10/08/2025 Zoning Administration Standard REQUIRES RESUBMIT Per the prior Zoning Administrator letter dated September 11, 2017 (case T17SA00367), the dentist office (medical service, outpatient use) at 404 N Alvernon is considered a legal nonconforming use. Substitution with another medical service, outpatient use is permitted. Per UDC 9.2.2 expansions of nonconforming uses may only be approved through a Zoning Examiner Special Exception Procedure if undertaken within five years of the time the use became nonconforming. There is no evidence in this case to support an exception to 9.2.2. A letter cannot be provided at this time.

Considering the proposed expansion of approximately 500 sq ft and building redesign, the appropriate process is a Zoning Examiner Special Exception per Use Table 4.8-2. Compliance with Use Specific Standards 4.9.4.O.2 and 4.9.4.P.1, 2.a., .3, & .4 is required. If standard .2.a cannot be met, per standard .3 a Board of Adjustment Variance Procedure is also required.
