Oracle Road. According to the floorplan submitted by the applicant, the existing dispensary is located in an approximately 1,705 square-foot suite. The proposed expansion would add an additional 1,705 square feet (SF), for a total area of 3,410 SF. This expansion would also reconfigure the entire space to include a larger waiting room and sales space. The transmittal email from the applicant states that the proposed expansion would increase the total size of the dispensary to 7,000 SF. The total size of the expansion must be clarified. The proposed expanded dispensary is below the 10,000 SF maximum regardless. The site is on the west side of n. Oracle Road approximately 530 feet south of the interchange of W. Auto Mall Drive and N Oracle Road. The proposed development lies within the Mixed-Use Centers building block of the Future Growth Scenario Map. These areas combine a variety of housing options, retail, services, office, and public gathering places, located close to each other, providing occupants of the center and the residents and workers in the surrounding neighborhoods with local access to goods and services. Public transit, bicycles, and walking will get priority in these areas although cars will still play an important role. Existing examples in Tucson include Williams Centre, Gateway Centre, and the Bridges. Surrounding Zoning and Land Uses: North: C-3 – Auto Dealership and Gym East: C-3 – Call Center and Office South: C-3 – Personal Storage and Moving Truck Rental West: C-3 – Auto Dealership Analysis: The applicant proposes expanding an existing marijuana dispensary into a vacant adjoining suite in the existing strip mall, doubling the size of the current dispensary. The proposed expanded dispensary would be below the 10,000 – sf maximum permitted by the Unified Development Code. A marijuana dispensary requires a Mayor and Council Special Exception, and must meet all use-specific standards in UDC 4.9.9.E for Marijuana Dispensary: 1.a – The total maximum floor area shall not exceed 10,000 feet. It appears the project will contain less than 10,000 square feet of floor area. 1.c – The permitted hours of operation of a marijuana dispensary are from 7:00am to 10:00pm. The project shall only operate only during permitted hours. 1.d – A marijuana dispensary shall have an interior customer waiting area equal to a minimum of 25% of the sales floor area. The waiting area must be in conformance with size requirements. 1.e – A marijuana dispensary shall not have outdoor seating areas. Compliance must be demonstrated on Preliminary Development Plan. 1.g – A marijuana dispensary shall be setback a minimum of 2,000 feet from any other marijuana dispensaries. The nearest dispensary appears to be over 2,000 feet away from the subject parcel. 1.h – A marijuana dispensary shall be setback a minimum of 500 feet from a K-12 public, private, or charter school or a licensed childcare center. The project appears to be in compliance with this requirement. 1.i – A marijuana dispensary shall be setback a minimum of 500 feet from a public park, and a minimum of 500 feet from a licensed residential substance abuse diagnostic and treatment facility or other licensed residential drug or alcohol rehabilitation facility. The project appears to be in compliance with this requirement. 1.j – Odor mitigation devices and techniques are required. This requirement must be met. A cursory GIS review was performed by staff, and the proposal appears to meet marijuana dispensary use-specific standards at the time of review. Your neighborhood meeting materials, and special exception application materials must explicitly demonstrate how compliance with each standard in UDC 4.9.9.E is met. Based on compliance with Plan Tucson, a plan amendment is not required. ***ADDED 1-30-2025*** After consulting the zoning team and administrator, the dispensary expansion will require a Mayor and Council Special Exception.
