., landscape plan and NPPO plan in the lower right hand corner near the title block. Also, place the SCZ case number (refer to comment 6), on each sheet of the site plan, landscape plan and NPPO plans in the lower right hand corner near the title block. Although this plan was submitted as a development plan, it does not contain many of the elements, calculations, general notes etc. required. Please refer to DS 2-05 for development plan standards.

Conditional approval is granted provided the following conditions are met:

Sabino Creek is a trail route designated by the Eastern Pima County Trail System Master Plan. A public, non-motorized trail corridor shall be dedicated by fee or easement to the City of Tucson for Sabino Creek Trail #45. The trail corridor shall be a minimum of 75 ft in width measured southwest from the top of the bank of Sabino Creek.

The area of the property designated Critical and Sensitive Biological Communities(Shaw, 1986) shall be preserved.

The above conditions are in keeping with the City of Tucson General Plan, Element 14: Environmental Planning and Conservation, Policies 1, 3 and Element 10: Parks Recreation, Open Space and Trails, Policies 8, 9, 10, 11.
