Site Engineering Review Comments:

To be completed in conjunction with new proposed project:
1. Existing permits must be withdrawn: DP12-0093 and T16CM02218. Please contact Sonya Bermudez, reference this Pre-App (TP-PRE-0726-00158) and the above listed permits to assist with withdrawing permits.
2. The option to seek CLOMR/LOMR was discussed with Stephen Blood on 8/5/2026. The following comments will be how to accomplish that process, and what will be required for submission in the subsequent permits.
3. FOR REFERENCE BODY OF EMAIL 8/4/2026: I wanted to discuss the Sonoran Equestrian Center proposal before our Pre-App Conference on Thursday at 3 PM. The Site Engineering Team discussed that the fact that Tanque Verde Creek is an ERZ Wash; per UDC 5.7.3.A and TSM 4-02.2.5 there are limited options for encroachment in the 100-yr floodplain. It should be noted that the entire parcel is within FEMA AE 100-yr floodplain, therefore subject to these sections of code and limited to encroachment by means of utilities, roadway improvements, walkways, or bike paths. It is also important to note that standard grading or site development activities do not qualify as permitted encroachment uses.

CLOMR/LOMR Application Process:
4. Begin the CLOMR application process by applying for a Floodplain Use (FPU) Permit on TDC-Online.tucsonaz.gov. Include in the description: CLOMR/LOMR application for 11450005B; REF: TP-PRE-0726-00158.
5. Complete the FEMA CLOMR form include all required docs to FPU permit application. The Floodplain Administration and City Engineer will review and sign the packet before sending application to FEMA.
6. As an added note: hydrology studies must include Tanque Verde Creek, nearby tributaries into the Tanque Verde AND Unnamed Washes that are located on the property.
7. CLOMR/LOMR process requires FEMA’s approval of the proposed project, it would be built as the approved design and result in a map revision. LOMR will be reflected after a project is completed to reflect as-built conditions and changes flood zones, elevations or floodway boundary. While CLOMR review is conducted by Floodplain Administration, final approval is required by FEMA. (The results of the CLOMR may maintain floodplain boundaries within the parcel, and could result in ERZ requirements and/or additional floodplain use permits.)

Submission Requirements with Development Package:
8. The Hydrology Study submitted for the CLOMR.
9. Geotechnical Investigation Report - prepared by a Registered Professional Engineer licensed in the State of Arizona is required [IBC 1803]. The report shall be submitted with the development package submission. The report shall, at minimum, address the following:
a. Soil Bearing Capacity & Site Classification – Including soil bearing capacity, site classification, expansive soil identification, and groundwater conditions, with all applicable foundation design recommendations for the proposed construction.
b. Grading & Earthwork – The report shall provide recommendations for site preparation, fill compaction standards, and the suitability of on-site materials for reuse as engineered fill.
c. Pavement Design – The report shall include pavement design recommendations for all proposed drive aisles, parking areas, and access improvements, including R-value or CBR testing results as applicable.
d. Retaining Walls – Where retaining walls are proposed, the report shall address lateral earth pressures, backfill requirements, and wall foundation recommendations. (IF applicable)
10. A Stormwater Pollution Prevention Plan (SWPPP) is required for any construction activity disturbing one (1) or more acres of land, in accordance with the AZPDES Construction General Permit (CGP No. AZG2025-001) issued by the Arizona Department of Environmental Quality (ADEQ). The SWPPP must be site-specific and prepared prior to submitting a Notice of Intent (NOI) via ADEQ's myDEQ portal. A Dust Control Permit issued by the Pima County Department of Environmental Quality (PDEQ) is also required prior to ground disturbance of one (1) or more acres. Contact PDEQ at (520) 724-7400 for permit requirements.

Details needed on Site Plan with Development Package submission:
11. Vehicular use area requires approved material or stabilized with a grid system (must include technical specification sheet for review and approval). UDC 7.4.6.I.2
12. Pedestrian circulation is required to connect all buildings, dumpster areas, common areas, and the sidewalk on all the street frontages per TSM 7-01.3.3. Exterior accessible route to be in accordance with 2017 ICC A117.1 Sections 402 and 403, and TSM 7-01.4

18. Any additional floodplain use permits will be dependent of results of approved CLOMR by FEMA.
19. Final steps will require submission of required materials and application of LOMR to FEMA.

3. Parking lot canopy trees are required at 1 tree for every 4 parking spaces provided, see UDC 7.6.4.B. Structurally covered parking spaces do not count toward the ratio, see UDC 7.6.4.B.1.c (8). Trees are to be distributed evenly throughout the parking area, see UDC 7.6.4.1.a.(1). See Technical Standards Manual 5-01.3.0 for additional landscaping in vehicular use area requirements.

4. Interior landscape borders per UDC 7.6.4.C.3 and Table 7.6.4-1 and proposed Commercial Land Use:
A. An interior landscape border is required on commercial land use sites adjacent to residence zones. This is the case at the east and south property line of this proposal and is stating compliance on the preliminary plan. This border will require trees and a 5’ wall at the property line.

5. DTM review is required for all planting and irrigation in the ROW prior to the approval of the development package. Reach out to David Marhefka (david.marhefka@tucsonaz.gov) for review and approval if applicable for this project.

6. A drip irrigation plan and details are required for all proposed landscape planting areas.

7. All landscape plans shall incorporate water conserving design as defined in UDC Section 7.6.6, Use of Water, and as described in the Technical Standards Manual 5.01-5.11.

8. A Commercial Rainwater Harvesting plan is required: See Technical Standards Manual 4-01.3.0 RAINWATER HARVESTING PLAN. A Rainwater Harvesting Plan shall be submitted with all applications for commercial developments at which landscaping is required. The Rainwater Harvesting Plan shall consist of two elements: a Site Water Budget and a Water Harvesting Implementation Plan. Preparation of the Rainwater Harvesting Plan elements requires coordination between project managers, site engineers and landscape architects from the inception of the project. The two elements of the Rainwater Harvesting Plan shall illustrate water harvesting how will meet 50% of annual landscape water demand, as required by the ordinance.

9. Coordinate the Landscape Plan, Commercial Rainwater Harvesting Plan and the Civil Grading Plans to have identical basin size, grades/percent slopes, spot elevations and curb cut inlet and outlet locations.

10. Maximize rainwater harvesting across the site into all landscape areas, including the street landscape borders and planting islands for the required trees in the parking area.

11. A separate irrigation water meter is required. Please label irrigation meter as “irrigation only”. See TSM 4-01.6.0. Or see City of Tucson Ordinance 10597 -- Sec. 6-182. Rainwater Harvesting Plan: Number 3 (a) A separate water meter connected to the main water supply; or (b) An irrigation sub-meter.
ARTERIAL SCENIC Street landscape borders: ARTERIAL SCENIC - UDC 5.3.4. SCENIC ROUTE BUFFER AREA

(HIGHLIGHTED REQUIREMENTS ARE REPRESENTED IN ALL CAPS BELOW). THE SUBMITTED SITE PLAN INDICATES THAT THE SCENIC ROUTE BUFFER AREAS ARE ACCOUNTED FOR.

REQUIREMENTS:

1. A BUFFER AREA 30 FEET WIDE, ADJACENT TO THE MS&R FUTURE RIGHT-OF-WAY LINE, IS REQUIRED AND SHALL BE PRESERVED AND MAINTAINED IN ITS NATURAL STATE.

2. NO DEVELOPMENT OR IMPROVEMENTS SHALL OCCUR IN A SCENIC ROUTE BUFFER AREA EXCEPT AS PROVIDED IN SECTION 5.3.4.C, PERMITTED IMPROVEMENTS; (SEE FIGURE 5.3-B.).

3. THE BUFFER AREA SHALL BE RESTORED AS CLOSELY TO ITS NATURAL STATE AS POSSIBLE IN AREAS WHERE PUBLIC SAFETY OR THE DELIVERY OF PUBLIC SERVICES PRECLUDES PRESERVATION OF EXISTING VEGETATION.

4. THE BUFFER AREA IS IN LIEU OF THE LANDSCAPE BORDER REQUIRED ALONG STREET FRONTAGES UNDER SECTION 7.6, LANDSCAPING AND SCREENING STANDARDS. FIGURE 5.3-B: PRESERVATION AND REESTABLISHMENT OF VEGETATION ADJACENT TO SCENIC ROUTE.

5. MEASUREMENT OF THE SCENIC ROUTES BUFFER AREA: The Scenic Routes buffer area is measured from the future MS&R right-of-way, except as follows-

EXCEPTION: WHERE THE MS&R ROADWAY DESIGN INCLUDES INSTALLATION OF A SIDEWALK, PEDESTRIAN WAY, OR BIKE PATH, THE BUFFER MAY BE MEASURED FROM THE MS&R PROJECTED BACK OF THE SIDEWALK, pedestrian way, or bike path if the buffer does not encroach more than ten feet into the future MS&R right-of-way with the written permission of the City of Tucson Department of Transportation. The use of the MS&R right-of-way is permitted only if the area can be landscaped.

*THE FOLLOWING IMPROVEMENTS ARE PERMITTED IN THE SCENIC ROUTE BUFFER AREA:

6. PERMITTED IMPROVEMENTS:

A. DRIVEWAYS OR ACCESS LANES, IF THEIR AREA DOES NOT EXCEED 20% OF THE SCENIC ROUTES BUFFER AREA (BUFFER AREA). IN THIS INSTANCE, THE WIDTH OF THE BUFFER AREA IS 30 FEET IN ACCORDANCE WITH SECTION 5.3.4.A.1. For the purposes here, the Buffer Area is calculated as follows: Multiply the distance of the property’s frontage along the Scenic Route measured at the MS&R right-of-way line by 30 feet. If, due to topographical or engineering constraints, the driveway or access lane exceeds 20% of the Buffer Area, the width of the Buffer Area shall be increased to accommodate the square footage resulting from the following calculation: (Distance of the frontage along the Scenic Route measured at the MS&R right-of-way line - total width of driveways or access lanes) x 24 feet = Required Buffer Area in square feet. Specific sign types may also be placed in the Scenic Routes buffer area in accordance with Article 7A.11.3 Scenic Corridor Zone (SCZ) District.

B. TRENCHING FOR THE PLACEMENT OF UTILITY LINES, IF THE AREA IS REVEGETATED IN ACCORDANCE WITH SECTION 5.3.4.D, REVEGETATION OF SITE.

C. AN AREA NOT LARGER THAN 18 SQUARE FEET AND NOT EXCEEDING 30 INCHES IN HEIGHT PER LOT OR PARCEL FOR THE PLACEMENT OF UTILITY TRANSFORMERS, PEDESTALS, AND SERVICE METERS AND HOOKUPS FOR UTILITIES.

D. SELECTED VEGETATION MAY BE REMOVED WHEN THE DEPARTMENT OF TRANSPORTATION DETERMINES THAT REMOVAL IS NECESSARY FOR PUBLIC SAFETY IF THE REMOVED PLANTS ARE REPLACED WITH NATIVE VEGETATION.

E. REVEGETATION OF SITE: ANY PORTION OF THE SCENIC ROUTE BUFFER AREA AND THE MS&R RIGHT-OF-WAY DISTURBED BY DEVELOPMENT ACTIVITY SHALL BE REVEGETATED WITH NATIVE VEGETATION.

F. WITHIN THE SCZ, EXCLUDING THE SCENIC ROUTES BUFFER AREA, ALL DISTURBED AREAS ON THE SITE THAT ARE VISIBLE FROM THE SCENIC ROUTE AND ARE NOT COVERED BY PERMANENT IMPROVEMENTS SHALL BE REVEGETATED WITH NATIVE PLANTS, PLANTS FROM THE DROUGHT TOLERANT PLANT LIST, OR A COMBINATION OF BOTH.

G. IN AREAS NOT VISIBLE FROM THE SCENIC CORRIDOR ZONE, VEGETATION MAY CONSIST OF NATIVE PLANTS INDIGENOUS TO THE SITE OR DROUGHT TOLERANT PLANT MATERIAL. OASIS AREA LANDSCAPING MATERIAL MAY ALSO BE PLANTED WITHIN THIS AREA AT THE LEVELS PERMITTED BY THE LANDSCAPING ORDINANCE.

COMMENTS:

1. Development must comply with Administrative Manual Section 2-06, Development Package. The Development Package is a separate submittal from the building permits, and the building permits cannot be approved until the Development Package is approved. (Administrative Manual Section 2-06)

2. The property is zoned SR. Animal Production, limited to Commercial Stable, is permitted in the SR zone, subject to UDC Sections 4.9.2.A.1.b and 4.9.2.A.2.b. (UDC Table 4.8-1 and UDC Sections 4.9.2.A.1.b and 4.9.2.A.2.b)

3. A prior variance, C10-13-13, approved the reduction of the minimum lot size requirement for a commercial stable from 10 acres to approximately 9.2 acres

4. Based on the prior variance approval, C10-13-13, the following setbacks apply:

a. Front street setback along Tanque Verde Road: 30’

b. Front street setback along Woodland Road: 20’

c. Existing stable, Building One: 64 feet from the west property line.

d. Existing corrals: 0 feet from the west property line.

e. Existing training arena and horse pens: 0 feet from the southwest lot line along Tanque Verde Road.

f. f. New stables, barns, and animal sheds or shelters not covered by C10-13-13 must be set back 100 feet from any property line.


5. The submitted plan notes that the western perimeter yard setback is not required per UDC Section 6.4.5.D.4.a.1. However, the adjacent property is zoned SR, which is not a nonresidential zone; therefore, this section does not appear applicable. The required perimeter yard must be shown unless another applicable code section, prior variance approval, or modification applies. (UDC Section 6.4.5.D.4.a.1)

6. The site is located within the Scenic Corridor Overlay Zone along Tanque Verde Road. A 30-foot scenic route buffer is required adjacent to the MS&R future right-of-way line and must be preserved and maintained in its natural state, except as allowed by the UDC. Clearly show the scenic buffer, future right-of-way line, and any proposed encroachments such as driveways or utilities. (UDC Section 5.3.4)


7. Building and structure surfaces visible from the Scenic Route must use colors that are predominant within the surrounding landscape, such as desert and earth tones. Include proposed colors and materials for all visible structures with the Development Package.

8. Comply with Technical Standards Manual Section 7-01, Pedestrian Access, for any required pedestrian circulation associated with the proposed development. (Technical Standards Manual Section 7-01)
