The Zoning Review Section approves the development plan for this project, subject to the following changes on the sign-off copies. However, should there be any changes requested by other CDRC members, the Zoning Review Section approval is void, and we request copies of the revised development plan to verify that those changes do not affect any zoning requirements.

The recordation information (docket and page numbers) for the dedication of right-of-way for both 12th Avenue and Valencia Road must be added to the plan. The docket and page numbers must be listed on the Mylar set of plans, which is to be submitted for City of Tucson approval stamps and signatures. In addition copies of the legal descriptions for the right-of-way dedications must be included along with a copy of any C.O.T. Transportation letter that accepts the dedication.

We have reviewed the above-referenced project on behalf of the Pima County Wastewater Management Department. The following comments are offered for your use:

1. The development plan is hereby approved, subject to the following conditions:

2. The necessary public sewer maintenance vehicle access easement (denoted by Keynote 5 on Sheet 2) must be recorded. Please contact Ms. Janet Russell of the Pima County Real Property Division at 520-740-6563 for information on how to do this.

Note: The legal and graphical descriptions of the necessary public sewer maintenance vehicle access easement have been reviewed and found acceptable as far as content is concerned, but please expect Ms. Russell to request some format changes to these documents, along with a number of other documents.

3. Show the number of wastewater fixture unit equivalents for the Walgreens in a General Note as requested by item 3 of my April 02, 2003 review letter.

4. The recorded documents at Docket 757, Page 142 and Docket 928, Page 262 show 10' public sewer and electrical easements, centered on the easternmost property line. Revise the labels for these easements to read 10' (rather than 5'). Show that they are centered on the property line by revising the label that currently reads 5' SEWER EASEMENT to read just 5'.

05/29/2003 ROGER HOWLETT COT NON-DSD COMMUNITY PLANNING Denied Our review is mixed. These are our three comments and the applicant responses point by point.

1. First staff comment from 5/16/03 - COT Real Estate Division just recently received a written legal agreement from the applicant for a right-of-way dedication agreement. This agreement is under review by the Real Estate Office.

2. Second staff comment from 5/16/03 - the applicant has addressed one of the three issues discussed by staff. The applicant did address, by revising the landscape plan the following issue:

All of the street frontage along 12th Avenue will be landscaped with Phase I. In addition, the proposed interior PAAL which connects through Phase II to Lerdo Rd. will be included with Phase I work and will meet all the requirements of parking, paving, and lighting in the same manner as all other Phase I parking areas.

However, the applicant did not address the following issues (part of staff's comment#2):

A. The applicant did not address how Phase II areas will be screened and buffered from the adjacent neighborhood, during the interim period, prior to the construction of improvements for Phase II areas.

B. The applicant did not address the issue of the Mayor and Council rezoning condition which requires a six foot tall masonry wall with landscaping along the south and east property line. Other than to state this issue needs to be discussed per historical documents (when?). This needs to be resolved prior to the approval of the Development Plan.

3. Staff's 3rd and final comment was not addressed with this resubmittal, which requested in the interim, how Phase II areas will be protected from temporary and unapproved land uses occurring along the arterial streets?
