Dispensaries are currently allowed in the C-2 Commercial zone subject to a Zoning Examiner Special Exception procedure as indicated by UDC Section 4.8.6 Permitted Uses: Commercial and Mixed-Use Zones.

Use Specific Standards for the existing retail dispensary are subject to UDC Section 4.9.9. E. Marijuana Facility.

Surrounding zoning consists of R-2 to the north, N R-2 to the west, R-2 to the east, and N R-2 to the south. Adjoining land uses are residential. The proposed Drive thru area is located along the westerly and southerly edges of the existing dispensary building which immediately abuts residential zoned land and structures. Entrance to the drive-thru is proposed from E Lee Street and exits to N Park Avenue per the current plan.

Buffering such as block walls and landscaping will be required to be maintained along the easterly, westerly and southerly boundaries to mitigate impacts from the Drive-thru as required by Site Landscape.

According to Traffic Engineering review, adequate Drive-thru stacking is provided on-site. Potential for increased traffic within the existing residential neighborhood is a potential concern and should be further addressed to lessen any impacts as result of the proposed Drive-thru.

To fully comply with Plan Tucson, the design of the proposed development must reflect sensitivity to the surrounding area by complementing adjacent land uses. The use should also enhance the overall function and visual quality of the street, adjacent properties, and the community.

Key comments are as follows:
• Does the drive-thru include menu boards, signs or speaker systems?
• Estimate the average daily trips (ADT) as result of the drive-thru pick-up window.
• See all Review Comments posted within TDC Online including from Site Zoning.

Key steps with the Rezoning include:
1. Prepare a Design Compatibility Report (DCR).
2. Discuss in the DCR: Land Use Compatibility, Design Compatibility, Drainage/ Grading/ Vegetation/Screening, Vehicular Access/Circulation, Traffic (ADT); and,
3. Prepare a Preliminary Development Plan (PDP) – including, but not limited to, calling out parking analysis/spaces, building wall setbacks, and structure heights per the Unified Development Code (UDC).

This plan has been reviewed for compliance with applicable development criteria in the City of Tucson Unified Development Code (UDC) Administrative Manual (AM) Section 2-11 and Technical Manual (TM) Section for landscape, native plants, and water harvesting.

The comments provided are preliminary and are not to be assumed as a complete review of the proposal. During the Development Package review process, a full review will be made by the Site Landscape and NPPO section to ensure compliance with the applicable UDC development criteria and Technical Standards.

SITE LANDSCAPE/NPPO COMMENTS:

1. Per the previously approved development package DP18-0043 it appears that a tree or two have been removed from the required street landscape border along Park, or destroyed by weather. A new tree (suggested in meeting, Blue Palo Verde) for shade and to meet UDC Landscape Border requirments is required. Show the new Blue Palo Verde to the northwest of the dispensary sign along Park near the ROW line on the updated PDP along with language that this new tree will bring the canopy tree requirement back to what was required on the orignial approved DP and that the canopy tree will help decrease heat island effect on site.

2. No other comments or concerns with the addition of a pick-up window at this dispensary location.

COMMENTS:

1. The Preliminary Development Plan (PDP) must be consistent with the Development Package (AM 2-06). The proposed development must comply with the City of Tucson Unified Development Code (UDC) Administrative Manual Chapter 2-06 – Development Package. Building permits can be submitted and reviewed concurrently with the development package but the building plans cannot be approved until the development package is approved and the building plans are reviewed for consistency.

2. Proposed use and use specific standards: Marijuana Facility – Dispensary with a drive thru is an allowed use through the Special Exception Procedure with adherence to the following use specific standard: 4.9.9.E.1 and the following:
[1]: Mayor and Council Special Exception Procedure UDC 3.4.4

3. If the existing floor plan changes due to the proposed drive thru lane, please adhere to the requirements of UDC 4.9.9.E.1.D “a marijuana dispensary shall have an interior customer waiting area equal to a minimum of 25% of the sales floor area”. A detailed floor plan will be required with your development package to ensure compliance.

4. Drive Thru must adhere to the minimum height clearance: UDC 7.4.6.E.2 “The minimum height clearance along access lanes and PAAL’s is 15.”

5. UDC 7.4.6.F.2.a: Access lanes and PAAL’s must be setback at least one foot from:
(1). An open structure, such as a carport or covered pedestrian access path as measured from the closest part of the structure or roof overhang; or,
(2). A structure when the access lane or PAAL serves as a drive thru lane.
b. Access lanes and PAAL’s must be setback at least two feet from a wall, screen, or other obstruction over six inches. The additional area is necessary to provide clearance for fire, sanitation, and delivery vehicles.
