COMMENTS:
1. Development must comply with the Administrative Manual Section 2-06 - Development Package for the Multi-family lot.
2. Residential-Single-Family, detached uses are allowed in the R-1 Zone, with the following use-specific standards: For 1 unit, 4.9.7.B.5 - 9; for 2 units (min. 10,000 sf lot size required), 4.9.7.B.1 - .9, & .11
3. Residential-Multi Family Development is allowed in the R-3 Zone, with the following use-specific standards: 4.9.7.B.6
4. The minimum lot size in the R-1 zone for two units is 10,000 square feet.
a. The minimum lot size for one unit in the R-1 zone is 7,000 square feet. The proposed lot on 5200 E 21st street meets the minimum requirements for one unit; however, the ADU ordinance can allow for a second unit, limited to 10% of the lot size.
b. There is no minimum lot size for a multi-family residential project in the R-3 Zone.
5. A multi-family development in the R-3 zone can have 36 Units per Acre. (6.3-2.A UDC). With a 38,247 Sq. ft. lot, the site can support the 9 proposed units.
6. Parking requirements can be found on (Table 7.4.4-1 UDC)
7. Residential uses adjacent to residential zones have a 6’ or 2/3 (H) setback requirement on interior lots. Residential uses adjacent to non-residential zones have a 10’ or ¾ (H) setback requirement. For the multifamily portion of the development, non-residential uses have a 10’ or ¾ (H) setback requirement when adjacent to residential and non-residential uses.
8. Street setback requirements are found in 6.4.5.C-1 of the UDC, and will be applied to all street frontage.
a. The Street setbacks on 21st street will have a minimum setback requirement of 20’ from the property line.
b. For the north half of the proposed split at 5220 E 21st, the setback will be measured from 21st street, and Magnolia Street. The setback from 21st street will have a setback requirement of 20’, as measured from the property line. Because Magnolia Street is perpendicular to a Major Street, it will be subject to Major Street and Route setback requirements based on the Average Daily Traffic (ADT), as shown in article 6.4.5.C-1. The ADT of this area will necessitate a 21’ setback as measured from the outside edge of the nearest adjacent travel lane. Please speak with the Department of Transportation and Mobility to see if street parking is allowable along Magnolia street so zoning can determine where the setback line will be measured to. 9. There is no measurable street setback for the parcel at 5110 E 21st street. Access to a street will be required through an easement. Please speak with Tucson Water about access to this parcel.
10. The height maximum for a Single-Family use in the R-1 zone is 25’.
a. The height maximum for a multi-family use in the R-3 zone is 40’.
11. Staff recommend a records request on these properties to determine if there are any subdivision notes that limit development of the property on 5110 E 21st.
12. It appears that the property at 5220 E 21st is eligible for a lot split, per the UDC definition: “the division of improved or unimproved land for the purpose of sale or lease, which is not defined as a subdivision , whose area is two and one-half acres or less in size, into two tracts or parcels if previously platted, or, three tracts or parcels of land or less if not previously platted.” (11.4.3 UDC).
13. The property at 5200 E 21st street will also be eligible for a split. The applications will be processed separately.
14. Ensure access standards found in section 7.8 of the UDC and sections 7-01.0.0 and 10-01.0.0 of the Technical Standards Manual are met.
15. As the current site at 5110 is already non-conforming to current code, any additional subdivision of that site will exacerbate the non-conformance and would likely not be supported by staff. The lot appears to have been split in 1999. Please provide any documentation regarding the split, as staff were unable to find any. A zoning determination my be necessary to verify the whether any building can take place on this parcel.
16. ADA parking will be required for the multi-Family development.
17. Any sites affected by this proposal must be brought up to compliance. For example, any parking reductions, trash enclosure removals, lot line adjustments, etc. could affect other sites. Any other sites would be required to address those changes on a separate development package. Another pre-submittal with staff may be necessary to discuss next steps.

1. Any existing curb or sidewalk that is non-compliant will be reconstructed to meet current standards.
2. New concrete driveway aprons are to be constructed per P.A.G. standard 206 at each new driveway entrance. Shared driveway aprons shall have a maximum curb cut width of 30 Ft.
3. Any existing curb cuts not used will be closed. Close with new concrete curb per P.A.G. standard 209 and new concrete sidewalk per P.A.G. standard 200.

1. Tucson Water’s Remote Meter Policy requires that all new lots have a minimum of 15’ of real property frontage onto a street, alley or existing water easement that contains a public water main.
2. 5220 (aka APN 12814132A) fronts existing 6” public water mains in E 21st Street and S Magnolia Avenue. The proposed lot split of 5220 is acceptable to Tucson Water as shown, as each of the new lots will have a a minimum of 15’ of real property frontage onto a street containing an existing public water main.
