The above referenced rezoning case is for the establishment of Original City Zone from Pima County SH (County Suburban Homestead Rural Residential Zone), Pima County MU (County Multiple Use), Pima County TR (County Transitional), and Pima County CB-2 (County General Business) to City SH (City Suburban Homestead Rural Residential), City MU (City Mix Use) City O-3 (City Office Use), and City C-2 (City Commercial Use), requested by Mike Czechowski, on behalf of the City of Tucson for annexation. The Original City Zoning site is located surrounding the intersection of Limberlost Drive and Fairview Avenue. The proposed annexation consists of 113 acres and currently developed as a mix of manufactured housing, single-family residential, office, and commercial.

The surrounding zones and land uses are the following; north perimeter of the annexation is County CR-3, (single family residential) developed with single family residential subdivision and City C-2 and C-3, (auto dealerships); east perimeter of the annexation is City R-2, (single family residential and vacant parcel) C-2, (personal self-storage) and C-3 (commercial); south perimeter of the annexation is City MH-2 (mobile home park), and I-1 (single family residential, vacant parcels, automotive services, and radio station); and the west perimeter of the annexation is County MU (single family residential and vacant parcels).

The annexation site is within the boundaries of Plan Tucson (PT), and the Catalina Foothills Subregional Plan (CFSP), which provide land use direction with relevant policies as outlined below:

The request to establish original City zone from Pima County SH (County Suburban Homestead Rural Residential Zone), Pima County MU (County Multiple Use), Pima County TR (County Transitional), and Pima County CB-2 (County General Business) to City SH (City Suburban Homestead Rural Residential), City MU (City Mix Use) City O-3 (City Office Use), and City C-2 (City Commercial Use) is consistent with Plan policy. Plan Tucson Future Growth Scenario Map calls identifies this area as Potential Annexation Areas which are areas that the City of Tucson may be pursuing for annexation within the next decade, working with other local jurisdictions with the ultimate goal of having urban commercial and residential areas located within incorporated cities and towns. The Future Growth Scenario Map should be used as a general guide for determining the general location of development opportunities, development patterns, and land use and transportation concepts, while also considering area and site-specific issues. Plan Tucson supports the pursuit of annexations of vacant, underdeveloped, and developed land that is within both the adopted Water Service Area and the Municipal Planning Area, taking into consideration the development/growth potential, projected revenues to be received and projected costs and capability to serve the area, and the strategic importance of the location.

The Catalina Foothills Subregional Plan (CFSP) does not provide specific land use direction for this annexation as the proposed annexation district is not within a specific map detail.

The annexation site includes a portion of the County Major Streets and Route Map and the City of Tucson Major Streets and Routes Map (MS&R) which acknowledge Wetmore Road as an arterial street and Roger Road as a collector street. Applicable land use Plans include Plan Tucson and the Catalina Foothills Subregional Plan.

The annexation request includes a pre-annexation and development agreement made by and between the City of Tucson and Dobbs Motors of Arizona also known as BMW of Tucson regarding the annexation, and original city zoning of the properties.

This annexation provides an opportunity to add to the City of Tucson, land that will contribute to the City's economic vitality and community character.

The information presented in the annexation agreements reflects the commercial developments will be within the General Business District of the Sign Code, which is correct. It should be noted the City of Tucson conducts annual billing of all properties within city limits displaying signage. The billing amount is a base fee of $14.30 per establishment, plus .13 cents a square foot for each (permanent) sign displayed (for on site signs). (It does not appear there are any off site billboard signs within the proposed annexation area). To evaluate the number of signs and their sizes at each establishment, the City of Tucson will be researching county permit records and possibly conducting surveys of the newly annexed properties to gather information to create new annual sign regulation billing accounts.
