D04-0020

Tucson Electric Power Company (TEP) has reviewed the plans dated May 20, 2004. TEP is unable to approve the plans at this time. There are existing electrical facilities within the boundaries of this project. In order for TEP to approve the plans, the facilities and any easement recording information must be depicted on the plans.

Enclosed is a copy of a TEP facility map showing the approximate location of the existing facilities. The existing poles at the southwest corner of Roger and Fairview appear to be in conflict. All cost associated with the relocation of the facilities in conflict will be billable to the developer.

Please resubmit two revised bluelines to the City of Tucson for TEP's review. You may contact me at (520) 917-8479 if you have any questions.

COMMENTS:

1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development plan. If, at the end of that time, the development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is May 24, 2005.

2. Please relocate the section number labeled 23 to the outside of the map. The number within the map gives the appearance that the map includes coverage of two sections. Also please label the City of Tucson / Pima County corporate limits. DS 2-05.2.1.D

3. This Project has been assigned the Development Plan case number D04-0020. Please list the case number in the lower right corner of all plan sheets including the NPPO and Landscape sheet. Also rezoning condition 9 was listed on sheet one. Please list the condition. DS 2-05.2.2.B.2

4. Please revise general note five (5) stating the use of the property as follows. The use, if strictly storage of vehicles "for the Toyota dealership" should be listed as commercial storage DD "31", Subject to LUC section 3.5.10.1. If the use is something else other what the tile block implies please clarify and adjust all relevant code criteria related to the use. Remove all information from general note five that does not apply to the commercial storage. DS 2-05.2.2.B.3

5. Although general note 15 states that the MS&R setback has been met has been listed the proposed nine foot high walls do not meet the street perimeter setbacks. Both streets are collectors on the MS&R map and therefore the minimum setback is 21 feet from the back of the future curb location. Also it does not appear that the correct cross-section for Fairview. The sidewalk along Fairview appears to be within the Toyota property. If the sidewalk is to remain within the property an easement will be required. It will be necessary to speak with the COT Real Estate Division for more information. Please address the MS&R street cross-section dimensions and location of the required sidewalk and curb. DS 2-05.2.2.B.10 and DS 2-05.2.3.C

6. If applicable all existing or proposed easements must be drawn on the plan. The location, width, purposes, and recordation information must labeled. DS 2-05.2.3.A and DS 2-05.2.4.G

7. It is not clear at this time whether the existing right-of-way will be sufficient for the necessary improvement required by the rezoning condition 3. Please clarify if COT transportation has reviewed the proposal and insures the rezoning condition has been met at least on paper. Please provide some memo or letter from COT transportation. DS 2-05.2.4.E

8. Please insure that the screen walls meet the minimum building setbacks. The nine (9) foot high screen walls must be setback a minimum of 21 feet from the back of future curb locations on Fairview Avenue and Roger Road. The minimum setback along the west and south property lines is based on one and one-half times (13.5') the height of the wall from the property lines. An LDO review and approval will be required if the setbacks cannot be met. Draw and label the setback dimensions from the back of curb on Roger and Fairview to the walls and from the west and south property lines to the walls.

A matrix that is to represent the building setbacks has been drawn on sheet one but does not provide the required or the proposed setbacks. Provide the information proposed or remove the matrix as it does not serve any purpose without the requited information. DS 2-05.2.4.I

9. The parking requirement for the commercial storage is based on the following.

Commercial Storage:
Hazardous Material Storage:

Motor Vehicle: SA. One (1) space per five thousand (5,000) sq. ft. FGA, plus
one (1) space per five thousand (5,000) sq. ft. of outdoor storage area for the first twenty thousand (20,000) sq. ft. of outdoor storage area,
one (1) space per ten thousand (10,000) sq. ft. of
outdoor storage area for over twenty thousand (20,000) sq. ft. of outdoor storage area.

Bicycle: Eight (8) percent - ninety (90) percent Class 1 and ten (10)
percent Class 2.

Based on the gross lot area of 80,496.81 square feet, a total of 10 vehicle-parking spaces are required. These spaces must meet the minimum vehicle-parking space dimensions and the PAALs accessing the spaces must meet the minimum width requirements for two-way traffic where necessary to access the parking spaces. The required parking spaces may not be vehicle storage spaces and should be designated as required parking. Please define on the plan the required spaces and insure that the spaces meet the requirements for vehicle parking space dimensions and that the PAAL used to access the spaces meets the requirements. Revise the parking calculations to correctly state the number of spaces required and number provided for the correct use "Commercial Storage". DS 2-05.2.4.P

In addition two bicycle-parking spaces all class two spaces are required. A class two bicycle parking facility must be drawn on the plan and labeled. A fully dimensioned detail drawing of the facility must be added to the plan. The detail must include the type of facility, manufacturer, surfacing material, lighting, and must be physically separated from the vehicular use area. DS 2-05.2.4.Q

10. No structure or object taller than 30 inches may be placed within a sight visibility triangle. The walls along the Fairview Avenue and Roger Road property lines have been placed in the SVT. Either the right-of-way information on the plan is incorrect or the walls must be relocated outside the triangles. Revise as required. DS 2-5.2.4.R

11. Submit a separate response letter that states specifically how all the rezoning conditions have been or will be met. DS 2-05.2.4.U

12. If applicable indicate the location type and size of any existing or proposed freestanding signage or if applicable existing billboards. DS 2-05.2.4.W

13. See Landscape reviewer comments related to the landscape borders, screening, and NPPO. DS 2-05.2.4.X
