COMMENTS:
1. COMMENT: The site is zoned R-1 and the proposed use is Residential – Residential Care Facility, which is permitted for up to 10 residents subject to use specific standards UDC 4.9.7.J. 2.a, 3.a, 4 (UDC Table 4.8.4).

2. COMMENT: Unlimited residents is permitted in R-1 through Zoning Examiner Special Exception Procedure subject to use specific standards 4.9.7.J.2.a, 3.d, .4, .8 (UDC Table 4.8.4). It does not appear the site meets applicable use specific standard UDC 4.9.7.J.8, minimum lot size requirement.

Per UDC 4.9.7.J.8, The maximum permitted lot coverage is 60%. The minimum required setback from all interior lot lines adjoining residential zoning is 20 feet. The minimum required lot size is one and one-half acres, with the following exception. Exception: There is no minimum lot size requirement for Residential Care Services use in the R-3, C-1, C-2, C-3, OCR-1, and OCR-2 zones.

3. COMMENT: Even though underlying R-1 zoning may allow a Residential Care Service with up to 10 residents in most areas of the City, this property is also covered by an Airport Environs Zone (AEZ) Approach Departure Corridor-1 (ADC-1), which per UDC 5.6.8.A.2.e., prohibits all uses within the the Residential Use Group, including all Residential Care Services.

As such, because of the ADC-1, no Residential Care Services are permitted at this site.

3. COMMENT: The comments provided are preliminary and are not to be assumed as a complete review of the proposal. During the Development Package review process, a full review will be made by Zoning to assure compliance with the applicable UDC development criteria and Technical Standards.

Please note that there’s a designated 10-foot utility easement located on the north side of the parcel. This easement is reserved for utility and/or access purposes as recorded in the property documentation.
The building currently has (1) existing domestic water meter size (3/4”). This service is connected to the 6-inch CA water main (B Zone) located within the south side of the parcel right-of-way of E 28th St.
