Key steps with the Special Exception include:
1. Prepare a Design Compatibility Report (DCR).
2. Discuss in the DCR: Land Use Compatibility, Design Compatibility, Drainage/ Grading/ Vegetation/Screening, Vehicular Access/Circulation, and Geotechnical Analysis; and,
3. Prepare a Preliminary Development Plan (PDP) – including, but not limited to, calling out parking analysis/spaces, equipment setbacks, and structure heights per the Unified Development Code (UDC).


Special Exception process:
1. Hold a Neighborhood Meeting as outlined in Section 3.2.2. of the Unified Development Code. For Special Exception applications, a single neighborhood meeting shall be held. The mailed notice must be mailed at least ten (10) days prior to the date of the meeting and sent by first class mail to property owners within 400 feet of the property, registered neighborhood associations within one (1) mile of proposal, and the Council Ward offices where the project is located. In addition, the following applies:
a. The meeting shall take place not more than 60 days prior to the date of the submittal of the application.
b. Documentation of the offer to meet and a summary of the meeting must be submitted with the application.
c. The meeting must be held at or near the subject site.
d. Mailing labels for neighborhood notice will need to be acquired from PDSD.
e. Please reach out to Ward 1 Office before the neighborhood meeting.

2. Project shall be scheduled for a Zoning Examiner (ZE) Public Hearing as outlined in UDC section 3.4.3.

ROW Engineering Review * REVIEW COMPLETED Swan Rd is an Arterial roadway per Major Streets and Routes (MS&R) Map. Access should follow COT Access Managment Guidelines.
ROW improvements will need to follow COT Standards or PAG Standards and street design guide.
New utilitys constructed in the public ROW should follow COT Public Administrative Manual.
Drainage improvements will require COT Floodplain Administration approval.

COMMENTS:
1. COMMENT: A Development Package that complies with Administrative Manual 2-06 will be required for formal submittal. Two development packages will be required for this proposal for either side of S Swan Rd.

2. COMMENT: Parcels located in Unincorporated Pima County will apply for permits through Pima County Development Services and comply with Pima County Zoning Code.

3. COMMENT: The site is zoned RH and the proposed use is Utilities – Renewable Energy Generation which is permitted through Zoning Examiner Special Exception Procedure subject to use specific standards 4.9.11.B.2, .3, .4, & .5 and 4.9.13.I (UDC Table 4.8-1).
4.9.11.B.2 – the setback of the facility, including walls or equipment, shall be 20 feet from any adjacent residential zone.
4.9.11.B.5 – In addition to the requirements of Section 7.6, Landscape and Screening, there shall be a decorative masonry wall at least six feet in height between the project site and any residential zone.

4. COMMENT: A lot combination or a Covenant for Use and Development of Real Property will be required.

5. COMMENT: Per UDC Table 6.3-1.B – Exceptions to the RH Dimensional Standards, the maximum height permitted is 16’.

6. COMMENT: Per UDC 6.4.5.C, for nonresidential uses abutting an arterial or collector street the minimum required street perimeter yard setback is ten feet measured from the existing or future property line.

7. COMMENT: Per UDC 6.4.5.D.4, with the Zoning Administrator approval, a project’s perimeter yard may be modified to equal nonresidential use to nonresidential zone perimeter yard requirements for governmental uses; therefore, the setback to the east is 0’.

8. COMMENT: The minimum parking requirement for utility uses is 1 space per 500 square feet of gross floor area with a minimum requirement of 2 spaces (UDC Table 7.4.4-1).

TW New Area Development * REVIEW COMPLETED Based on the information currently available, Tucson Water does not have water service to the planned parcels
The parcels are located in the Tucson Water service area, but there are no existing or planned water mains connecting this area to the Tucson water distribution system. Our one water 2100 plan includes a proposed path to serve the zone, but it requires a new reservoir, booster and up to 10 miles of new transmission main.
