PROJECT DESCRIPTION & LOCATION:
The applicant is requesting feedback on a proposal to rezone their property at 1170 N Pantano Road from C-1 to C-2 to support the expansion of the existing Automotive Service and Repair Use. The current use is an existing non-conforming use as determined by the Zoning Administrator on May 12, 2021. The expansion of a non-conforming use requires full code-compliance and rezoning to C-2.

The project is located in the Mixed-Use Centers building block of Plan Tucson, and the Pantano East Area Plan.

The proposal would remove the car wash from the facility, keeping the two existing garage bays and add an additional multi-bay garage size approximately 8,600 square feet.

Applicable Plan Policies:

Plan Tucson: The Plan Tucson Future Growth Scenario Map illustrates different building blocks within the city that have specific policies to promote future growth opportunities. The proposed development lies within the Mixed-Use Corridors building block of the Plan Tucson Future Growth Scenario Map. This building block features a mix of retail services, housing, and employment centers. Typical housing types include mid- and high-rise multifamily or mixed-use multifamily.

Pantano East Area Plan:
This Plan requires rezonings for commercial use to be based on:
i. The demonstrated need for commercial zoned land in the area;
ii. The site is located on an arterial street;
iii. The proposed use is integrated with other adjacent commercial uses;
iv. The adjacent uses are adequately buffered.

Analysis:
The project conforms to the Plan Tucson Future Growth Scenario Map and with the requirements for commercial rezonings within the Pantano East Area Plan.

The existing land use is an allowed use in the C-2 zone, and a rezoning to C-2 would allow the expansion of that use. The project is located on an arterial street, and the location is adjacent to existing C-1 and C-2 uses located at the corner of Pantano Road and Speedway Boulevard.

The project should demonstrate sensitivity to the adjacent RX-1 zone and low-density land use to the north through adequate buffering, orientation of maintenance bays, landscaping and screening.

A rezoning to C-2 to allow an expansion of the Automotive Minor Service and Repair may be supported depending on design.

A plan amendment is not required to proceed as proposed.

DURING THE DEVELOPMENT PACKAGE REVIEW PROCESS, A FULL REVIEW WILL BE MADE BY THE SITE LANDSCAPE/NPPO REVIEW SECTION TO ENSURE COMPLIANCE WITH THE APPLICABLE CITY OF TUCSON UNIFIED DEVELOPMENT CODE, TECHNICAL STANDARDS MANUAL AND ADMINISTRATIVE MANUAL REQUIREMENTS FOR SITE LANDSCAPE, NATIVE PLANTS AND RAINWATER HARVESTING.

SITE LANDSCAPE/NPPO COMMENTS:

1. The PDP appears to be preserving native vegetation along the north and east project boundaries. If this is not the case, then a Native Plant Preservation Plan (NPPP) or a NPPO Waiver is required per UDC 7.7. See UDC 7.7.3. Applicability; UDC 7.7.4 NPPO General Provisions and Standards; UDC 7.7.4.c. Plan Approval Prior to Permitting; UDC 7.7.4.d. Professional Expertise 7.7.5.c.5; also see AM 2-11.3.0 Permitted Exceptions. If applicable, the Planning and Development Services Department will provide the applicant with the NPPO waiver form upon request.

2. A landscape plan set is required. Preparation of the landscape plans shall adhere to UDC 7.6.4 and Administrative Manual 2-10.

3. ***The PDP indicates that all site landscape requirements for landscape borders and parking lot trees have been established. This site is also subject to the Commercial Rainwater Harvesting Ordinance. See Technical Standards Manual 4-01.3.0 RAINWATER HARVESTING PLAN. A Rainwater Harvesting Plan shall be submitted with all applications for commercial developments at which landscaping is required.

4. A drip irrigation plan and details are required for all proposed landscape planting areas.

COMMENTS:
1. COMMENT: Development is required to comply with Administrative Manual 2-06, Development Package, for the formal submittal. The Development Package should include the entire site, which includes APN 13309060F, 13309060B, and 13309060E (UDC 11.4.20). The UDC defines a site as “the land area consisting of a portion of a lot, an entire lot, or contiguous lots, not including public property, designated for development as a single entity”.

2. COMMENT: The proposed zoning classification is C-2 and the proposed use is Commercial – Automotive Major Service and Repair, which is permitted in C-2 subject to UDC 4.9.13.E (UDC Table 4.8.6).

3. COMMENT: The minimum setback requirement along Pantano is 10’ from the existing or future property line (UDC 6.4.5.C).

4. COMMENT: The minimum setback requirement to the north (non-res use adjacent to res zone) is 1.5 the height of the proposed building wall. The minimum requirement to the east and to the south (non-res use adjacent to non-res zone) is 0’ (UDC Table 6.3-4.A).

5. COMMENT: The maximum permitted height is 40’ (UDC Table 6.3-4.A).

6. COMMENT: The minimum parking requirement for Commercial – Automotive Services Major Service and Repair is 1 space to 300 square feet in gross floor area, and the minimum parking requirement for Commercial – Medical Services, outpatient is 1 space to 200 square feet in gross floor area. Include the parking calculation for the Commercial – Medical Services, Outpatient (Dentist Office) to demonstrate the site has sufficient parking and meets the minimum parking requirement per UDC 7.4.4-1.

7. COMMENT: The minimum bicycle parking requirement for Commercial – Automotive Services Major Service and Repair is 2 short-term spaces and 1 long-term space per 12,000 square feet of gross floor area with a minimum requirement of 2 spaces (UDC Table 7.4.8-1). See UDC 7.4.9 for design criteria.

8. COMMENT: The comments provided are preliminary and are not to be assumed as a complete review of the proposal. During the Development Package review process, a full review will be made by Zoning to assure compliance with the applicable UDC development criteria and Technical Standards.
