Analysis: The Utilities Distribution Use in the R-1 zone requires a Zoning Examiner Special Exception procedure. In similar cases, a City Manager’s Office waiver was granted providing relief from this special exception and certain use-specific standards for city-owned infrastructure. This proposal meets the criteria for seeking relief through that waiver process. The request should be submitted prior to permitting, and the Development Package application for the well site should include the signed waiver as an attachment. A plan amendment is not required. Comment: The Preliminary Development Package (DP) reference must significantly correspond with the DP when you are formally ready to submit with Administrative Manual 2-03.3.0. 2. Comment: The proposed development must comply with the City of Tucson Unified Development Code (UDC) Administrative Manual Chapter 2-06 – Development Package. Building permits can be submitted and reviewed concurrently with the development package but the building plans cannot be approved until the development package is approved and the building plans are reviewed for consistency. 3. Comment: Distribution system use is allowed in the R-1 zone and must comply with use specific standards 4.9.11.A.1, .2, .5, .8, .9, .11, .12 and Zoning Examiner Special Exception Procedure. 4.9.11.A.1 - The setback of the facility, including walls or equipment, shall be 20 feet from any adjacent residential zone. 4.9.11.A.9 - The use shall be located wholly within an enclosed building or within an area enclosed on all sides with a masonry wall or compact evergreen hedge, not less than six feet, nor more than ten feet, in height. 4.9.11.A.12 - The following requires approval in accordance with Section 3.3.4, 100' Notice Procedure. The PDSD Director may forward the request to the Design Review Board (DRB) for design review and recommendation. a. Water pumping and storage facility upgrades or expansions, provided: (1) Existing setbacks are not altered. (2) Use Specific Standards 4.9.11.A.5, .9, .11, are met. 4. Comment: Setbacks for a nonresidential use adjacent to a non/residential zone is 10 feet or ¾(H) the height of the wall to the south property line. UDC TABLE 6.3-4.A. 5. Comment: Per UDC 6.4.5.C.2.b., for nonresidential use abutting a Local Street: the minimum required street perimeter yard is 20 feet, as measured from the street property line. 6. Comment: Ensure compliance with Table 7.4.4-1: Minimum Number of Motor Vehicle Spaces Required for the Utilities Use Group. • 1 space per 500 sq. ft. GFA, with a minimum of 2 spaces per facility 7.
