The above referenced rezoning case is for the establishment of Original City Zone from Pima County RH (County Rural Homestead) and County CI-2 (General Industrial) to City RH (City Rural Homestead) and I-2 (Heavy Industrial), requested by Mike Czechowski, on behalf of the City of Tucson for annexation. The proposed annexation district is located southeast of Tucson International Airport, east of South Alvernon and Hughes Access Road. The annexation district encompasses 1,944 acres of vacant, undeveloped land that is owned by the Tucson Airport Authority.

The surrounding zones and land uses are the following; north is County CI-2 , General Industrial; south is County Special Plan (Swan Southlands) and County RH, Rural Homestead; west is County CI-2, General Industrial and County RH (Rural Homestead), City RH (Rural Homestead); and east is County CI-2, General Industrial and County RH (Rural Homestead).

The annexation site is within the boundaries of the Plan Tucson, the Rincon/Southeast Subregional Plan (RSSP), which provide land use direction with relevant policies as outlined below:

The request to establish original City zone from Pima County RH and CI-2 to City of Tucson RH and I-2 is consistent with Plan policy. Plan Tucson Future Growth Scenario Map calls identifies this area as Potential Annexation Areas which are areas that the City of Tucson may be pursuing for annexation within the next decade, working with other local jurisdictions with the ultimate goal of having urban commercial and residential areas located within incorporated cities and towns. The Future Growth Scenario Map should be used as a general guide for determining the general location of development opportunities, development patterns, and land use and transportation concepts, while also considering area and site-specific issues. Plan Tucson supports the pursuit of annexations of vacant, underdeveloped, and developed land that is within both the adopted Water Service Area and the Municipal Planning Area, taking into consideration the development/growth potential, projected revenues to be received and projected costs and capability to serve the area, and the strategic importance of the location. Annexations are to apply Pima County Conservation Land System map and associated guidelines.

The Rincon Southeast Subregional Plan (RSSP) does not provide specific land use direction for this annexation as the proposed annexation district is not within a specific map detail. However the RSSP overall planned land use reflects rural intensity with existing planned communities and high-intensity industrial and park-industrial land uses to respond to existing development patterns around Tucson International Airport.

The annexation site includes several zoning overlays: Airport Environs Overlay, County Major Streets and Route Map and the City of Tucson Major Streets and Routes Map (MS&R) which acknowledge future arterial roadways, Environmental Resource Zones and WASH areas.

The annexation request is part of a larger overall process including a total of four annexation districts, covering approximately 2,419 acres, all owned by either the Tucson Airport Authority or the City of Tucson. This annexation provides an opportunity to add to the City of Tucson, land that will contribute to the City's economic vitality and community character. In addition, Aerospace Parkway (planned arterial roadway connection between Nogales Highway and South Alvernon Way), currently in design by Pima County will increase interest in development opportunities within this area.

SUMMARY: PDSD Engineering has reviewed the application of the proposed Tucson Airport Authority 1 Annexation District and recommends consideration of the following comments for discussion regarding the proposed annexation. The following considerations are based on Tucson Floodplain, Stormwater, and Erosion Hazard Management code, Tucson drainage regulations, ERZ code, previous Annexations (C15-02-02), State regulations including SB1598 & HB2443, and other City of Tucson regulations and ordinances.
1. Tucson Stormwater Management Study (TSMS) provides several components of stormwater management within the City of Tucson area, including emphasis on non-structural stormwater management practices. The City of Tucson’s ERZ codes are intended to minimize flood hazards and assist in providing flood control, erosion mitigation, groundwater recharge, and preserve significant natural riparian areas along the watercourses. For this annexation, areas that have ERZ designation on portions of the watercourse shall be extended through the watercourse within the annexed area. Based on TSMS and ERZ studies and assessments, the annexation map shall be updated to show locations of any ERZ watercourses; Franco Wash and major tributaries, and Hughes Wash and its major tributaries shall be included in the translation map and designated as ERZ watercourses.
2. The southern portion of the proposed annexed area includes the Franco Wash watershed which is located within the Lee Moore Wash Floodplain Management Plan which was adopted by the City of Tucson on October 19, 2010. Development within the Lee Moore Wash area shall meet intent of the study and all guidelines and concepts as adopted for this management plan.
3. Basin Management area regulations shall be consistent with the TSMS plan and adopted detention requirements. Current data indicates the entire proposed annexation area lies within the balanced basin management area.
4. The northern portion of the proposed annex area includes the Hughes Wash Watershed which is currently being restudied by the Regional Flood Control District. Any updated flood data shall be incorporated into determination of floodplain limits and basin management criteria for development within this annexation area.
5. Engineering Technical Manual standards, overlay zones, and City Zoning Maps are extended to the annexed land in accordance with Section 3.4.4, Mayor and Council Special Exception Procedure. Areas where riparian floodplain exist, shall not be disturbed unless the disturbance is necessary for required access, location of utilities that cross perpendicular to flow, or trails/bake paths, and, shall be subject to City of Tucson ERR standards, ERZ codes, or W.A.S.H. Ordinance regulations.
6. Drainage data for determination of the final alignments, floodprone areas, and locations of watercourses shall be referenced by current County and City flood maps and drainage reports, as well as current watershed studies by Pima County Regional Flood Control District, and/or City of Tucson as partner or independently.
7. The FIS and FIRM shall apply to all territory annexed into the city at the time of annexation. With the floodplain administration of additional areas of jurisdiction by an annexation, the annexed area will be governed by the City of Tucson Floodplain regulations. Drainage considerations shall include the submission of the latest revised or updated Master Drainage Report showing detention requirements that meet the intent of the Master Drainage Report with emphasis on detention with positive surface flow gradients, rather than retention systems, in order to accommodate existing soil constraints and groundwater protection in the area.
8. Areas within the annexation map shall be clarified to indicate locations where master drainage reports and their associated revisions or updates are applicable.
9. Areas within the annexation map shall be clarified to indicate locations which may be subject to TIA/TAA agreements (or updated/revised agreements).
10. Any existing intergovernmental agreements related to procedures for floodplain use permitting, should be considered for revision with suitable arrangement between Pima County and the City of Tucson to provide compliance with current state laws and to provide direct and efficient permitting processing.
11. Submission of acceptable soils reports at time of individual development plan or subdivision plat review.
12. Submission of tentative plats prior to submittal of final plats within this area.
13. Submission of acceptable grading plans showing all-weather access to all lots/parcels, at time of individual development plan or subdivision plat review.
